Sullins Dee Freeman Governor Director Secretary March 25, 2009 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Jay Meyers, Public Utilities Director Town of Fuquay-Varina 401 Old Honeycutt Road Fuquay-Varina, NC 27526 Subject Property: NE Judd Parkway Extension Terrible Creek [030403, 27-43-15-8-(2), C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Meyers: DWQ Project # 08-1817 Wake County On December 10, 2008, the Division of Water Quality (DWQ) received your application dated December 9, 2008, to fill or otherwise impact 0.92 acres of 404/wetland, 349 linear feet of perennial stream, and 23,887 square feet of Zone 1 Neuse River basin protected riparian buffers and 14,718 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the proposed linear transportation project at the site. On February 20, 2009, the DWQ received additional information from you, however, the DWQ has determined that your application remains incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will place this project on hold as incomplete until we receive this additional information. If we do not receive the requested information, your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: At Impact Area 3, the scour hole on the northwest quadrant of the road crossing is placed upslope of an area that is too steep to allow for diffuse flow (greater than eight percent slope). Please provide EITHER a level spreader in another location with appropriate slopes OR a BMP that removes a minimum of 85 percent TSS and 30 percent TN from the stormwater generated by this project. If you provide a BMP, then include a completed BMP Supplement Form, with all the required items. The BMP Supplement Forms are available at: http://h2o.enr.state.nc.us/su/bmp_forms.htm. 2. For the proposed level spreader at Impact Area 3, sheet 2-C showing the plan details and section view of the level spreader was omitted from the submittal. Please include this sheet in the resubmittal. All stormwater discharged in the vicinity of Impact Area 4, must be discharged through a correctly designed level spreader or scour hole per the requirements of the Neuse Buffer Rule. Level spreader design requirements are set forth in Chapter 8 of the North Carolina Stormwater BMP Manual, available at: http://h2o.enr.state.nc.us/su/binp forms.htm. 4. For every scour hole that is proposed on the project, please provide the following information: a. The drainage area and impervious surface area draining to the device, b. The peak flow from the 1 in/hr and 10-year storms, c. The elevations of the natural ground at the location of the scour hole and the top of bank of the receiving stream, d. The slope of the filter strip, e. Plan details of the scour hole that include the dimensions, one foot topo lines between the device and the top of bank, and f. A signed and notarized Operation and Maintenance Agreement. 5. For every proposed discharge to a wetland on the site, please provide details of the proposed dissipation devices. In addition, provide supporting calculations that show that the device has been designed to limit the velocity of stormwater to less than two feet per second during the peak flow from the ten-year storm. Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
