Brightleaf Commons; Durham, Durham County, North Carolina
On behalf of the property owner, Real Estate Associates, we request an appeal of the buffer determination
performed by Debbie Edwards on April 15, 2004 as part of the permitting process for the adjacent
property (Brightleaf, owned by Rhein Interest). Ms. Edwards met S&EC on site and determined feature
A to be subject to the Neuse Buffer Rule (see attached maps). However, recent investigation and site
meetings conducted with Mack Wiggins of NC-DWQ uncovered an elicit discharge at the origin of
this feature. Therefore, we believe this feature lacks the necessary indicators of an intermittentibuffered
stream channel. As such, we request a re-evaluation of Ms. Edward's analysis. Please accept this letter
as an official request. We are only appealing the determination of stream "feature A". Your help in
clarifying the status of the application of the Neuse Buffer Rules to this feature is greatly appreciated.

Dear Mr. Westmoreland:
On April 15, 2004, at your request I oonduoted an on-site determiMtlon to review 3 features located on the
subject property far applicabfrdy to the Neuse Butter Rules (15A NEAC 2B .0233). These features are
labeled as "A, B and C" on the attached reaps.
The Division of Water Quality (DWO) has determined than the surface waters labeled as "A" on the
attached map is subject to the Neuse Suflsr Rule, feature A is subject from the culvert of Hwy 70

should notify the DWO (and other relevant agencies) of this decision In any future oorrespondenoes
oonoeming this property. This on-site determination shall expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DW O or Delegated L:ooal
Authority that a surface water eocista and that it is subject t0 Lhe buffer rule rtmay raquost a determination by
the D1 sonar. A request for a determination by the Director shall be refereed to the Director in writing do

dispute a determination by the'DWQ or Delegated Local Authority that "exempts" a surface water from the
buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive
this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until the
affected party (including downstream and adjacent landowners) Is notified of this decision. DWO
recommends that the applicant conduct this notification in order to be certain that third party appeals are
made In a timely manner. To ask for a hearing, send a written petition, which conforms to Chapter 1506
of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Servioe Center,
Raleigh, N.C. 27699-6714. This determination is final and binding unless you ask for a hearing within 60
days.
