The Aquifer Protection Section has reviewed the permit renewal request submitted on August 24, 2012
for the above referenced facility. Mr. John Toepfer (Duke Energy Corporation) was contacted via
telephone on August 27, 2012 and was informed that the subject permit is affected by Session Law 2009-
406 and 2010-177 which extend coverage of certain government permits and approvals and added
additional years to the permit expiration date. Therefore, permit number W00000020 is extended until
February 28, 2015.
Your application is being returned as indicated by Mr. Toepfer that no further action is required from the
Division at this time. However, if it is determined by Duke Energy Corporation later that a permit
modification to change some permit language is needed, the applicant can re -submit a permit
modification request to the Division.

Dear Mr. Risgaard:
In the process of generating electricity, coal-fired plants generate Coal Combustion Residuals (CCRs). As
part of our ongoing commitment to the environment, Carolina Power & Light Company d/b/a/ Progress
Energy Carolinas, Inc. (PEC) seeks to handle these products in the safest,, most responsible manner
possible, either through beneficial reuse or storage. The Ash Distribution Program Permit WQ0000020
issued to PEC is set to expire on February 28, 2013. This letter constitutes a request for an extension of
the subject permit. Attached are the Toxicity Characteristic Leaching Procedure (TCLP) results for each
source generating facility as required by Condition 111.3. of the permit. We also offer the following
comments for your consideration in drafting the permit renewal:
General Comment for Permit WQ0000020 dated February 17. 2006:
• When discussing structural fill in,the permit, we recommend the following wording: "structural
fill shall mean an engineered fill constructed using CCRs that are properly placed and
compacted. This shall include fill used for embankments, greenscapes, foundations,
construction foundations, and for bases/sub-bases under a structure or a footprint of a paved
road, parking lot, sidewalk, walkway or similar structure." -This wording is slightly different than
that in our current permit but more reflective of structural fill projects we encounter and that of
15A NCAC 02T.1202.
Condition Specific Comments for Permit WQ0000020 dated February 17, 2006:
• We request the removal of Condition 11.2. regarding an operator to be in responsible charge
(0 RC). This activity is not classified by the Water Pollution Control System Operators
Certification Commission (WPCSOCC) and therefore, does not require an ORC.
• Under Condition 11.3.b. we request a modification in wording for the approved uses for bottom
ash as the Department of Transportation can not approve the use of bottom ash in areas it does
not have jurisdiction. The permit presently reads, "Overlay for secondary roads, residential
driveways, farm roads and high -traffic farm areas as approved by the NC Department of
Transportation". We request a modification that reads: "Overlay for roads as approved by the
NC Department of Transportation, residential driveways, private roads, farm roads and high -
traffic farm areas".

• Under Condition 11.3.b., we request the following uses be approved for consistency with other
permits issued by the Land Application Unit:
Bottom Ash:
Material for traction control during snow and ice events as approved by the NC
Department of Transportation. Approval by the NC Department of Transportation is not
required for use on private roads.
Flowable fill for the backfill of trenches for potable water mains as approved by the NC
Division of Environmental Health, sanitary sewers, storm drainage structures and other
trenching uses.
Soil nutrient additive, amendment, or other agricultural purpose as approved by the NC
Department of Agriculture and Consumer Services.
Raw product for the stabilization of wastewater residuals.
Fly Ash:
Flowable fill for the backfill of trenches for potable water mains as approved by the NC
Division of Environmental Health, sanitary sewers, storm drainage structures and other
trenching uses.
Overlay for roads as approved by the NC Department of Transportation, residential
driveways, private roads, farm roads and high -traffic farm areas
• We request the language in Condition 11.5 be changed to the following' -for consistency with
other permits issued by the Land Application Unit:
"Except as exempted by the condition, the Leachate Concentrations during the performance of a
Toxicity Characteristic Leaching Procedure (TCLP), the Ceiling Concentrations (i.e., dry weight
basis) and the Pollutant Monthly Average Concentrations (i.e., dry weight basis) shall be
maintained at levels less than the values listed in the table below for ash to be distributed
throughout the ash distribution program:

The following uses approved for distributed ash under the ash distribution program in
accordance with this permit shall be exempt from meeting the requirements of this condition
provided the activity does not result in any violations of water quality.standards, and there is no
direct discharge to surface waters:
a. Structural/engineered fill (i.e. engineered fill that is properly placed and compacted) for
embankments, greenscapes, foundations, construction foundations, and for bases/sub-
bases under a structure or a footprint of a paved road, parking lot, sidewalk, walkway or
similar structure. For CCRs used as fill, this exemption shall be limited to individually
permitted sites, as stipulated in Condition IVA.a, and the Permittee shall meet the
performance standard stipulated in Condition 1.5. to ensure that the applicable surface
water quality standards and groundwater quality standards are not contravened.
b. Fuel for combustion in boilers, furnaces, etc. for energy recovery.
c. Material for manufacturing of concrete products, asphalt products, brick products,
lightweight aggregate, roofing materials, insulation products, plastics, paints, bowling balls,
cosmetics, and other manufactured products in which the CCRs are encapsulated.
d. Daily, intermediate and final cover as well as any other use at a landfill as approved by the
NC Division of Waste Management.
e. Overlay for roads as approved by the NC Department of Transportation, residential
driveways, private roads, farm roads and high -traffic farm areas.
f. Material for traction control during snow and ice events, provided that the CCRs do not
exceed the leachate concentrations of concern specified in this Condition.:
g. Substitute for blasting grit, roofing granules and filter cloth precoat for residuals dewatering,
provided that the CCRs do not exceed the leachate concentrations of concern specified in
this Condition.
h. Flowable fill for backfill of trenches for potable water mains as approved by the NC Division
of Environmental Health, sanitary sewers, storm drainage structures, and other trenching
uses, provided that the CCRs do not exceed the leachate concentrations of concern specified
in this Condition.

j. Base or subbase under a structure or footprint (i.e. engineered fill that is properly placed
and compacted) of a paved road, parking lot, sidewalk, or similar structure as long as the
total depth of the CCRs does not exceed one foot."
• Under Condition 11.6. and 11.7., we request removal of reference to PEC document EVC-FGDC-
00101 "Ash Utilization Plan".
• Also at Condition 11.7., we request modification of the wording to read, "Adequate provisions
shall be taken to prevent wind erosion and surface water runoff from conveying ash from active
structural fill stockpile/storage areas onto adjacent property or into any surface waters prior to
distribution and use. This condition does not apply to ash storage facilities regulated by another
permit (e.g. NPDES permit)".
Since the CCRs are generated and stored on our applicable generation sites, this provision
conflicts and overlaps with other regulations and permits that are issued to the site by DENR.
Details are explained below:
CCRs accumulate within PEC ash ponds which are permitted wastewater treatment units that
operate under an NPDES wastewater permit. Ash ponds serve as the treatment units for
separation of ash from sluice water and are not stockpile or storage areas. Each plant's
individual NPDES wastewater permit prohibits the discharge of untreated effluent, prescribes
the conditions under which a discharge may occur and specifically regulates storm water runoff
from each plant property, including storm water runoff from any and all stockpiles.
Air emissions, including fugitive dust, at each individual plant site are regulated by Title V of the
Clean Air Act with air permits containing specific language that addresses fugitive dust emissions
from coal, coal conveyances, CCRs and on=site roads. Avoidance of nuisance conditions from
CCRs is specifically included in each plant's individual Title V permit.
Therefore, the language and intent of regulating storm water and fugitive dust emissions from
CCRs and on-site roads under Condition 11.7. are already addressed within each plant's individual
NPDES wastewater permit issued by the NC Division of Water Quality and each plant's individual
Title V air permit issued by the NC Division of Air Quality. Additional regulation of storm water
and fugitive dust emissions by the Aquifer Protection Section is duplicative of regulatory
permitting already administered by State agencies whose directive is specialized for storm water
control and air quality protection.
• We request that Condition 11.9. be updated to be consistent with 15A NCAC 02T.1206.
• Condition 111.3, states that reach source generating facility must complete a TCLP test for the
eight RCRA metals only if ash was reused during that calendar year. However, once a permit
cycle, each source generating facility must complete a TCLP test for all 40 TCLP parameters.
The TCLP test comprises eight RCRA metals (arsenic, barium, cadmium, chromium, lead,
mercury, selenium and silver), pesticides and herbicides (chlordane, endrin, heptachlor (and its
hydroxide), lindane, methoxychlor, toxaphene, 2,4-D and 2,4,5 -TP) along with volatile and semi -
volatile organics (benzene, carbon tetrachloride, chlorbenzene, chloroform, cresol, o -cresol, m-

cresol, p -cresol, 1,4 -dichlorobenzene, - 1i2-dichloroethane, 1,1-dichloroethylene, 2,4-
dinitrotoluene, hexachlorobenzene, hexachloro-1,3-butadiene, hexachloroethane, methyl ethyl
ketone, nitrobenzene, pentachlorophenol, pyridine, tetrachloroethylene, trichloroethylene,
2,4,5-trichlorphenol, 2,4,6 -trichlorophenol and vinyl chloride).
Coal does not contain pesticides and herbicides and therefore, coal ash does not contain
pesticides and herbicides. Any volatile or semi -volatile constituents of coal have been
combusted in the boiler at temperatures of 1,900 T for three to five seconds and therefore,
volatile and semi -volatile organic constituents are not present in coal ash. Our past three permit
renewals (including this one) confirm that pesticides and herbicides along with volatile and
semi -volatile organics are not present in coal ash.
As such, we request that this requirement be modified such that each source generating facility
completes and annual TCLP test on a representative ash sample once per year for only the eight
RCRA metals if.that facility uses ash during the calendar year. During a permit cycle, the TCLP
test should also be required for only the eight RCRA metals.
Condition 111.4. requires sampling up to 12 times per year. However, the permit allows for a
reduction in frequency of this monitoring. We propose a monitoring frequency as shown in the
following table:

In addition, we request that calcium, magnesium, manganese, phosphorous, potassium, pH and
sodium only be monitored for if the coal ash is used as a soil nutrient additive, amendment or
for other agricultural purpose as approved by the NC Department of Agricultural and Consumer
Services to be consistent with other permits issued by the Land Application Unit.
• For Condition V.1., we request removal of the reference to PEC document EVC-FGDC-00101
"Ash Utilization Plan".

beneficial reuse of CCRs is both environmentally sound and cost-effective solution. We request an

plan to remove any source generating facility from this permit as future reuse opportunities may arise.
