Pine St Maiden, NC 28650 Subject: Request for a Revised NPDES Application NPDES Application NC0006190 South Fork Industries, Inc. Malden Plant Dear Mr. Owens: Delta Apparel submitted its application for renewal of NPDES permit NC0006190 on November 4, 2015, and the permit was administratively continued based on timely receipt of the completed application. In 2016, you corresponded with Julie Grzyb, NPDES Branch supervisor, to discuss what South Fork Industries needed to do to obtain an ownership change and to maintain the NPDES wastewater permit at the former Delta Apparel facility. On June 28, 2016, and again on August 10, 2016 (via an email to Mike Stanforth), Julie Grzyb outlined the basic information South Fork Industries was to submit in order for the permit to be renewed and modified to address wastewaters particular to South Fork Industries. The NPDES Branch has yet to receive your application. In accordance with N.C.G.S. 143-215.1, 15A NCAC 211.0 105, and 40 CFR 122, the Division requires a revised application from South Fork Industries which specifically characterizes its wastewaters, operations, process flows, and production rates, so that proper effluent limitations and other permit conditions can be established. The standard letter sent with the Name & Ownership change in 2016 recognized receipt of Delta Apparel's renewal application which is clearly not representative of South Fork Industries specific wastewaters. In order for the Division to renew and modify this permit, and to establish appropriate limitations relevant to South Fork Industries, a revised application must be submitted within 60 days to NPDES Complex Permitting Branch. The application must include, at a minimum, the following information: 1. Complete and accurate application forms, EPA Form 1 and EPA Form 2C1 with information relevant to South Fork Industries' current production operations and process wastewater discharges. These forms can be found on the DWR website at: https.//deq.nc gov/about/divisions/water-resources/water-quality-permltting/npdes- wastewater/npdes-permitting-0 State of North Carolina I Environmental Quality I Water Resources 1617 Mail service Center I Raleigh, North Carolina 27699-1617 919 707 9000 2 A detailed flow schematic showing all processes in the facility that have a wastewater discharge, including any floor drains for various tank overflows or equipment washings, along with estimated flow volumes and wastewater characteristics. 3. Updated estimates of summer and winter 7Q10 of the receiving stream (Clark Creek). Estimates can be obtained from USGS at no charge. (USGS contact: Curtis Weaver, jcweaver@usgs.gov) 4. Instream (Clark Creek) and effluent hardness data. The Division has adopted new dissolved metal standards for the state, and the NPDES branch is required to implement the standards in all permits advertised for public review after April 6, 2016. The new standards for seven metals are hardness -dependent. As a result, the NPDES branch requires site-specific effluent hardness data and instream hardness data for each facility monitoring these metals in order to calculate permit limitations. South Fork Industries must collect five effluent hardness samples and five instream hardness samples (as CaCO3), upstream of the discharge, and submit this data with its application. If no hardness data is submitted, a conservative default value of 25 mg/L (as CaCO3) will be used in the limits calculations 5. Identification of applicable effluent guidelines. Operations performed by the previous owner were subject to Federal Regulations covered under 40 CFR 410 Subpart E, Knit Fabric Finishing Subcategory. Limits for COD in the permit were based on average cloth production rates from the most recent 5 years. South Fork Industries shall submit cloth production data, including total annual production (lbs/year) and average daily rates (lbs/day) for the past five years (2013 through 2017 plus the beginning of 2018) clong with the revised application. South Fork Industries shall identify what Federal Effluent Guidelines and Subparts their production is subject to. Failure to provide a complete and accurate applmca:mon within 60 calendar days (or by May 14th, 2018) may be grounds for enforcement action or termination of NPDES permit NC0006190.
