I am pleased to provide you with the additional information regarding the Matheson Avenue and 3e Street
Project requested by Mr. Alan Johnson ofNCDWQ at a field meeting on March 17, 2009.
Stormwater and Project Phasing
A map showing the division between Phase 1 and Phase 2 of the project is attached (Figure 1). Phase 2 of
the project is in the conceptual planning stage and cannot move further forward without approval for
Phase I which provides for access to the developable portion of the site. A complete storm-water plan
will be developed for phase II of the project if and when it moves forward. Our client is proposing to use
the Distressed Business District provision in the Charlotte-Mecklenburg Post Construction Ordinance
(attached) for Phase I of the project. As phase I of the project will not exceed 5 acres of impervious cover
our client will pay the required fee (Table 1, attached)) in lieu of a full storm-water plan.
Proposed Ditch - Design Changes
The proposed ditch linking the un-impacted portion of Unimportant Intermittent Stream A to Little Sugar
Creek has been redesigned (Figure 2, attached). The new ditch design will be graded with 4:1 side slopes.
The entire ditch will be planted with live stake material and will have fascines installed across the ditch at
35 to 50 foot intervals. The shallow grade of the ditch and the installation of fascines will ensure frequent
over bank flooding, thus maintaining the hydrological connection with adjacent wetland areas. Planting
the bottom of the ditch will also provide water quality benefits. A cross-section of the redesigned ditch is
also attached (Figure 2, inset). Step pools will be installed at the confluence of the ditch and Little Sugar
Creek in order to meet grade, a conceptual design of these step-pools (6 steps over 30 feet) is attached
(Figure 3).
Relocation of Road Drainage Outfall
As requested the outfall of the road drainage system has been relocated to the floodplain area north of
unimportant intermittent Stream A. A figure showing the new location of the outfall is attached (Figure 2).

Construction Ordinance
subdivision plat is recorded for the site, then the operations and maintenance agreement shall be
recorded with the Mecklenburg County Register of Deeds Office so as to appear in the chain of
title of all subsequent purchasers under generally accepted searching principles. A copy of the
recorded maintenance agreement shall be provided to the Storm Water Administrator within
fourteen (14) days following receipt of the recorded document. A maintenance easement shall
be recorded for every structural BMP to allow sufficient access for adequate maintenance. The
specific recordation and deed restriction requirements as well as notes to be displayed on final
plats and deeds shall be contained in the Administrative Manual.
SECTION 4: DEVELOPMENT AND REDEVELOPMENT MITIGATION
401 MITIGATION PAYMENT
(A) Lots Less than One Acre
Development and Redevelopment on a lot less than one (1) acre in size measured
in accordance with Section 106(H) is allowed by right to forego meeting the
requirements of this ordinance provided the City is paid a mitigation fee
according to rates set forth in the Administrative Manual and provided such
Development and Redevelopment are not part of a larger common plan of
development or sale, even though multiple, separate or distinct activities take
place at different times on different schedules.
(B) Transit Station Areas and Distressed Business Districts
Development and Redevelopment projects within transit station areas designated
by the Planning Director based on Corridor Record of Decisions, Council
Adopted Station Area Plan or distressed business districts designated by the
Economic Development Director are allowed by right to forego meeting the
requirements of this ordinance, except for peak control and downstream analysis
requirements on the increased impervious area of the project site, provided one
(1) of the following three (3) measures are implemented on the site:
(1) Provide 85% TSS removal from first inch of rainfall for entire site, or
(2) Provide 1-year 24-hour volume control and 10-year 6-hour peak control
for entire site, or
(3) Pay the City a mitigation fee according to rates set forth in the
Administrative Manual for the pre-project built upon area and any
additional impervious area not to exceed five (5) acres. New impervious
area in excess of five (5) acres must comply with this ordinance.
