This permit shall be effective from the date of issuance until August 31, 2020, shall void Permit No. WQ0000020 issued. Please pay particular attention to the groundwater monitoring requirements listed in Attachments C for they may differ from the previous permit issuance. Please note that on September 20, 2014,, Senate Bill 729 — Coal Ash ,Management Act of 2014 became law (attached.SL 2014-122). Accordingly, this act: superseded the 02T requirements for structural fill, which would include use as a base or subbase under,a paved road, parking lot, sidewalk, or similar structure; therefore, any future. CCP structural, fill projects must comply with this new law and all required permit application or documentation shall be submitted to the Division of Waste Management. However, the following activities are still deemed permitted under 15A NCAC 02T;1203: ♦ Use of CCPs as fuel for combustion in boilers, furnaces, etc. for energy recovery. ♦ Use of CCPs as material for manufacturing concrete products, asphalt products, brick products, lightweight aggregate roofing materials, insulation products, plastics, paints; Bowling balls, cosmetics and other manufactured products in: which the ash are encapsulated in. the manufactured product,. ♦ Use or disposal of CCPs in a solid waste facility ;permitted by the .Division of Waste Management that is approved to receive the CCPs. This permit shall be effective from the date of issuance until August 31, 2020, shall void Permit No. WQ0000020 issued February 17, 2006, and shall be subject to the following specified conditions and limitations: I. SCHEDULES 1. No later than six months prior to the expiration of this permit, the .Permittee shall request renewal of this permit in writing. Upon receipt of the request, the Division will review the adequacy of the facilities described therein, and if warranted, will renew the permit for such period of time and under such conditions and limitations as it may deem appropriate. Please note Rule 15A NCAC 02T .0105(d) requires an updated site map including sites approved for structural fill to be submitted with the permit renewal application. [15A NCAC 02T.01 08(b)(2), 02T .105(d), 02T.01 09] 2. Within 60 days of this permit issuance, the Permittee shall submit two copies of an 11X17 -inch site map that includes the following information for each structural fill site listed under the Attachment B: a. The location of major components of the waste disposal system. b. The location and identity of each monitoring well. c. The location of property boundaries. d. The location of compliance and review boundaries. [15A NCAC 02T .0108(b)(2)] H. PERFORMANCE STANDARDS The subject CCP structural fill facilities shall be effectively maintained and operated at all times so there is no discharge to surface waters, nor any contravention of groundwater or surface water standards. In the event the facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper operation and maintenance, the Permittee shall contact the Asheville regional office supervisor, and take any immediate corrective actions. [G.S. 143-215.1] 2. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or surface water resulting from the operation of the CCP structural fill facilities. [15A NCAC 02B .0200, 02L.0100] 3. Only CCPs generated by the facility listed in Attachment A are approved for structural fill in accordance with this permit. [G.S. 143-215.1] 4. Only the sites listed in Attachment B are approved for structural fill. [G.S. 143-215.1] 5. Concentration of pollutant during the performance of a Toxicity Characteristic Leaching Procedure (TCLP) of the CCP used at the structural fill sites shall not exceed the following limits: Parameter Leachate Concentration of Concern (milligrams per liter) Arsenic 5.0 Barium 100.0 Cadmium 1.0 Chromium 5.0 Lead 5.0 Mercury 0.2 Selenium 1.0 Silver 5.0 [15A NCAC 02T .1205(a)] 6. The compliance boundary for all structural fill sites listed in Attachment B shall be specified in accordance with 15A NCAC 02L .0107(b). These sites were individually permitted on or after December 30, 1983; therefore, the compliance boundary is established at either 250 feet from the CCP fill area boundary, or 50 feet within the property boundary, whichever is closest to the CCP fill area boundary. An exceedance of groundwater standards at or beyond the compliance boundary is subject to remediation action according to 15A NCAC 02L .0106(d)(2) as well as enforcement actions in accordance with North Carolina General Statute 143-215.6A through 143-215.6C. Any approved relocation of the COMPLIANCE BOUNDARY will be noted in Attachment B. [15A NCAC 02L .0107(a)] 8. In accordance with 15A NCAC 02L .0108, the review boundary for all structural fill sites listed in Attachment B shall be established midway between the compliance boundary and the CCP fill area boundary . Any exeeedance of groundwater standards at the review boundary shall require action in accordance with 15A NCAC 02L.0106. [15A NCAC 02L.0108] 7. All wells constructed for purposes of groundwater monitoring shall be constructed in accordance with 15A NCAC 02C .0108 (Standards of Construction for Wells Other than Water Supply), and any other jurisdictional laws and regulations pertaining to well construction. [15A NCAC 02C .0108] 8. Except as provided for in 15A NCAC 02L .0107(g), the Permittee shall ensure any landowner who is not the Permittee and owns land within the compliance boundary shall execute and file with the appropriate County Register of Deeds an -easement running with the land containing the following items: a) A notice of the permit and number or other description as allowed in 15A NCAC 02L ,0107(f)(1); b) Prohibits construction,and operation of water supply wells within the compliance boundary; and c) Reserves the right of the Permittee and the State to enter the property within the compliance boundary for purposes related to the permit. The Director may terminate the easement when its purpose has been fulfilled or is no longer needed. [15A NCAC 02L .0107(f)] III. OPERATION AND MAINTENANCE REQUIREMENTS 1. The CCP structural fill facilities shall be properly maintained and operated at all times. The program shall be effectively maintained and operated as a non -discharge system to prevent any contravention of surface water or groundwater standards. [15A NCAC 02T .1207] 2. The Permittee shall maintain an Operation and Maintenance Plan (O&M Plan) pursuant to 15A NCAC 02T .1208. The O&M Plan, at the minimum, shall include: a) Operational functions b) Maintenance schedules c) Safety measures d) Spill response plan e)` Sampling and monitoring plan [15A NCAC 02T .1208] w00000090 Vevzinn 1 0 ChPll VP'Q;^n 14ns2n1 n....,.1) _r0 IV 3. For the storage areas of CCPs and sites where CCPs are used for structural fill and bedding, where the bedding is applied at a depth greater than 2 feet underneath the structure, the following minimum setbacks (i.e., in feet) shall be adhered to: a. Private or public water supply sources: 100 feet b. Surface waters (streams — intermittent and perennial, lakes, perennial water bodies, and wetlands): 50 feet c. Wells with exception to monitoring wells: 100 feet d. Seasonal high water table: 2 feet All distances are horizontal distances except for the distance from a seasonal high water table which is a measured as a vertical distance. [15A NCAC 02T.12061 1. Any Division required monitoring (including groundwater, plant tissue, soil, slope structural integrity, cap maintenance, permanent cap completion, leachate collection, surface water analyses, etc.) necessary to ensure groundwater and surface water protection shall be established, and an acceptable sample reporting schedule shall be followed. Monitoring requirements for permitted structural fill sites can be found in attachment C. [15A NCAC 02T .0108(c)] 2. CCPs shall be analyzed for toxicity characteristic leaching procedure (TCLP) at the frequency specified in Attachment A, and the Permittee shall maintain these results for a minimum of five years. Any exceptions from the requirements in this condition shall be specified in Attachment A. The TCLP analysis shall include the following parameters: Arsenic (5.0) Chromium (5.0) Selenium (1.0) Barium (100.0) Lead (5.0) Silver (5.0) Cadmium (1.0) Mercury (0.2) Zinc (15A NCAC 02T .1205(a)] 3. An analysis shall be conducted on CCP from each source generating facility at the frequency specified in Attachment A, and the Permittee shall maintain the results for a minimum of five years. The analysis shall include the following parameters: Arsenic Lead Nickel Cadmium Mercury Selenium Copper Molybdenum Zinc [15A NCAC 02T .1205(6)] 4. Laboratory parameter analyses shall be performed on the CCP as they are distributed, and shall be in accordance with the monitoring requirements in 15A NCAC 02B .0505. At a minimum, these records shall include the following: a. Source of CCP; b. Receiver of CCP. c. Intended use of CCP; and d. Date and Volume of CCP distributed. [15A NCAC 02T.0 109(a)] 6. The Permittee shall maintain records of monitoring results to demonstrate compliance with specific requirements as stipulated under 15A NCAC 02T .1203 for CCP distributed for deemed permitted activities. 7. Three copies of an annual report shall be submitted on or before March I". The annual report shall include summary of sampling, analytical results, and record keeping as required in Conditions IV.1 through IV.6. Any emergency requiring immediate reporting (e.g., discharges to surface waters, imminent failure of a storage structure, etc.) outside normal business hours shall be reported to the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also file a written report in letter form within five days .following first knowledge of the occurrence. This report shall outline the actions taken .or proposed to be taken to ensure that the problem does not recur. [15A NCAC 02T .0105(1), 02T .0108(b)(1)] 9. Monitoring wells at each. structural fill site listed under Attachment B shall be sampled at the frequencies and for the parameters specified in Attachment C. All mapping, well construction forms well abandonment forms and monitoring data shall refer to the permit number and the well nomenclature as provided in Attachment B. [15A NCAC 02T .0105(m)] 10. For initial sampling of monitoring wells, 'the Permittee shall submit a Compliance Monitoring Form (GW-59CCR) and a Well Construction Record Form (GW -1) listing this permit number and the appropriate monitoring well identification number. Initial Compliance Monitoring Forms (GW- 59CCR) without copies of the Well Construction Record Forms (GW -1) are deemed incomplete, and may be returned to the Permittee without being processed. [15A NCAC 02T.0 I 05(m)] 11. Two copies of the monitoring well sampling and analysis results shall be submitted on a Compliance Monitoring Form (GW-59CCR), along with attached copies of laboratory analyses, on or before the last working day of the month following the sampling month. The Compliance Monitoring Form (GW-59CCR) shall include this permit number and the appropriate well identification number. Noncompliance and Incident Notification The Permittee shall report by telephone to the Asheville Regional Office, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any failure of the CCP structural fill facilities resulting in a release of material to surface waters. b. Any time self-monitoring indicates the facility has gone out of compliance with its permit limitations. c. Any spill or discharge from a vehicle or piping system during residuals transportation. d. Any groundwater standard violation detected at a compliance boundary. e. Any incident involving breech of the liner system, excavations within 3 feet of the liner system, severe erosion, slope failure, changes in leachate quantity or quality, and damage to groundwater monitoring wells. [15A NCAC 02T .0105(l), 02T .0108(b)(1)] 1. The Permittee shall provide adequate inspection and maintenance to ensure proper operation of the subject structural fill facilities and shall be in accordance with the approved O&M Plan. Inspection and maintenance of approved structural fill sites shall include, but not be limited to, integrity of intermediary and permanent caps, structural integrity, erosion, liner systems, stormwater collection systems, condition of monitoring wells, etc. [15A NCAC 02T .0108(b)] 2. The post -closure inspection shall be conducted quarterly on all structural fill sites listed under Attachment B. The Permittee shall maintain an inspection log and report that include, at a minimum: a. Date and time of inspection; b. Name and title of person who conducted the inspection; c. Observation results on structural integrity, erosion, liner systems, integrity of the cap system, stormwater collection systems, condition of monitoring wells, settlement, subsidence, seepage, and presence of woody vegetation; d. Description and photo documentation of any pertinent issues such as a breech in the liner system, excavations within 3 feet of the liner system, erosion, development of depressions, slope movement, damage to monitoring wells, and groundwater seepage; e. Any maintenance, repairs, or corrective actions taken; f. An annual engineer's certification of the evaluation on the structural integrity and stability of the ash fill areas. An annual inspection report containing items a. through f. shall be submitted to the Asheville Regional office on or before December 31". [15A NCAC 02T.0 108(b)] 3. Any duly authorized Division representative may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the structural fill sites permitted herein at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records required to be maintained under the terms and conditions of this permit; and may collect groundwater, surface water or leachate samples. Failure to comply with the conditions and limitations contained herein may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes 143- 215.6A to 143-215.6C. [G.S. 143-215.6A to 143-215.6C] 2. This permit shall become voidable if the CCP management are not carried out in accordance with the conditions of this permit. [15A NCAC 02T .0110] 3.. This permit is effective only with respect to the nature and volume of CCP described in the permit application and other supporting documentation. [G. S. 143-215.1] 4. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other jurisdictional government agencies (e.g., local, state, and federal). Of particular concern to the Division are applicable river buffer rules in 15A NCAC 02B .0200; -erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Pen -nit NCGO10000; any requirements pertaining to wetlands under- 15A nder15A NCAC 02B .0200 and 02H .0500; and documentation of compliance with Article 21 Part 6 of Chapter 143 of the General Statutes. [15A NCAC 02T.01 05(c)(6)) 5. In the event the approved structural fill sites change ownership or the Permittee changes their name, a formal permit modification request shall be submitted to the Division. This request shall be made in writing, and shall include appropriate documentation from the parties involved and other supporting documentation as necessary. The Permittee of record shall remain fully responsible for maintaining and operating the structural fill sites permitted herein until a permit is issued to the new owner. [15A NCAC 02T.0104] 6. The Permittee shall maintain this permit until all permitted facilities herein are properly closed or permitted under another permit issued by the appropriate permitting authority pursuant to 15A NCAC 02T .01050). This permit is subject to revocation or unilateral modification upon 60 days notice from the Division Director, in whole or part for the requirements listed in 15A NCAC 02T .0110. Unless the Division Director grants a variance, expansion of the permitted residuals program contained herein shall not be granted if the Permittee exemplifies any of the criteria in 15A NCAC 02T .0120(b). Wouldn't we want these in their monitoring plan to be consistent with their NPDES permitted wells? Ones not included were: Aluminum, beryllium, calcium, cobalt, magnesium, molybdenum, potassium, sodium, strontium, vanadium, alkalinity, bicarbonate, carbonate, TSS, Specific Conductivity, Dissolved Oxygen, ORP. Also, a different question. The parameters in red. All the parameters listed above were placed in the groundwater monitoring plan for consistency with what we are sampling outside the compliance boundary. However, in discussing this, they don't really seem to be directed toward compliance, although we understand why we would need them in the water supply well sampling. SECTION 3.(f) limits the application of the law to the use of coal combustion products as structural fill contracted for on or after September 20, 2014. DEP will provide comments via email to you separate from this letter on draft permit WQ0000020 which removes Area 2 from the permit. Charah, Inc. will pursue an individual structural fill permit pursuant to Session Law 2014-122 for Area 2 at the Asheville Regional Airport. 2. Submit two copies of an 11 x 17 -inch site map that includes the following information for each structural fill site listed under the Attachment B of the Draft permit: a. The location of major components of the waste disposal system. b. The location and identity of each monitoring well. c. The location of property boundaries. d. The location of compliance and review boundaries. Note that the draft permit provides Duke with an additional 60 days to provide this information after permit issuance. As response to this information request provide either the information requested or acknowledge that the information will be sent within 60 days of permit issuance. Submit the Operation and Maintenance (O&M) plan as required by 15A NCAC 02T .0108(b)(2). Provide documentation addressing all the outstanding items (i.e. groundwater modeling, leachate results) related to Area 3 as required by the Division June 16, 2014 letter to Mr. John Toepfer (see attached). As part of our ongoing commitment to the environment, Duke Energy Progress, Inc. (DEP or Duke Energy) seeks to handle these products in the safest, most responsible manner possible, either through beneficial reuse or storage. The Ash Distribution Program Permit W00000020 issued to DEP is set to expire on February 28, 2015. This letter constitutes a request for an extension of this permit. Attached are the TCLP results for each source generating facility as required by Condition 111.3. of the permit. DEP also offers the following comments for your consideration in drafting this permit renewal: General Comment for Permit W00000020 dated February 17. 2006: • When discussing structural fill in the permit, DEP recommends the following wording: "structural fill shall mean an engineered fill constructed using CCRs that are properly placed and compacted. This shall include fill used for embankments, greenscapes, foundations, construction foundations, and for bases/sub-bases under a structure or a footprint of a paved road, parking lot, sidewalk, walkway or similar structure." This wording is slightly different than that in our permit but more reflective of structural fill projects DEP encounters and that of 15A NCAC 02T.1202. Condition Specific Comments for Permit W00000020 dated February 17 2006: • DEP requests the removal of Condition 11.2. regarding an operator to be in responsible charge (ORC). This activity is not classified by the Water Pollution Control System Operators Certification Commission (WPCSOCC) and therefore, does not require an ORC. • Under Condition 11.3.b. DEP requests a modification in wording for the approved uses for bottom ash as the Department of Transportation cannot approve the use of bottom ash in areas it does not have jurisdiction. The permit presently reads, "Overlay for secondary roads, residential driveways, farm roads and high -traffic farm areas as approved by the NC Department of Transportation". DEP requests a u� modification to the following: "Overlay for roads as approved by the NC Department of Transportation, residential driveways, private roads, farm roads and high -traffic farm areas". • Under Condition 11.3.b., DEP requests the following uses be approved for consistency with other permits issued by the Land Application Unit and approvals by other DENR divisions: Bottom Ash: Material for traction control during snow and ice events as approved by the NC Department of Transportation. Approval by the NC Department of Transportation is not required for use on private roads. Flowable fill for the backfill of trenches for potable water mains as approved by the NC Division of Environmental Health, sanitary sewers, storm drainage structures and other trenching uses. Soil nutrient additive, amendment, or other agricultural purpose as approved by the NC Department of Agriculture and Consumer Services. Raw product for the stabilization of wastewater residuals. Mine reclamation as approved by DENR Division of Energy, Mineral and Land Resources Mining Program. Fly Ash: Flowable fill for the backfill of trenches for potable water mains as approved by the NC Division of Environmental Health, sanitary sewers, storm drainage structures and other trenching uses. Overlay for roads as approved by the NC Department of Transportation, residential driveways, private roads, farm roads and high -traffic farm areas. Structural/engineered fill (i.e. engineered fill that is properly placed and compacted) for embankments, greenscapes, foundations, construction foundations, and for bases/sub-bases under a structure or a footprint of a paved road, parking lot, sidewalk, walkway or similar structure. For CCRs used as fill, this exemption shall be limited to individually permitted sites, as stipulated in Condition IV.1.a, and the Permittee shall meet the performance standard stipulated in Condition 1.5. to ensure that the applicable surface water quality standards and groundwater quality standards are not contravened. b. Fuel for combustion in boilers, furnaces, etc. for energy recovery. c. Material for manufacturing of concrete products, asphalt products, brick products, lightweight aggregate, roofing materials, insulation products, plastics, paints, bowling balls, cosmetics, and other manufactured products in which the CCRs are encapsulated. d. Daily, intermediate and final cover as well as any other use at a landfill as approved by the NC Division of Waste Management. C e. Overlay for roads as approved by the NC Department of Transportation, residential driveways, private roads, farm roads and high -traffic farm areas. f. Material for traction control during snow and ice events, provided that the CCRs do not exceed the leachate concentrations of concern specified in this Condition. g. Substitute for blasting grit, roofing granules and filter cloth precoat for residuals dewatering, provided that the CCRs do not exceed the leachate concentrations of concern specified in this Condition. h. Flowable fill for backfill of trenches for potable water mains as approved by the NC Division of Environmental Health, sanitary sewers, storm drainage structures, and other trenching uses, provided that the CCRs do not exceed the leachate concentrations of concern specified in this Condition. L Raw product for the stabilization of residuals. j. Base or subbase under a structure or footprint (i.e. engineered fill that is properly placed and compacted) of a paved road, parking lot, sidewalk, or similar structure as long as the total depth of the CCRs does not exceed one foot." k. Mine reclamation as approved by DENR Division of Energy, Mineral and Land Resources Mining Program. For CCRs used in this manner, this exemption shall be limited to individually permitted sites, as stipulated in Condition IV.1.a, and the Permittee shall meet the performance standard stipulated in Condition 1.5. to ensure that the applicable surface water quality standards and groundwater quality standards are not contravened. • Under Condition 11.6. and 11.7., DEP requests removal of reference to PEC document EVC-FGDC-00101 "Ash Utilization Plan". • Also at Condition 11.7., DEP requests removal of the following wording, "Adequate provisions shall be taken to prevent wind erosion and surface water runoff from conveying ash from stockpile/storage areas onto adjacent property or into any surface waters prior to distribution and use" Since the CCRs are generated and stored on our applicable generation sites, this provision conflicts and overlaps with other regulations and permits that are issued to the site by DENR. Details are explained below: CCRs accumulate within DEP ash ponds which are permitted wastewater treatment units that operate under an NPDES permit. Ash ponds serve as the treatment units for separation of ash from sluice water FII and are not stockpile or storage areas. Each plant's individual NPDES permit prohibits the discharge of untreated effluent, prescribes the conditions under which a discharge may occur and specifically regulates storm water runoff from each plant property, including storm water runoff from any and all stockpiles. Air emissions, including fugitive dust, at each individual plant site are regulated by Title V of the Clean Air Act with air permits containing specific language that addresses fugitive dust emissions from coal, coal conveyances, CCRs and on-site roads. Avoidance of nuisance conditions from CCRs is specifically included in each plant's individual Title V permit. Therefore, the language and intent of regulating storm water and fugitive dust emissions from CCRs and on-site roads under Condition 11.7. are already addressed within each plant's individual NPDES permit issued by the NC Division of Water Resources and each plant's individual Title V air permit issued by the NC Division of Air Quality. Additional regulation of storm water and fugitive dust emissions by DWR is duplicative of regulatory permitting already administered by State agencies whose directive is specialized for storm water control and air quality protection. • DEP requests that Condition 11.9. be updated to be consistent with 15A NCAC 02T.1206. • Condition 111.3. states that reach source generating facility must complete a TCLP test for the eight RCRA metals only if ash was reused during that calendar year. However, once a permit cycle, each source generating facility must complete a TCLP test for all 40 TCLP parameters. The TCLP test comprises eight RCRA metals (arsenic, barium, cadmium, chromium, lead, mercury, selenium and silver), pesticides and herbicides (chlordane, endrin, heptachlor (and its hydroxide), lindane, methoxychlor, toxaphene, 2,4-D and 2,4,5 -TP) along with volatile and semi -volatile organics (benzene, carbon tetrachloride, chlorbenzene, chloroform, cresol, o -cresol, m -cresol, p -cresol, 1,4 - dichlorobenzene, 1,2-dichloroethane, 1,1-dichloroethylene, 2,4-dinitrotoluene, hexachlorobenzene, hexachloro-1,3-butadiene, hexachloroethane, methyl ethyl ketone, nitrobenzene, pentachlorophenol, pyridine, tetrachloroethylene, trichloroethylene, 2,4,5-trichlorphenol, 2,4,6 -trichlorophenol and vinyl chloride). Coal does not contain pesticides and herbicides and therefore, coal ash does not contain pesticides and herbicides. Any volatile or semi -volatile constituents of coal have been combusted in the boiler at temperatures of 1,900 F for three to five seconds and therefore, volatile and semi -volatile organic constituents are not present in coal ash. Our past three permit renewals (including this one) confirm that pesticides and herbicides along with volatile and semi -volatile organics are not present in coal ash. As such, DEP requests that this requirement be modified such that each source generating facility completes and annual TCLP test on a representative ash sample once per year for only the eight RCRA metals if that facility uses ash during the calendar year. During a permit cycle, the TCLP test should also be required for only the eight RCRA metals. 5 • Condition 111.4. requires sampling up to 12 times per year. However, the permit allows for a reduction in frequency of this monitoring. DEP appreciates your consideration of our comments and operations in renewing this permit because beneficial reuse of CCRs is both environmentally sound and cost-effective solution. Wilmington StreeYNC14 Raleigh, NC 27601 In April 2013; Duke Energy notified the Division of Water Resources (DWR) of a name change from Progress Energy Carolinas, Inc. to Duke Energy Progress, Inc. The Land Application Unit was the only program within DWR to issue an updated permit, or a draft permit, based upon the name change request. Rather, for example, the Wastewater Branch, which issues NPDES wastewater permits, made note of the name change in the electronic database and intends to update the affected permits upon renewal. As such, Duke Energy requests that you rescind the draft permit No. WQ0000020 and incorporate necessary updates, including the name change, at permit renewal. The draft permit maintained the expiration date of February 28, 2015. As requested during our meeting on September 30, 2013, to discuss -the proposed draft permit WQ0000020, Duke Energy provides the following comments. Page 1 of 10 • The permit should be issued to "Duke Energy Progress, inc." Similarly, in the first sentence, add ",.Inc. (Duke Energy Progress)". Duke Energy requests that the second and third sentences from the first paragraph be deleted: "The use and disposal of ash residuals are regulated under Title 40 Code of Federal Regulations Part 257. This permit does not exempt the Permittee from complying with the federal regulations." Sluiced ash is a wastewater regulated by the NPDES program, therefore the reuse of wastewater treatment residuals is not governed by solid waste regulations. Residuals permitted under NPDES permits are exempt from the solid waste regulations, per § 130A-290 (35)(b)(3): "Solid waste" means any hazardous or nonhazardous garbage, refuse or sludge from a waste treatment plant, water supply treatment plant or air pollution control facility, McDaniel Letter October 25. 2013 domestic sewage and sludges generated by the treatment thereof in sanitary sewage collection, treatment and disposal systems, and other material that is either discarded or is being accumulated, stored or treated prior to being discarded, or has served its original intended use and is generally discarded, including solid, liquid, semisolid or contained gaseous material resulting from industrial, institutional, commercial and agricultural operations, and from community activities. The term does not include: a. Fecal waste from fowls and animals other than humans. b. Solid or dissolved material in: Domestic sewage and sludges generated by treatment thereof in sanitary sewage collection, treatment and disposal systems which are designed to discharge effluents to the surface waters. Irrigation return flows. Wastewater discharges and the sludges incidental to and generated by treatment which are point sources subject to permits granted under Section 402 of the Water Pollution Control Act, as amended (P.L. 92-500), and permits granted under 6.5. 143-115.1 by the Environmental Management Commission. However, any sludges that meet the criteria for hazardous waste under RCRA shall also be a solid waste for the purposes of this Article. Condition I Schedules, Item 1 • Duke Energy requests a copy of the official Division forms referenced. "Permittee shall request renewal of this permit on official Division forms." Duke Energy requests replacing the time period from "six months" to "180 days" to be consistent with units of time elsewhere in the permit and to be consistent with other permitting language. Condition I Schedules, Item 2 • Duke Energy requests replacing the phrase "...for each structural fill site listed under the Attachment B:" with "...for each currently -approved structural fill site.". Duke Energy requests confirmation that an updated site plan will not be required for the Sutton Plant project. Duke Energy understands the requirement of rule 15A NCAC 02T .010S(d) to submit updated site plans for approved structural fill sites if those plans were required as part of the original submittal. Since the structural fill project with ash from the Sutton Plant was completed between 2001 and 2003 under Permit WQ0000020 dated July 9, 1998, prior to the codification of the 2T rules, Duke Energy believes the requirements of this condition does not apply to this project. Condition II Performance Standards, Item 1 • Duke Energy requests that the phrase "of the ash stockpile/storage areas or the ash reuse site" be inserted following the wording "operation and maintenance" in the second sentence. Condition II Performance Standards, Item 7 • Duke Energy requests that the first sentence be deleted and the second sentence be modified to read: "The Permittee shall submit an application, including all required documentation as required under 15A NCAC 02T .1204(d), for Division's approval prior to commencement of any -6 McDaniel Letter October 25, 2013 new or expanding structural fill sites." After approval, the Division would issue an "approval" letter and the project would be covered under the issued permit, without reissuance. Condition 11 Performance Standards, Item 8 • Duke Energy requests that the phrase "...listed in Attachment 8..." be deleted and the word "approved" be inserted before "structural fill sites...". • Duke Energy requests that the word "permitted" in the second sentence be changed to "approved". • Duke Energy requests that the last sentence be modified to delete the reference to Attachment B and instead insert "...will be included in the application for the site. Condition II Performance Standards, Item 9 • Duke Energy requests that the phrase "...listed in Attachment 8..." be deleted and the word "approved" be inserted before "structural fill sites...". Condition III Operation and Maintenance Requirements, Item 3 • Duke Energy requests removal. of wording "and NPDES treatment units" from line 2. Condition IV Monitoring and Reporting Requirements,, Item 5 • Duke Energy requests that "...each structural fill site listed under Attachment 8..." be replaced with "...each approved structural fill site...". Condition IV Monitoring and Reporting Requirements, Item 7 • Duke Energy requests that for number "GW-59"'be changed to "GW-59CCR" for consistency with the report submits to NCDENR per NPDES wastewater permit requirements. Condition IV Monitoring and Reporting Requirements, item 8 • Duke Energy requests that the Land Application Unit utilize the format for information exchange that has been established per the NPDES wastewater permit for groundwater results around our ash basins. Duke Energy provides two copies of GW-59CCR to the Information Processing Unit and'one copy to the appropriate regional office. The laboratory results are not included, but rather maintained onsite and available to DENR upon request. Therefore, Duke Energy requests that the submittal form be changed to GW -5 9CCR and the phrase ".,.along with attached copies of laboratory analyses..." be deleted. "Condition VI General Conditions, Item 5 • Duke Energy requests that the wording "...or method otherwise approved by the Director" be added following the "This request shall be make on official Division forms, ..." For the convenience of both parties, the Director approved the methodology used during the Progress Energy Carolinas to Duke Energy Progress name change. This was not an ownership change which would have required documentation of transference. Attachment B: 0 Duke Energy requests that Attachment B be removed. Approved projects, based on the McDaniel Letter October 25, 2013 submitted application documents and approved sampling locations, are on file at your office. Listing approved sites in the permit would require a new permit issuance for any subsequent projects. Duke Energy recommends removing Attachment B and substituting language provided in other comments. Otherwise, if Attachment B remains, Duke Energy requests that a footnote be added to the attachment title to indicate that this attachment includes projects that were approved at time of permit issuance. Subsequent approved projects are maintained in your files. The division would provide a letter to Duke Energy acknowledging receipt, review and approval for each subsequently submitted project. All of Duke Energy s reuse of ash besides that of structural fills are uses that are deemed permitted per 15A NCAC 02T.1203. Should DWR remove DEP's authorization to perform future structural fills and require that each site receive specific approval, then it calls into question the need for Duke Energy to hold an ash reuse permit. The list of permits included permit WQ0000020 which authorizes the beneficial reuse of coal combustion products (CCP) generated as part of the wastewater treatment systems at the seven utilities previously owned by Progress Energy. Duke Energy Carolinas, LLC. holds a similar permit (W00000452) for seven additional utilities. Permit WQ000020 was issued prior to the promulgation of the rules coving the reuse of CCP (15A NCAC 02T) and as a result have a few inconsistencies with current administrative code that the Division has intended to address during the next permit renewal or modification. Similarly, updated permit language is needed in both the Progress and Duke permits (WQ0000020 & WQ0000452) to improve clarity concerning the reuse of CCP as a structural fill that was described in detail in April 2009 letters sent to both organizations (unsigned copies attached). It is my desire to ensure that all of the utilities have consistent requirements when reusing CCP and to ensure that the permits reflect current statutory and administrative code requirements using the most recently available permit language. It is my preferred path to combine the CCP permits into one permit for all of the utilities owned by Duke Energy wishing to continue to distribute CCP for reuse; however, I understand that this may not yet fit the business model for your organization. Please get back to me with how you would prefer to move forward with the ownership change request and handling of the two permits. If you would prefer to keep the permits separate, please provide suggestion on how best to ensure consistency between the two permits. Also on the disc is the background groundwater analysis completed at wells W-1 through W-10. These wells were installed as part of the background investigation and have been closed out.
