On January 7, 2009, the Division of Water Quality received your letter dated January 6,
2009 requesting comments on the City of Lenoir's plans to replace and upgrade its raw water
intake on Lake Rhodhiss in Caldwell County. The 401 Certification Program has no objection to
your proposed plan as long as you acquire the required 404 Permit and 401 Certification for this
activity. As you may know, you should contact the US Army Corps of Engineers to determine
which type of 404 Permit will be required for this activity.
