PROJECT SUNLMARY: The applicant is proposing to construct a pier, platform, finger piers, tie pilings, 8 slips, extension of the existing gravel access road, a boat/rv storage area and a future 52 lot s/d. 9. Narrative Description: The Eric Stroud project is located adjacent to Morada Bay S/D in Newport, Carteret County. Morada Bay s/d is found by turning off of Hwy. 24 east onto J Bell Lane. Follow Morada Bay Drive to the future site of Phase III, Morada Bay. Follow the existing partial dirt and rock road until the cul-de-sac appears. The site is located at the waters edge through the woods. The site lies on the northern side of Bogue Sound in this area. The subject property is 1,737,241 square feet in its entirety and averages 16.5' in elevation above NHW. There are not any structures currently on the high ground portion of the site; however, there is an existing gravel access way on the property. Along the shoreline of Bogue Sound is a 50' fringe of Coastal Marsh that contains Black Needlerush (Juncus roemaerianus), Scirpus Spp, Salt Meadow Grass (Spartina patens) and Smooth Cordgrass (Spartina alterniflora). The high ground portion of the track is vegetated with Loblolly Pine (Pinus taeda), Scrub Oak ( uercus mohriana) and Live Oak (Quercus vir ing iana). Aerial photographs and site visits with DMF indicate that SAV's do exist in the area. The shoreline has a length along the NHW line of 923.69ft for the entire tract and 50ft for the pier access easement. There is a single-family residential S/d to the west and single-family residential parcels located to the east. The single family S/d at the west has a community dock next to the proposed project. This project is intended to serve the existing Morada Bay subdivision and the future 52 lot Morada Bay IV. The Division of Water Quality classifies this area as SA and ORW waters. This area is not a Primary Nursery Area. This portion of Bogue Sound is open to the taking of shellfish and is a width of 1,065'. There is a COE federal channel setback of 80'. Substrate within this area is mostly silt and sand. Carteret County's Land Use Plan dated 1996 classifies this area as Limited Transition with Conservation within the AFC's. There are no shellfish leases in this area. 10. Protect Description: The project consists of construction of a 6'x32' boardwalk, 6'x 293' pier, 8'x15' platform, four 2.7' x 10' finger piers, four tie pilings, eight slips, a 12'x 473' extension to the existing gravel access road, boat/rv storage area and a future 52- lot s/d. The pier would provide boating and pedestrian access to Bogue Sound for owners and residents of the existing Morada Bay subdivision and the future Morada Bay IV. The 6'x 32' boardwalk would cross over jurisdictional wetlands with a 6' x 35' portion of the pier crossing over coastal wetlands. The remaining portion of the pier would cross open water and would retain the dimensions of 6' x 258' from the water ward edge of the marsh. There would be an 8' x 15' platform located at the most waterward end of the pier. They applicants are also proposing 4 finger piers that would extend from the pier portion. They would be located landward of the proposed platform with two located on the west side of the pier and Eric Stroud Page 3 two located on the east side of the pier. They would retain the dimensions of 27 narrowing to 1' and would be 10' in length. There would be four tie pilings located within this area to help formalize the proposed 8 wet slips. Bogue Sound is approximately 1,065' wide in this area and the pier with platform would extend 266' into the water body from the waterward edge of the marsh. The most water ward extent of SAV's observed end at 206' from the edge of the marsh. The eight slip areas would be located starting at 213' from the edge of the marsh. All slip areas and finger piers would be located outside of the observed SAV location. The finger piers for slips one and eight would be located 3 to 5 feet waterward from the outermost limits of the SAV's. Water depths around the proposed dock average -2.9'NLW. The platform area of the dock would be 120ft2 on an easement shoreline of 50'. Substrate composition is mostly sand and silt. Riparian lines are drawn 90° from the channel and appear to coincide with aerial photography showing the channel configuration. The dock would be located 268 feet from the 80' intracoastal channel setback. The proposed dock would not be a hindrance to navigation. The applicants are also proposing a road extension to connect to the existing gravel road. The extension would be 12' wide and 432' long with an oval gravel turnaround and cover .025 % impervious within the AEC and.072% impervious outside of the AEC. There would be a 30,000 square feet gravel rv/boat storage located outside of the AEC. The total area of disturbance for upland development would be 2.06 acres. Per the applicant a cross easement agreement between Inland Properties Group (developers of Morada Bay phases I, II and III) and Eric Stephen Stroud Has been recorded with the Carteret County Register of Deeds. The easement allows Mr. Stroud access for his property and in return the residents of the existing subdivision have been given water access rights on Mr. Stroud's property with a rv/ boat storage also provided. 11. Anticipated Impacts: This proposed pier would result in 2,635ft2 of open water incorporated while shading 1,776 ft2. The pier would also shade and incorporate 210 ftz of coastal wetlands and the boardwalk would shade and incorporate 192 ft2 of jurisdictional wetlands. The upland development for a connecting gravel road to the existing gravel road would cause 89,733 ft2 of disturbance. An increase in turbidity will occur while setting pilings. There should be no hazard to navigation resulting from this project, as there are other docks of equivalent length along the same shoreline. No coastal marsh would be filled or excavated during this project. SAV'S were observed during field visits, however the slips should not impact the SAV's due to the location proposed and the existing water depths. The site also contains an existing gravel access road. The property fronts Bogue Sound and is adjacent to single-family residential areas, including the Morada Bay subdivision (Phases I, 11, and III). Access to the project site is gained from NC Highway 24 through Morada Bay. Within the Coastal Shoreline AEC, the project consists of construction of an 8-slip wooden pier with finger piers and tie pilings and a 536.3' x 12' extension of the existing gravel access road. Outside the AEC, the project consists of a 570' x 24' gravel road extension accessing a 30,000 square foot gravel boat/RV storage area. The existing gravel road connects the proposed road extensions. The existing road section and the proposed road section accessing the boat/RV storage area will eventually be paved. The water access and boat/RV storage area will serve owners and residents of the existing Morada Bay subdivision. A potential future single-family subdivision (Morada Bay IV) to be located on the tract will also be served by the project. (Morada Bay IV, consisting of 52 lots, received sketch approval by the Carteret County Planning Commission in October 2005. There are no current plans or timeline for development of Phase IV, other than the water access and boat/RV storage areas.) The pier will be located on a 50' wide water access easement that is included in the Cross Easement Agreement described below. Only the shoreline adjacent the access easement will be dedicated to the proposed pier facility. The pier will measure 258' x 6' with an 8' x 15' platform. Four finger piers measuring 10' by 2.7' narrowing to 1' and 4 tie pilings are included. The pier is located 20' from the adjacent riparian corridor to the west. Mr. Stroud has provided a waiver as the adjacent riparian property owner to the east of the easement to allow the structure to be built within the eastern setback. A copy of the waiver is enclosed. The boat slips associated with the pier have been located beyond the waterward extent of SAVs found at the site. An on-site meeting with representatives of National Marine Fisheries and the NC Divisions of Marine Fisheries and Coastal Management located SAVs waterward for a distance of 210' from edge of marsh. Normal low water depths in the area of the boat slips measure -2.9' to -3.0'. A Cross Easement Agreement between Inland Properties Group, LLC (developers of Morada Bay Phases I, II, and III) and Stephen Stroud, dated August 4, 2006, has been recorded with the Carteret County Register of Deeds. The easement allows Mr. Stroud access to his property through Morada Bay Phases I, II, and 111. In return, residents of the existing subdivision are given water access rights on Mr. Stroud's property and a boat/RV storage area is provided. A state stormwater permit and approval of an erosion and sedimentation control plan for Morada Bay Phase IV were recently issued. These permits were pursued to allow development of the boat/RV storage area and to comply with CAMA permit application requirements for full disclosure.
