In accordance with 15A NCAC 211.0107(b),we must hereby return the attached permit application
received on August 18,2017.After a preliminary review in accordance with N.C.G.S. 143-215.1 and 15A
NCAC 211.0105,the Division has determined that the application package lacks the following items:
1. Demonstrate Appropriate Easements: A portion the discharged effluent pathway to waters of
the state appears to be located on an adjacent lot owned by you.Although this property is
subdivided under the same ownership,an easement is required.Please provide documentation of
easement agreements that are attached to both property deeds including any professional surveys.
Such easements should allow discharged wastewater to flow across any property under separate
ownership from the point of discharge to waters of the state. Easement agreements should be
attached to property deeds.Please contact a real estate attorney to help you complete and file an
easement with county register of deeds.
If you wish to reapply for an NPDES permit, correct these items before resubmitting the application.
