The CONTRACTOR shall be responsible for taking sufficient precautions to protect public health. The sewer lines shall also be protected from damage. The following shall apply: 1. No wastewater shall be allowed to back up into any homes or buildings. 2. No wastewater shall overflow any manholes, cleanouts, or any other access to the sewers. 3. Users upstream of the pump and haul area shall be able to use all their water and sewer utilities without interruption. B. Any sump pumps, bypass pumps, trash pumps, or any other type of pump which pulls wastewater or any type of material out of the manhole or sewer shall discharge the material into another manhole, or appropriate vehicle or container approved by the ENGINEER. Under no circumstances shall this material be discharged, stored, or deposited on the ground, swale, road, or open environment. C. The CONTRACTOR shall take appropriate steps to ensure that all pumps, piping, and hoses that carry raw wastewater are protected from traffic. D. If during the execution of the Work any raw wastewater is spilled, discharged, leaked, or otherwise deposited in the open environment, due to the CONTRACTOR's work, the Contractor shall be responsible for any cleanup of solids and stabilization of the area affected. This work shall be performed at the CONTRACTOR's expense with no additional cost to the OWNER. The CONTRACTOR shall also be responsible for notifying the OWNER's sewer system maintenance personnel and complying with any and all regulatory requirements for cleaning up the spill at no additional cost to the OWNER. E. The CONTRACTOR shall take proper precautions to prevent damage to existing sanitary sewer facilities, flooding, or damage to public or private property. F. The CONTRACTOR shall make repairs or replacements or rebuild such damaged section or sections of existing sewers, as directed by the ENGINEER. All such repairs, replacements, and rebuilding shall be paid for by the CONTRACTOR. G. The CONTRACTOR shall make such provisions as are necessary for handling all flows in existing sewers, connections, and manholes by pipes, flumes, or by other approved methods at all times, when his operations would, in anyway, interfere with normal functioning of those facilities. H. The CONTRACTOR shall be responsible for the removal of any debris and sedimentation in the existing sewers, laterals, and manholes, etc., which is attributable to his work under this Contract. All operations shall be performed by the CONTRACTOR in strict accordance with OSHA and any other applicable safety requirements. Particular attention is directed to safety regulations for entering confined spaces. SUMMERHOUSE PUMP AND HAUL ROUTE WASTEWATER SALES AGREEMENT ADDENDUM III RECITALS WHEREAS, the Parties entered into the Wastewater Sales Agreement on February 17, 2004 (hereinafter referred to as the "Agreement) and has heretofore executed 2 addendums to the Agreement; WHEREAS, the Agreement provides for a Phase 1 Volumetric Flow Limit of 2 mgd and permits the Authority to submit a written request to the Government Representative for an increase in the Volumetric Flow Limit; WHEREAS, on April 24, 2006, the Authority has requested in writing that the Government increase the Volumetric Flow Limit to the Phase 2 level of 3.5 mgd; WHEREAS, at the time of execution of the Agreement, the Authority had determined to design its facilities to utilize the Phase 1 Volumetric Flow Limit of 2 mgd; WHEREAS, since the execution of the Agreement, the Authority had identified additional needs which, through good business practice, requires that the Authority design its utility facilities to utilize the Phase 2 Volumetric Flow Limit of 3.5 mgd; WHEREAS, the potential users of additional capacity provided by the Phase 2 Volumetric Flow Limit include, but are not limited to, the City of Jacksonville (1 mgd), the Town of Swansboro (1 mgd), Hunters Creek (about 900 residential connections), other incorporated areas of Piney Green, and substantially more interest for sewer capacity from developers; WHEREAS, the cost of designing the Authority's facilities to utilize the Phase 2 Volumetric Flow Limit is substantial and the Authority has determined that it would be potentially wasteful to so design its facilities unless it is assured that the Phase 2 Volumetric Flow Limit is available; WHEREAS, as required by paragraph 2 (e) and Exhibit A of the Agreement, the Government has determined that the Phase 2 volumetric flow capacity of 3.5 mgd is available, that such service is not available to the Authority from another local source, that the sale of such service is in the public interest, such additional service shall comply with all applicable federal, state and local laws and regulations pertaining thereto and that the Authority is fully in compliance with the terms and conditions of the Agreement. 1 I r NOW, THEREFORE, the parties agree as follows: 1. PROVISION OF UTILITY SERVICES (a) Description. The Government shall from the effective date of this addendum provide the Authority 3.5 million gallons per day of sanitary sewage disposal and treatment services for wastewater affluent. Connection to the Government system shall be in accordance with the provisions noted in Addendum II to the Wastewater Sales Agreement. (b) Effective Date. This addendum shall become effective on the date of its full execution by both parties hereto. WQ0019907. 910.9327523 Tel 910.055.5607 Fax ONWASA has been working on rehab of the Summerhouse WWTP. At this time the Plant is about 95% ready to be put in operation. We are running the Plant with clean water to find out what works and what doesn't. During this process we have found several things that need to be fixed and many parts had to be ordered. TA Loving is the Contractor that built the new Head Works and has done many of the major repairs needed at the plant; they are completing the start-up on the equipment that has been installed. We anticipate TA Loving and ONWASA should be able to complete the start-up of new equipment and make any other repairs needed in the next couple of months. The force main from the Jenkins Street Pump Station has been completed and is ready to pump wastewater to Summerhouse. The flow from the Jenkins Street Pump Station from January 2015 to January 2016 averaged about 137,000 GPD; this will reduce the flow to Holly Ridge WWTP around 50%. The recommended minimum flow to start-up and operate the facility, located in Holly Ridge, NC, is 30,000 gallons per day (gpd) of wastewater. It should be noted that ONWASA is working towards completing upgrades to the W WTP in anticipation of operating the facility in the future. ONWASA is requesting permission to renew the existing permit to maintain the permitted pump and haul volume of 8,000 gpd. The proposed operation will consist of pumping and hauling from existing Summerhouse Pump Station Nos. 2, 3, and 4 discharging at one of two locations depending on available capacity at the time. The primary discharge location will be an existing manhole adjacent to the intersection of Jenkins St. and Crawford St. in the Town of Holly Ridge, NC. From that point, the wastewater will be conveyed to the Holly Ridge Wastewater Treatment Facility. Due to recent periods of inclement weather and subsequent increased flows at the Holly Ridge Wastewater Treatment Facility, ONWASA is requesting to continue to utilize a secondary receiving facility as necessary. The secondary discharge location will be an existing manhole on Rolling Ridge Dr. in Jacksonville, NC, which is upstream of the nearby Hunters Creek Pump Station. The Hunters Creek Pump Station conveys wastewater to Piney Green Pump Station, which then directs the flow to French Creek Wastewater Treatment Facility on Camp Lejeune for treatment. Flow Control Precautions 1.2 SUBMITTALS A. CONTRACTOR to submit a complete and detailed pump and haul plan to the ENGINEER for review, prior to commencement of Work in this Section. 1.3 RESPONSIBILITY FOR OVERFLOWS AND SPILLS A. It shall be the responsibility of the CONTRACTOR to schedule and perform his work so as to result in no overflows or spills of sewage or combined sewage from the system. B. In the event of overflows caused by the CONTRACTOR's work activities, the CONTRACTOR shall immediately take appropriate action, in accordance with the OWNER's SSO Emergency Response Plan and all applicable regulatory requirements, to contain and stop the overflow, clean up the spillage, disinfect the area affected by the spill, and notify OWNER immediately upon first knowledge of overflow event. C. CONTRACTOR will indemnify and hold harmless the OWNER for any fines or third -party claims for personal or property damage arising from a spill or overflow that is fully or partially the responsibility of the CONTRACTOR. Should fines subsequently be imposed, as a result of any overflow for which the CONTRACTOR is fully or partially responsible, the CONTRACTOR shall pay all such fines and all of the OWNER's legal, engineering, and administrative costs in defending such fines and claims associated with the sanitary sewer spill. PART 2 PRODUCTS 2.1 EQUIPMENT A. All pipe materials utilized in wastewater flow diversion during construction shall be in good condition, and free of defects, and leaks. Any defective material shall be replaced by the CONTRACTOR at no cost to the OWNER. Upon completion of the job, pipe materials shall be removed from the site.
