The Division of Water Resources (DWR) has reviewed your submittal for a 401 Warer Quality Certification tbr the
aforementioned project. Review of your application revealed it lacking necessary inforniation required for making
an infornied permit decision. l he permit applica[ion was deficient in the fbllowing area:
• The dredging tha[ is proposed is ro occur during the sturgeon mora[orium, the DWR needs
documentation from Na[ional Marine Fisheries [hat thcy are allowing you to dredge during that time
frame. 15A NCAC 2H .Og06(b)(2)
Therefore, pursuant to I SA NCAC ?H .0�07(a)(5), we will have ro place the permit application on hold until we are
supplied the necessary information. You have 21 days to respond in writin� with the requested information or
no[itication ro[his office that [he information is forthcomine. If, a[ the end of [he 21 days, [his office has not
received this infomiation in writing, we will assume you are withdrawing your application and it will be returned.
Furthermure, until the information is received by [he NC Division of Water Resources. we reyuesl (by copy ofthis
letter) that the US Army Corps of Engineers place [he permit applica[ion on hold.
