Dcllingcr-Inc.com This letter is intended as a response to your Notice of Deticiency letter, dated March 2, 2018, noting Dellinger's violation of record keeping nnd maintenance of NPDES on our project in Beaufort County, NC. Since the findings of errors, carly January, Dellinger has met with the project Superintei�dent as well as the necessary NCDOT representatives to rectify these errors and to clarify the proper reporting procedure. Included in this meeting, Dellinger was given explanation and clariflcation regarding UZe misunderstanding diat led to the incomplete documents. Once these issues were resah�ed, Dellin�=er continued record keeping on this project until the Final Inspection without further issues. The pr�ject has since been �ccepted by NCDOT and therefore the reeord keeping has Ucen accepted. REGAN .��Pc'I'e•!tU•i' LINDA CIILPEPPER On February 7. ?018, Garcy Ward ofthe Nurth Carolina Division of Water Resources (NCDWR) Washineton Regional Office conducted an on-site inspection of the replacement uf Bridge No. 4 over Aggie Run on VOA Road in Bzaufort County. In addi[ion ro NCDWR staff, David Peasley with RK&K, [he on-si[e inspector was also presen[ durin� the inspection and his [ime and assistance is gready appreciated. During the inspection, a review of the NCG010000 inspectiun fornu revealed they were not bein, properly completed and maintained. Deficiencies include: • listing multiplz SDO's on a sin�le row and not breahing them out separately, • no SDO's listed for the week of January 22, ?018, • not conductine a follow up inspection within 24 hrs after a 0.5 in. or greater rain event durin, the week of January Z9, 2018, and • missing inspection fonns. Similar observations were noted and reported ro the on-site inspector during previous inspections on October 20, 30 � 7 and January ?6, ?018. The actions described above led to the following violation(s): I.) 401 WQC conditions violation: The NCDW R issued an approval letter allowing the impacts for the subject project under General Water Quality Certitication ( WQC) No. 4085 on May i0, 2017. NCDW R project number 20170407. Nnnh Cnrnlina 2'157a-IRI � The North Cazolina Deparunent of Transportation (NCDOT) shall be required to be in full compliance with the conditions related to construction activities within the most recent version of their individual NPDES (NCS000250) stormwater permit. Failure to ptoperly to properly complete and maintain the inspection records represents a violation of NCS000250 and therefore constimtes a violation of this condition. � a; 2.) NPDES (NCS000250) and NCGO10000 permit violations: Failure to properly complete and maintain inspection records does not meet the requirements set forth in NCS000250 Part II, Section C(1 xb)(ii) of NCDOT's individual NPDES permit and the self-inspection and reporting requiremenu specified in NCGO10000 Section [I.B(3). Accotdingly, you are d'uected to respond to this letter in writing within 30 caleodar days of receipt of this notice. Your response shall include the following: • List any actions necessary to remediate [he violation and prevent it from happening again.
