Drew Morgan (Durham Co. Environmental Health) had estimated the discharge at about 3,000 gallons/day. Mack Wiggins from your office can verify this. Upon removing a section of pipe closest to the discharge point, the pipe was capped to prevent further discharge. Drew informed us that since sand filters fell under DWQ jurisdiction, he would write a letter to DWQ informing them of the failing system and asking for DWQ enforcement. This project has been migrating beyond my area of expertise, so I believe that since the discharge has ceased, DWQ should coordinate directly with Real Estate Associates to resolve the issue with the failing system. James Allen of Real Estate Associates was on-site to coordinate the digging. By copy of this email, I am asking my contact at Real Estate Associates to verify that DWQ may coordinate with James to resolve the matter of the failing system. James Allen's number is 201-3053. SatedEC can From: Jason Payne 1 of 6 5/15/2008 5:34 PM Brightleaf Appeal - FW: Elicit Discharge Investigation Sent: Wednesday, September 13, 2006 3:07 PM To: 'Drew Morgan'; 'Joe Albiston' Cc: 'Joe Jernigan'; 'Joe Ng'; 'mack.wiggins@ncmail.net' Subject: Elicit Discharge Investigation Gentlemen, On Monday, 9/12/06, we met at the property located at 2106 US 70 HWY E to investigate the source of an apparent elicit discharge into an existing storm sewer adjacent to Hwy 7o East. During our meeting, Drew Morgan (Durham County Environmental Health Specialist) agreed that the discharge was not likely authorized, and that the discharge is continuous at an estimated 1,500 gallons per day from a schedule 40 line. The origin of the wastewater is not known; therefore exploratory digging was proposed to locate the source. The property owner (Joe Jernigan c/o Real Estate Associates) agreed to provide a backhoe and operator to locate the source in an effort to eliminate the discharge. Because the discharge point is into a stormwater system, Joe Albiston (Durham County Stormwater Manager) was contacted by Drew Morgan. Mr. Albiston met us on-site to further review the discharge and discuss measures necessary to coordinate the exploratory digging. Mr. Albiston provided contact information for an engineer with NC-DOT and recommended we notify DOT of the proposed exploratory digging, since it will occur adjacent to the stormwater drain alongside Hwy 70 (and the storm drain is actually a DOT structure/system, per Joe Albiston). The attached photographs document the current condition of the drain, which appears to be in need of repair. I contacted Joe Ng of NC-DOT today, and coordinated a meeting on Friday morning to review and discuss any DOT considerations that should be taken into account during the exploratory digging. Notwithstanding issues that may arise during Friday's DOT meeting, we are scheduled to begin exploratory digging on Wednesday, September 20, 2006 at approximately 10-10:3o a.m. I have a few questions that I would appreciate either Joe Albiston's or Drew's answer on prior to digging. First, does the work you are requesting require any permits we may not be aware of (i.e. grading, etc.)? What other equipment and/or personnel would you need at our disposal on Wednesday morning? Is it possible to begin prior to 10-10:30 in your absence in an effort to expedite the process? My client pointed out that this could be tedious and time consuming work.
