On behalf of Whispering Pines of Franklin County (applicant and owner) please find
attached a complete application and supplemental information requesting written
concurrence from the US Army Corps of Engineers (USACE) and North Carolina Division
of Water Resources (NCDWR) that the activities associated with the proposed road
extension may proceed under Nationwide Permit (NWP) 29 and the associated General
Certification (GC) 4139. Please find attached a complete application and supplemental
information.
Project Summary and Purpose
The overall project is a single-family residential subdivision with residential streets and
utilities that will connect to existing adjacent roads and utilities in the area. The Project is
located southeast of Franklinton between Hicks Road and Cedar Creek Road, Franklin
County, NC. The purpose of the proposed project is to construct a residential subdivision
and associated utilities to meet the demand for housing in this part of Franklin County.
Project Detail
The overall project is a single-family residential subdivision that consists of residential lots
and associated utilities such as roads, sewer, electric, stormwater, etc. Residential streets
and utilities will connect to existing adjacent roads in the area. An existing sewer line
exists along the southern portion of the Site (north of Cedar Creek) which the project will
tie into. The proposed wetland impacts will result from road construction and wetland fill.

Heavy equipment typically used for utility installation projects (e.g. back hoes, bull-dozers,
etc) will be utilized.
No recorded federally listed species are located on the project site or within a 1-mile
radius according to the NC Natural Heritage Data Base (2018).
According to the SHPO website, the project is located approximately 2000 feet
southeast of the Michael Bailey House (Triple R Ranch) (Williams-Jones House)
(FK0479 surveyed only), a 1900 2-story Neoclassical Revival House, Ineligible 2005;
ER 03-1507; Multi Co Rpt #393. No impacts are anticipated to this structure.
Project History
Most of the project site has been forested or in pasture and crop production since the
early twentieth century. A riparian buffer determination was made by NCDWR staff on
February 22, 2016 and a determination letter (NBRRO# 16-030) was issued on February
25, 2016. A site meeting was held with Mr. James Lastinger of the USACE on May 23,
2016. A preliminary Jurisdictional Determination (SAW-2005-21019) was issued on July
25, 2016.
Avoidance and Minimization
Previously planned stream crossings were eliminated and the site plan redesigned to
avoid having any stream and riparian buffer impacts. A single perpendicular aerial sewer
crossing is proposed which will avoid stream impacts. Lot configurations were redesigned
and open space enlarged and reconfigured to avoid previously proposed lot fill in disjunct
wetland areas (e.g. immediately SE of the intersection of Sugar Pine Drive and Fire Oak
Drive; SE of the intersection of Fire Oak Drive and Three Oaks Trail; and east of Echo
Ridge Drive).
Project Impacts
Proposed wetland impacts will result from roadfill and lot fill in three locations of small
disjunct wetland pockets. Proposed permanent wetland impacts will total 0.156 acre. No
stream impacts are proposed. A single perpendicular aerial sewer crossing will result in
riparian impacts of 3,471 ft2 (950 ft2 in Zone 1 and 2,521 ft2 in Zone 2). No other impacts
are proposed.
Mitigation
No stream impacts are proposed therefore stream mitigation is not proposed. The only
proposed riparian buffer impacts will result from a perpendicular aerial sewer crossing
that is considered “allowable” therefore no buffer mitigation is proposed. Proposed
permanent wetland impacts total 0.156 acre. Wetland mitigation requirements will be met
through the purchase of 0.32 wetland mitigation credits from the Grantham Branch
Mitigation Site (Wildlands Holdings. III, LLC).
