Field Investigation Report: Burton Farm Development Company, LLC Page 2 of 4 --------------------------- 9. Narrative Description: This proposal is a modification to State Permit #28-08. It was issued on April 4, 2008 for the construction of 1,825' of shoreline stabilization. State Permit #28-08 is set to expire on December 31, 2011. The property is a 362-acre parcel located off of Burton Farm Road near Minnesott Beach, Pamlico County. Burton Farm Development Company, LLC, wishes to construct a kayak launching facility, day docks, a parking lot, and nature trails, and is applying for a permit to do so. The property is known as the Mill Creek subdivision and is on the Neuse River and Mill Creek tributary. It follows the eastern shoreline of Mill Creek out to the mouth and on around along the Neuse River. There is 4,625' of shoreline on this property. The current vegetation on the tract mainly consists of upland grasses, pine trees, and a fringe of coastal wetlands. None of the project area has submerged aquatic vegetation. The elevation of the tract is + 16' nwl. Existing man-made features on the property include infrastructure needed to support the 144-lot subdivision. The Pamlico County Land Use Plan classifies the project area as Rural with Services, with CAMA AEC's classified as Conservation. These waters of Neuse River and Mill Creek are not designated as Primary Nursery Area and are closed to shellfish harvesting. These waters carry a water quality classification of SB and SC, respectively. The bottom substrate is firm without shell. 10. Proposed Development: The request is for the new construction of recreational amenities in the form of a series of nature trails, boardwalks, a parking lot, and two docks for the new Mill Creek subdivision. The nature trails consist of gravel walkways and wooden decking. The two docks are mainly for kayak launching and staging for community use. The waterfront shoreline will be common area for the subdivision, to be owned by the future home owners association. The main kayak launching facility will be located in the northwest section of the subdivision on the Mill Creek tributary, between Lot #62A and Lot #62B. The wooden pier access will be 6' wide and 87' long to connect the platform to the upland community "Outfitter Center." The 12' wide and 57' long platform will be half over coastal marsh and half waterward of nwl along 120' of shoreline. It is about -4.0' nwl deep at this location. The second canoe launching dock will be located between Lot 238 & Lot 236, more than 2,000' southeast of the "Outfitter Center" on the Mill Creek tributary. The wooden pier access will be 6' wide and 118' long to connect the platform to an upland nature trail. Brad Connell March 19, 2009 Morehead City Field Investigation Report: Burton Farm Development Company, LLC Page 3 of 4 --------------------------- The "T" platform at the waterward terminus of the pier will be 8' by 20' with an adjacent 3' by 8' drop-down finger pier along 210' of shoreline. It is about -3.0' nwl deep at this location. The gravel nature trail connecting Willow Cove Lane to Palm Court will have an elevated, wooden pedestrian bridge over coastal and Section 404 wetlands. This footbridge will be 6' wide and 375' long. This walkway will have a minimum elevation of 3' above the coastal wetland substrate. The gravel nature trail at W. Burton Farm Drive in between Lot 317 & 318 will have an elevated, wooden pedestrian bridge over Section 404 Wetlands and a "blue line stream." This footbridge will be 6' wide and 116' long. The gravel nature trail next to Lot 263 & Lot 264 off of W. Burton Farm Drive will have an elevated, wooden footbridge over Section 404 Wetlands and a "blue line stream." This pedestrian bridge will be 6' wide and 219' long. Along this same trail, will be another wooden footbridge crossing Section 404 wetlands. This bridge adjacent to Lot 259 will be 6' wide and 38' long. The gravelwalkway at the end of W. Burton Farm Drive adjacent to Lot 304, will lead down to a wooden walkway. This 6' by 113' pedestrian boardwalk will access a set of stairs in the corner of a permitted bulkhead. A similar access off of S. Brightleaf Drive next to Lot 381 will lead down to a 6' by 200' boardwalk to connect to another bulkhead stair access. The gravel nature trails from the "Guardhouse" to the "Clubhouse" have a series of seven wooden pedestrian bridges traversing through Section 404 Wetlands: 6' by 45', 6' by 241, 6' by 51', 6' by 110', 6' by 511, 6' by 90', and 6' by 111. Then the gravel trail from the "Clubhouse" to Mill Creek will have a series of five wooden, elevated footbridges over Section 404 wetlands: 6' by 184', 6' by 751, 6' by 92', 6' by 77', and 6' by 110' . At the southern end of this "Guardhouse" to "Clubhouse" nature trail, there will be an asphalt parking lot adjacent to Burton Farm Road. The proposed parking lot will be approximately 8,263 square feet on high ground. It will support eighteen parking spaces. Connecting to Sprigtail Court, the applicant wishes to construct a pier and viewing platform through Section 404 Wetlands. The proposed pier will be 6' wide and 155' long. The platform at the terminus of the pier will be 6' wide and 10' long. The piers will shade 1,988 fe of coastal wetlands and 9,082 fe of Section 404 Wetlands. It will result in the usurpation of 3,216 fe of Public Trust Waters. The nature trails and parking lot will impact 52,399 fe of high ground. Gregson, Director Dee Freeman, Secretary MEMORANDUM DATE: March 18, 2009 TO: Doug Huggett THRU: Tere Barrett FROM: Brad Connell SUBJECT: Comments and Recommendations - CAMA Major Permit - Mill Creek S/D Phase II, Pamlico County The following is my assessment and consequent recommendations of the above referenced proposal: This proposal involves the filling of 44,136 square feet of high ground. This proposal will shade 1, 988 square feet of coastal wetlands and 9,082 square feet of Section 404 Wetlands. It will usurp 3, 216 square feet of Public Trust Waters. The waters of Mill Creek are closed to shellfish harvest. This waterbody is not a Primary Nursery Area. This proposal will not pose a hazard to navigation. This proposal is in accordance with 15A NCAC 07H.0208(b)(6) and 15A NCAC 07H .0209. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. The kayak storage rack is non-water dependent usage and therefore must be located entirely on high ground. 2) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent riparian access corridors, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 3) Any development or land disturbing activity that is considered non-water dependent is not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission (EMC) Neuse River buffer regulations in place at the time of such development. 400 Commerce Avenue, Morehead City, North Carolina 28557 Phone: 252-808-2808 \ FAX: 252-247-3330 \ Internet: www.nccoastalmanagement.net An Equal Opportunity \ Affirmative Action Employer - 50% Recycled \ 10% Post Consumer Paper Mill Creek S/D, Phase II March 19, 2009 Page 2 4) The authorized structures and associated activity must not cause an unacceptable interference with navigation. 5) Any portion of the permitted access pier and docking facilities built over coastal wetlands must not exceed six feet in width and must be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 6) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) Any mitigative measures or environmental commitments specifically made by the applicant in the Environmental Assessment for this project should be implemented, regardless of whether or not such commitments are addressed by individual conditions of this permit. 9) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 10) The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant. 11) A ground cover sufficient to restrain erosion shall be provided within the shorter of 15 working or 30 calendar days of completion of any phase of grading on cut or filled slopes. 12) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 13) Any development or land disturbing activity that is considered non-water dependent is not authorized within 50 feet of the normal water level unless specifically exempted by Coastal Resource Commission (CRC) regulations in place at the time of such development. NOTE: The building code or flood damage prevention ordinance may impose additional more restrictive requirements than the Division's standards for development in areas of environmental concern (AECs). Mill Creek S/D, Phase II March 19, 2009 Page 3 NOTE: If the permittee discovers any previously unknown historic or archaeological remains while accomplishing the authorized work, he will immediately notify the District Engineer, Wilmington Branch, U.S. Army Corps of Engineers at (910) 251-4511, who will initiate the required State and Federal coordination. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not convey any rights, either in real estate or material. NOTE: Should either adjacent property be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. CC: Tere Barrett, DCM Ted Tyndall, DCM Burton Farm Development Company, LLC Mill Creek Phase I and Phase II CAMA Major Modification Permit Application REVISION- December 31, 2008 PROJECT DESCRIPTION ?r Site Location The site is an approximately 362.24 acre parcel located along the Neuse River accessed via Burton Farm Road (NCSR 1120) and roughly centered around latitude 34.9881863°N and longitude 76.8467657°W. The site is part of the larger Burton Farm Development, LLC property which has been subdivided into two separate projects; Mill Creek Phases I and 11 and Arlington Place. Existing Development Mill Creek Phase I and Phase II is an existing 408 lot subdivision owned by Burton Farm Development, LLC. The development is a low density subdivision (issued low density stormwater permits #SW7070602 and SW7070210MOD-included in previous permit applications) with on site waste water serving each lot and potable water provided by Pamlico County. In addition to the existing lots and utilities, the subdivision has an Outfitters Center, Clubhouse and Guardhouse. The Outfitters Center is an open air gathering place that offers an area for the community to assemble. The clubhouse offers recreational facilities for members of the community and the Guardhouse is part of the gated community entrance. All of the utilities and associated infrastructure associated with the subdivision have been completed with the exception of a parking lot adjacent to the Guardhouse and electric service to lots along the south end of W. Burton Farm Drive. The enclosed site plans show the existing subdivision. Please note, 233 if of existing gravel trails were constructed prior to this modification request. The existing gravel trail is located at the north end of the proposed Willow to Palm Trail and was surveyed by Mr. Josh Nobles, PLS. The surveyed location of the gravel trail is shown on the attached site plans. Issued Permits and Permitting History Permits required and secured for the current subdivision include site specific NC DWQ Low Density Stormwater Permits (SW7070602-Phase II and SW7070210MOD-Phase I), Soil Erosion and Sedimentation Control Permits (Pamli-2007-002 Mill Creek Phase I and Pamli-2007-022 Mill Creek Phase II), wastewater evaluations and approvals (on file at the Pamlico County Health Department) and a CAMA Major Permit #28-08 issued on April 4, 2008 for the construction of 1,825 linear feet of bulkhead. In 2006, the initial project scope (Arlington Shores) included the present Mill Creek Phase I, Mill Creek Phase 11 and proposed Arlington Place subdivisions. A North Carolina State Environmental Policy Act Environmental Assessment (NC SEPA EA) was prepared at that time for all three phases of the project. Representatives of Burton Farm Development, LLC and the Division of Coastal Management agreed to separate the project into two parts; Mill Creek (Phases I and 11) and Arlington Place. This project separation allowed the Arlington Place development to continue in the NC SEPA EA process concurrent with the development of Mill Creek. As of the date of this permit application revision, a NC SEPA FONSI for the proposed Arlington Place Development has been issued. A wetlands delineation map of the property is currently being finished for the site. The United States Army Corps of Engineers (USACE) has been asked to review an area of the site for final plat submission and Jurisdictional Determination (JD). The USACE requested that one overall plat be prepared for both Mill Creek and Arlington Place. The wetlands line shown on the attached site pla.forMill Creek have been agreed to in the field and preliminarily on paper. Please note, the wetlands line on ttie attached.?ite. i plans will not change as part of the planned USACE review of the site. The Coastal Wetlands line was delineated (with DCM revisions in September of 2008), surveyed and shown on the enclosed site plans. A blue line stream location plat was submitted to NC DWQ on November 25, 2008 for approval. The blue line stream locations were agreed to in the field by DWQ staff and Land Management Group during an on site meeting. Archaeological Findings and Requirements In an archaeological report prepared by Environmental Services, Inc. dated April 2006, nine archaeological sites were identified on the Mill Creek and Arlington Place properties. The 2006 archaeological study reported a total of seven recorded sites (31PM51/51** through 3IPM54/54 and 31PM56-31PM58) and two previously recorded sites (31PM13 and 31PM15/15). The general locations of the sites are shown on the attached site plan. Please note, only one site QIPM 52/52**) was recommended for additional testing by Environmental Services Inc. A condition of CAMA Permit #28-08 (Issued to Burton Farm Development for shoreline stabilization along the Neuse River) was the testing of site 31 PM52/52** to determine eligibility for inclusion on the National Register of Historic Places (NHRP). This condition was requested by the North Carolina Department of Cultural Resources State Historic Preservation Office (SHPO) in a Memorandum to Mr. Doug Huggett on January 25, 2008. A CAMA Major Permit was issued on April 4, 2008 with a condition that... "prior to initiation of any ground disturbing activities within the project area, the permittee shall arrange for an archaeological assessment of site 3 1 PM52/52* * * * in terms of the NHRP". Burton Farm Development, LLC contracted the services of Environmental Services, Inc. and the assessment was completed in April of 2008. The assessment concluded that site 31PM52/52** be listed as eligible for inclusion in the NHRP. Copies of the April 2006 and April 2008 Archaeological Assessments conducted by Environmental Services Inc. (ESI) were included in the September 2008 CAMA Major Permit Modification application. In response to a review of ESI's April 2008 Report entitled Archaeological Testing of Site 31PM52152**** SHPO issued a letter correspondence (dated April 28, 2008) recommending Site 31PM52/52**** for inclusion on the NHRP. The letter correspondence further requests that Burton Farm Development, LLC implement a mitigation plan for site 3 1 PM52/52* * * * prior to construction of the conditionally permitted bulkhead along the Neuse River. A mitigation plan was presented to SHPO by ESI on behalf of Burton Farm Development, LLC. The mitigation plan was reviewed and approved by the Assistant State Archaeologist, Mr. Lea Abbott. Burton Farm Development, LLC has verbally agreed to perform the mitigation of site 31PM52/52**** and has ceased all development activities within an area of 31PM52/52**** agreed to by Lea Abbott in a meeting on April 21, 2008. The location of 31PM52/52**** is shown on the attached overall site plans. Remaining development activities within site 31PM52/52**** include the installation of underground electric lines and the construction of the conditionally permitted bulkhead shoreline stabilization. Proposed Work The applicants propose to construct a walkway from the Outfitter Center (shown on the attached site plans) leading to a platform and canoe/kayak launch in Mill Creek. In addition, the applicants propose to construct an additional walkway leading from Sawgrass Court to Mill Creek (shown on the attached site plans) with a day dock (including a finger pier) and platform for benches and passive recreation. The applicants also propose to construct a system of walkways and bridges that cross Section 404 wetlands 2 and areas within Zone I and Zone II of the Neuse River Buffer as shown on the attached site plans. For the purposes of this permit, all walkways that cross Section 404 wetlands will b 4 oodert and elevated a minimum of three feet above the substrate. All trails outside of the Zone I and Zone 11 Buffers and°thaf do not cross any wetlands will be constructed with gravel composed of granite fines. The expected linear footage of proposed gravel paths is 6,895 if (currently 233 if of existing gravel). Wooden walkways within buffers and not over wetlands will not be elevated. The total linear footage of wooden walkways sited within the DWQ and DCM buffers requiring CAMA permitting is approximately 2,203 linear feet. All trails and walkways are proposed to be constructed six feet wide. For clarity, the proposed development activities are separated by location throughout the project and outlined in detail below: Outfitter Center Walkway and Kayak Launch-Revised December 11, 2008 The applicants propose to construct an elevated wooden walkway (6' by 97') leading to a 57' by 12' walkway/kayak platform installed parallel to the shoreline of Mill Creek. The walkway/kayak platform will be constructed so that 6 feet will extend over wetlands (342 sf) and 6 feet will extend over public trust (342 sf) which includes a two feet wide lowered kayak loading pier (see details). The purpose of the Outfitter Center is to provide a direct community access to Mill Creek for kayaks and canoes. Sawgrass Court Day-Dock and Walkway (Trail 1C) The applicants propose to construct an elevated 6 feet wide by 118 linear feet wooden walkway from the community access on Sawgrass Court leading down to an 8 feet by 20 feet platform and day dock with benches to provide access to Mill Creek. There will be a side to finger pier constructed along the dock measuring eight feet by three feet. The finger pier will be lowered to approximately eight inches above normal water to provide safe entry and exit for boaters. A set of stairs will connect the finger pier to the platform above. The proposed platform will extend out over Mill Creek six feet from normal water level and two feet will extend parallel to the shore over the shoreline/wetlands. The platform will be constructed a minimum of three feet above the substrate and normal water level. The purpose of the access and platform is to provide recreational access to Mill Creek with one day slip. There will be no permanent or overnight mooring allowed at the dock. The footprint of the structures are shown on the attached site plan. Walkways and Bridges In addition to water dependent structures, the applicants propose to install a system of trails and walkways throughout the project to provide pedestrian access connections to the development, the Neuse River and Mill Creek. Walkway connections will involve crossings over Section 404 USAGE, Coastal Wetlands and blue line streams. Any walkway over Section 404 USACE and Coastal Wetlands will be elevated a minimum of three feet over the existing substrate. Trails that are not within wetlands or any of the buffers will be constructed using gravel fines. The linear footage of gravel walkways in uplands and areas not designated as buffers is approximately 7,128 If. The applicants propose to construct 2,203 linear feet of wooden walkways. Currently there are 233 if of existing 6 ft wide gravel trails. The existing trail is shown on the attached site plans and detail sheets. Walkway from Willow to Palm (Trail 1A) A wetland crossing is proposed to connect approximately 516 if gravel walking trails (233 if existing and 283 proposed) from Willow Cove Lane to Palm Court. The proposed wooden walkway is 6 feet wide by approximately 375 if (Approximately 325 feet will be constructed over Section 404 wetlands and Zone I and H Buffers and approximately 15 feet will be constructed over a blue line stream). Walkways will be 3 elevated a minimum of three feet over all wetlands and five feet above normal water level where it crosses the blue line stream. Walkway from W. Burton Farm to S. Brightleaf (Trail 1B) The applicants propose to construct a six feet wide trail from W. Burton Farm Drive to S. Brightleaf Drive. The proposed walkway will be constructed of 270 linear feet of gravel fines leading to a 219 if elevated wooden walkway that will cross an unnamed tributary of the Neuse River that has been designated a "blue line stream". The walkway will transition back to gravel fines for an additional 3001f leading to S. Brightleaf Drive. Walkway from S. Brightleaf to W. Burton Farm (Trail 1B) Trail 1B continues on the south side of S. Brightleaf Drive and re-connects with W. Burton Farm Drive. The proposed walkway begins with 203 if of gravel fines leading to a 381f elevated six feet wide wooden walkway that crosses USACE Jurisdictional wetlands. The walkway transitions to a 6501f six feet wide gravel fines trail that leads back to W. Burton Farm Drive. Sawgrass Court Day-Dock and Walkway (Trail 1C) See above. Walkway from W. Burton Farm to Neuse River (Trail 1D) A community access to the Neuse River is proposed to be constructed at the W. Burton Farm community access and common area. The applicants propose to construct a 224 if by six feet wide gravel fines path that will transition to a 113 if by six feet wide wooden walkway as the path intersects the Zone II buffer. The wooden walkway will be constructed at or near the ground surface and will lead to permitted stairs and bulkhead to provide direct community pedestrian access to the Neuse River. Walkway from S. Brightleaf to Neuse River (Trail 1E) A community access to the Neuse River is proposed to be constructed at the S. Brightleaf Drive community access and common area. The applicants propose to construct a 130 linear feet by six feet wide gravel fines path that will transition to a 210 linear feet by six feet wide wooden walkway as the path intersects the Zone H buffer. The wooden walkway will be constructed at or near the ground surface and will lead to permitted stairs and bulkhead to provide direct community pedestrian access to the Neuse River. Walkway from Guardhouse to Clubhouse (Future Trail 1) The applicants propose to create a 2,417 if trail running from the parking lot across the street from the Guard House to the Club House. In uplands, the trail will be constructed out of 2,035 if of gravel fines, all 3821f of wetlands crossings will be constructed out of slotted wood elevated a minimum of three feet above the existing substrate. Walkway from Mill Creek to Clubhouse (Future Trail 2) The applicants propose to create a 1,6361f trail that connects Future Trail 1 to Mill Creek Drive at the north end of the development. In uplands, the trail will be constructed out of 1,208 if of gravel fines, all 428 if of wetlands crossings will be constructed out of slotted wood elevated a minimum of three feet above the existing substrate. Sprigtail Court Walkway (Future Trail 3) A walkway is proposed at the end of Sprigtail Court to provide a passive recreation dock overlooking an 4 unnamed tributary of the Neuse River-delineated as a blue line stream. Please note, the tributary is not navigable. The walkway will be constructed of 179 if gravel fines leading to a 155 if elevated wooden walkway. The elevated wooden walkway will terminate at a 60 sf (6'x 10') platform setback a minimum of 30 feet from the unnamed tributary. The elevated walkway and platform will be constructed out of slotted wood and elevated a minimum of three feet above the existing substrate. Walkway from W. Burton Farm to Pintail (Future Trail 4) The applicants propose to connect Pintail Drive with W. Burton Farm Drive with a 918 if gravel and slotted wood walking trail. One unnamed tributary (blue line stream) and wetlands crossing is proposed to be made with an 1161f elevated wooden walkway. Guardhouse Asphalt Parking Lot An 8,263 sf asphalt parking area (required by local zoning) is proposed adjacent to the existing Guardhouse as shown on the adjacent site plans. The parking area is addressed in both the Soil Erosion and Sedimentation Control Permits and the NC DWQ Stormwater Permits. The walkway and kayak platform will be constructed so that 6 feet will extend over wetlands (342 sf) and 6 feet will extend over public trust (342 sf) which includes a two feet wide lowered kayak loading pier (see details). The purpose of the Outfitter Center is to provide a direct community access to Mill Creek for kayaks and canoes. Sawgrass Court Day-Dock and Walkway (Trail 1 C)--The applicants propose to construct an elevated 6 feet wide by 118 linear feet wooden walkway from the community access on Sawgrass Court leading down to an 8 feet by 20 feet platform and day dock with benches to provide access to Mill Creek. There will be a side-to finger pier constructed along the dock measuring eight feet by three feet. The finger pier will be lowered to approximately eight inches above normal water to provide safe entry and exit for boaters. A set of stairs will connect the finger pier to the platform above. The proposed platform will extend out over Mill Creek six feet from normal water level and two feet will extend parallel to the shore over the shoreline/wetlands. The platform will be constructed a minimum of three feet above the substrate and normal water level. The purpose of the access and platform is to provide recreational access to Mill Creek with one day slip for a small recreational boat. There will be no permanent or overnight mooring allowed at the dock. The footprint of the structures are shown on the attached site plan. Walkways and Bridges--In addition to water dependent structures, the applicants propose to install a system of trails and walkways throughout the project to provide pedestrian access connections to the development, the Neuse River and Mill Creek. Walkway connections will involve crossings over Section 404 USACE, Coastal Wetlands and blue line streams. Any walkway over Section 404 USACE and Coastal Wetlands will be elevated a minimum of three feet over the existing substrate.
