The reason for the pump & haul modification request is that the Holly Ridge WWTP and disposal system can not take the full pump & haul permitted amount (80,000 gpd) at this time. Wastewater sent to an upgradient manhole of the Hunters Creek influent pumping station is to be processed at the MCB Camp Lejeune Advanced Wastewater Plant in accordance the conditions of Permit No. NC0063029 per the agreement between ONWASA and the MCB Camp Lejeune. The wastewater is to be processed at the MCB Camp Lejeune Advanced Wastewater Treatment plant in accordance with Permit No. NC0063029. Additionally, pump & haul volumes may continue to be transferred from the Summerhouse sewer collection system Pumping Stations #2,#3, and #4 for processing at the Holly Ridge WWTP. Please be advised that the pump & haul permitted volume has been increased to 80,000 gal/day of domestic wastewater mixed with 1/1 flow. This permit shall be effective from January 30, 2013 until July 30, 2013 and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will constitute noncompliance with the permit. Also, please note Condition No. 8 in the permit, which states that the pump and haul activity will cease upon the expiration date. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Additionally, an unspecified amount of disinfected upset pond liquids can be transferred into the Holly Ridge spray irrigation lagoon as part of the one-time upset pond cleanout operation. This permit shall be effective from the date of issuance until July 30, 2013 and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the subject pump and haul activities are carried out in a manner which has been approved by this Division. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 5. No type of wastewater other than raw domestic waste from the Summerhouse Pumping Stations #2,0, #4, and from the upset pond located in Onslow County, shall be included in the pump and haul activities. 6. This permit shall become voidable unless the agreement between ONWASA-Holly Ridge WWTP, and the hauler (ONWASA- Collections & Distribution or Lewis Farms & Liquid Waste, Inc.) and the agreement between ONWASA and the Maine Corps Base Camp Lejeune are in full force and effect. 7. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall cease operation of all pump and haul activities, and take such immediate corrective action as may be required by this Division. 8. The pump and haul activity shall cease upon the expiration date of this permit. 9. The raw domestic wastewater collected from Summerhouse Pumping Stations #2,#3, #4 and the upset pond shall be transferred to the upgradient manhole of the Holly Ridge WWTP for ultimate treatment and disposal in accordance with conditions of Permit WQ0019907 or raw domestic wastewater collected from Summerhouse Pumping Stations #2,#3, and #4 shall be transferred to an upgradient manhole of the influent pumping station at Hunters Creek WWTP for ultimate treatment and disposal by the Advanced Wastewater Treatment facility at the MCB Camp Lejeune in accordance with conditions of Permit No. NCO063029 issued by the Division of Water Quality. Such transfers shall be accomplished on Mondays and Fridays during regular daily wastewater plant operating hours. Disinfected wastewater from the Summerhouse WWTP upset pond may be transferred into the Holly Ridge spray irrigation lagoon. 10. The Permittee (ONWASA) is liable for any damages caused by a spill or failure of the pump and haul operations. 11. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee or their designated system operator to insure proper operation of the subject facilities. 12. The Permittee (ONWASA) shall inspect the wastewater collection facilities and wastewater plant receiving facilities to prevent malfunctions, deterioration, operator errors, and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. This log of inspections shall be maintained by the Permittee for as long as the pump and haul activities are being conducted and shall be made available upon request to the Division of Water Quality. 13. Any duly authorized officer, employee, or representative of the Division of Water Quality may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater collection facilities at any reasonable time for the purpose of determining compliance with this permit and may inspect or copy any records that must be kept under the terms and conditions of this permit, and may obtain samples. 14. An accurate record of the pump and haul activities must be maintained by the Permittee indicating: date wastewater is removed from the facility. name of facility from which wastewater is removed. name of facility receiving wastewater. volume of wastewater received at each wastewater treatment receiving facility. status of permanent disposal option (Operation of Summerhouse WWTP) These records shall be submitted to the Wilmington Regional Office of the Division of Water Quality, Aquifer Protection Section located at 127 Cardinal Drive Extension, Wilmington, North Carolina, 28405 on or before the fifteenth (15th) day of the following month. 15. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6A. 16. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal), which have jurisdiction. 17. Noncompliance Notification: The Permittee shall report by telephone to the Wilmington Regional Office at telephone no.(910) 796-7215 as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Wilmington, NC 28405-3845 Subject: Summerhouse at Everett Bay — Revised per NCDENR Request (additions highlighted in yellow) Request for Pump and Haul Permit Modification Dear Mr. Bushardt, As previously discussed, the ONWASA-owned wastewater treatment facility (WWTP) at Summerhouse at Everett Bay (Summerhouse) cannot be operated due to low -flow conditions as currently there are only 6 homes and a community clubhouse that have been constructed in the development. The recommended minirnu n flow to start-up and operate the facility, located in Holly Ridge, NC, is 30,000 gallons per day (gpd) of domestic -strength wastewater. The wastewater that is currently being generated within this development is heavily -diluted with inflow/infiltration (I/1) entering the Summerhouse collection system, and carinot be conveyed to a treatment facility. It should be noted that ONWASA has identified locations within the collection system in need of repair, and plans to move forward with completing the repairs as soon as possible. A signification decrease in 1/1 is anticipated once said repairs are completed. Furthermore, ONWASA is working towards completing upgrades to the WWTP in anticipation of operating the facility in the near future. ONWASA is requesting permission to modify the existing pennit'to increase the permitted pump and haul volume to 80,000 gpd, and utilize a secondary receiving facility if needed. The proposed operation will consist of pumping and hauling from existing Summerhouse Pump Station Nos. 2, 3, and 4, and discharging at one of two locations depending on available capacity at the time. The primary discharge location will be an existing manhole adjacent to the intersection of Jenkins St. and Crawford St. in the Town of Holly Ridge, NC. From that point, the wastewater will be conveyed to the Holly Ridge Wastewater Treatment Facility. Due to recent periods of inclement weather and subsequent increased flows at the Holly Ridge Wastewater "Treatment Facility, ONWASA is requesting to utilize a secondary receiving facility as necessary. The secondary discharge location will be an existing manhole on Rolling Ridge Dr. in Jacksonville, NC, which is upstream of the nearby Hunters Creek Pump Station. ONWASA has sufficient wastewater allocation at the French Creek Wastewater Treatment Facility to accommodate the additional flow. For this modification we are requesting the maximum volume of wastewater that the Holly Ridge WWTP ORC and ONWASA Collection System ORC has agreed to accept. We do not anticipate additional flow fi•om future homes to exceed the requested volume of 80,000 gpd. It should be noted that ONWASA has contracted a local pump and haul company to assist with ouI' efforts at Summerhouse, theI'efore, Out' combined total capacity to pump and haul actually exceeds the accepted volume from the Holly Ridge and French Creek Wastewater Treatment Facilities. However, the 80,000 gpd will not be exceeded. Bt,x 141 � --la 'kv,ii1'1lk. 1 C 'Ni•111 • li'f! 1 11fr� •E:?.'�•�- • 1111 :1.111+11 -et., .1'Ulrr WASTEWATER SALES AGREEMENT ADDENDUM III RECITALS WHEREAS, the Parties entered into the Wastewater Sales Agreement on February 17, 2004 (hereinafter referred to as the "Agreement) and has heretofore executed 2 addendums to the Agreement; WHEREAS, the Agreement provides for a Phase 1 Volumetric Flow Limit of 2 mgd and permits the Authority to submit a written request to the Government Representative for an increase in the Volumetric Flow Limit; WHEREAS, on April 24, 2006, the Authority has requested in writing that the Government increase the Volumetric Flow Limit to the Phase 2 level of 3.5 mgd; WHEREAS, at the time of execution of the Agreement, the Authority had determined to design its facilities to utilize the Phase 1 Volumetric Flow Limit of 2 mgd; WHEREAS, since the execution of the Agreement, the Authority had identified additional needs which, through good business practice, requires that the Authority design its utility facilities to utilize the Phase 2 Volumetric Flow Limit of 3.5 mgd; WHEREAS, the potential users of additional capacity provided by the Phase 2 Volumetric Flow Limit include, but are not limited to, the City of Jacksonville (1 mgd), the Town of Swansboro (1 mgd), Hunters Creek (about 900 residential connections), other incorporated areas of Piney Green, and substantially more interest for sewer capacity from developers; WHEREAS, the cost of designing the Authority's facilities to utilize the Phase 2 Volumetric Flow Limit is substantial and the Authority has determined that it would be potentially wasteful to so design its facilities unless it is assured that the Phase 2 Volumetric Flow Limit is available; WHEREAS, as required by paragraph 2 (e) and Exhibit A of the Agreement, the Government has determined that the Phase 2 volumetric flow capacity of 3.5 mgd is available, that such service is not available to the Authority from another local source, that the sale of such service is in the public interest, such additional service shall comply with all applicable federal, state and local laws and regulations pertaining thereto and that the Authority is fully in compliance with the terms and conditions of the Agreement. NOW, THEREFORE, the parties agree as follows: 1. PROVISION OF UTILITY SERVICES (a) Description. The Government shall from the effective date of this addendum provide the Authority 3.5 million gallons per day of sanitary sewage disposal and treatment services for wastewater affluent. Connection to the Government system shall be in accordance with the provisions noted in Addendum II to the Wastewater Sales Agreement. (b) Effective Date. The Piney Green pump station can also handle the additional 80,000 gallons per day. Currently, ONWASA is only utilizing approximately 225,000 gpd of the allocated 3.5 MGD at the French Creek treatment facility.
