On December 12, 2017, the Division of Water Resources (Division) received your application dated
December 4, 2017, requesting a 401 Certification from the Division for the subject project. We
wrote to you on January 2, 2018 requesting additional information. During a site visit conducted
on January 31, 2018 it was determined that modifications to the application were necessary and
we informed your consultant that we would place the application on hold until March 1, 2018. As
of today, the Division has not received a revised application and have been notified by your
consultant that alternative designs are currently being investigated.
Pursuant to Title 15A NCAC 02H .0507(e) the Division is unable to approve your application. For the
reasons listed above, your application is hereby returned. Once you have addressed the problems
and/or inadequacies with your application as it was submitted, you will need to reapply to the
Division for approval including a complete application package and the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clean Water Act for this
activity and any work done within waters of the state may be a violation of North Carolina General
Statutes and Administrative Code.
