Proposed activity includes dredging in front of 610 and 608 Evelyn Lane, and 632 Maritime Way, as well as the construction of a dock at 610 Evelyn. This area was previously dredged in 1970-71, under Department of Conservation and Development permit #238, dated 9-14- 70. Approximately 475 cy are proposed to be dredged currently. John E. Dougher Page Two 9. PROJECT DESCRIPTION: The project site is located at 608 & 610 Evelyn Ln., adjacent to Banks Channel, in Topsail Beach, Pender County. To get to the site from Wilmington, take US Hwy 17 North to NC Hwy 210. Turn right onto NC Hwy 210 and continue to NC Hwy 50. Take a right onto NC Hwy 50. Travel across the swing bridge to the stoplight. Take a right onto NC Hwy 50. Travel approximately six miles. Take a right on Haywood Ave. Take the second left which is Evelyn Drive. The applicant's properties are located on the right. The combined properties are approximately 19,500 ft.2. The current elevation of the property ranges from 0' above normal water level to approximately 6' above normal high water. The project site is adjacent to Evelyn Lane to the east, residential property to the north and the south, and Banks Channel to the west. There are currently two residential dwellings on the lots, a bulkhead that runs the length of both lots and a dock on the lot southern lot (608 Evelyn Lane). The existing pier at 606 Evelyn Ln. measures approximately 4' in width and 36' in length with a T-head that measures 16' in width and 16' in length. There is a ramp that connects the dock to a floating dock that measures approximately 8' in width by 16' in length and a 12' x 12' boatlift located on the southern side of the floating dock. There is an existing bulkhead that is located landward of the coastal wetlands and runs the width of both properties. The highground portion of the property is vegetated primarily with lawn grasses and ornamental plants. Coastal wetlands are present at the site. There is high marsh that measures approximately 5'- 10' in width and consists of Salt Meadow Grass (Spartina Patens), and Salt Marsh Cordgrass (Spartina alterniflora). There is a low marsh consisting of salt marsh cordgrass that measures approximately 20' in width and runs the width of the properties. After reviewing the aerial photography from 2006 appears to be an area of submerged aquatic vegetation (SAV) located in the area in front of 610 Evelyn Ln. This was confirmed during a site visit performed in May of 2005 for a bulkhead and pier permit. The NC Division of Marine Fisheries subsequently confirmed that there were SAV's on site. Considering the potential impacts to SAV's and SAV habitat their request to dredge this area was elevated from a general permit to a major permit The Topsail Beach Land Use Plan classifies the upland areas of this project as Developed. The waters of the project site are classified as SA by the NC Division of Water Quality. The NC Division of Marine Fisheries has NOT designated Banks Channel as a Primary Nursery Area, and the waters adjacent to the proposed project are open to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to excavate an area measuring approximately 120' in length and 40 ` in width to a final depth -4' @ NLW. The spoil material would be transported via barge to 1009 N Anderson Blvd and placed on the highround landward of the 30' buffer. The applicant is also proposing to install a 5-slip docking facility. The docking facility would consist of a fixed pier starting at the bulkhead and extending waterward at 610 Evelyn Ln. The proposed fixed pier would measuring 6' in width by 22' in length and would be access to a floating dock measuring 6' in width by 30' in length. The proposed floating dock would have two finger piers attached perpendicular to it and one would be located at the end of floating dock, measuring 6' in with by 20' and the other would be located approximately 15' landward of the outermost finger pier, measuring 4' in width by 20' in length. The outermost finger pier would measure 6' in width by 20'in length. The applicant is also proposing to install a boatlift on the north side of the 6' x 30' floating dock that would measure 13' x 13'. The water depths at the end of the proposed structure would be approximately -4' @ Normal Low Water. John E. Dougher Page Three 10. ANTICIPATED IMPACTS The proposed dock would incorporate approximately 549 ft.2 of public trust waters. The proposed excavation would disturb approximately 4,800 ft.2 of shallow bottom and the disposal of the dredged material would disturb approximately 4,900 ft.2 of highground. The proposed dredging would also impact an area of SAV's, the total impacts to SAV's / SAV habitat is unknown since the area has not been delineated. The dock construction and excavation would likely result in a temporary increase in turbidity. Submitted by: J. W.
