Re: Mountain Electric's Sugar Mountain Transmission Line, PCN Follow-up Response
Requests
Response requests from NC DWQ:
Condition 1.4. of Water Quality Certification (WQC) 4133 (attached), which corresponds to
U.S. Army Corps of Engineers Nationwide Permit 12, requires that construction corridors in
wetlands and across stream channels be minimized to the maximum extent practicable and
shall not exceed 50 feet wide for gas utility lines and 40 feet wide for all other utility lines. The
proposed construction corridor width at stream crossings for the subject project is unclear.
The Division understands that a 100 foot cleared right-of-way is required for the project.
However, it is anticipated that the construction corridor, including any land -disturbing activity,
will be necked down, or tapered, at stream and wetland crossings. Please confirm that this
condition will be met or clearly explain why it cannot be met. (15A NCAC 02H 0506 (b)(2) and
(c) (2)]
Mountain Electric Cooperative ("MEC") will be constructing an overhead electric high
voltage transmission line that requires a 75 -foot -wide cleared right-of-way, which is
MEC's standard right-of-way width. This right-of-way width will be maintained along
the entirety of the line and cleared of vegetation (primarily mature trees) that could
potentially fall on the line. Understory vegetation (less than 15' in height) adjacent to
streams will be retained where vehicular stream crossings are not proposed. Table 5-3
within the Rural Utilities Service Bulletin 1724E-200 includes typical right-of-way
widths for various voltages. Within the 69 kV category, the right-of-way width is shown
between 75-100 feet wide. MEC's 75 -foot -wide corridor is already set at the minimum
width allowable while still ensuring appropriate protection from danger trees.
2. Condition 1.5. of WQC 4133, requires that permanent maintained access corridors in wetlands
and across stream channels be restricted to the minimum width practicable and shall not
exceed 30 feet wide for gas utility lines and 20 feet wide for all other utility lines. The subject
Pre -Construction Notification includes proposed stream impacts ranging from 30-50 feet.
Please revise the proposed culvert length to that allowed by the WQC, or clearly explain why
the additional impact length is needed. (15A NCAC 02H 0506 (b)(2) and (c)(2)]
MEC always attempts to minimize impacts to environmental resources wherever
possible, and the access corridors across stream channels are no exception. However, the
Sugar Mountain/Banner Elk area includes steep terrain that is difficult to access with
construction equipment necessary to erect and perpetually maintain the new 69 kV
line. In order to provide access in these areas, some grading is necessary to build access
roads across these streams, which is why some of the culverts are longer than others.
3. Condition 11.11. of WQC 4133 requires culvert burial, with some exceptions including slope, in
order to allow for aquatic life movement. It appears that at least one culvert is proposed to be
installed at a slope requiring culvert burial. Please provide a cross section detail showing the
provisions for aquatic life passage that meet Condition 11.11. of WQC 4133. [15A NCAC 02H
.0506(g)]
The cross-section detail of S3 is included in the packet.
4. Condition 11.11. of WQC 4133, also requires that, if multiple pipes or barrels are required, they
shall be designed to mimic the existing stream cross section as closely as possible including
pipes or barrels at floodplain elevation and/or sills were appropriate. Widening the stream
channel should be avoided. Stream channel widening at the inlet or outlet end of structures
typically decreases water velocity causing sediment deposition that requires increased
maintenance and disrupts aquatic life passage. Please revise the permanent double culvert
installation detail to meet the noted condition. [15A NCAC 02H 0506 (b)(2) and (c)(2)]
The proposed culvert installations, that exceed the existing stream bed width, were sized
per the TR -55 Watershed Hydrology 10 year storm data and were " sized down" to the
extent possible. Multiple options for the crossing of these streams were considered, but
all presented reasonable concerns for additional/ongoing disturbance and/or future
impacts to the streams. Widening of the streams will be avoided except where streams are
less than 3' wide (S12 and S9), as culverts are 36" (or greater) in diameter.
5. Please explain why rip rap is necessary at the culvert inlet and outlet and include any
applicable calculations demonstrating the need for this material. If the rip rap is necessary,
please provide a detail showing the proper installation (below the streambed elevation) of the
rip rap pad at the culvert inlet and outlets. In addition, if the rip rap is proven to be necessary,
please revise the stream impact table to include the permanent impacts associated with the
rip rap pads. [15A NCAC 02H .0502(b)]
Riprap was provided out of an abundance of caution; however it is not necessarily
needed. The riprap has been removed in these areas.
6. Please explain why impact S9 is necessary. It appears that the utility easement could be
accessed from Hickory Nut Gap Road, thereby eliminating the need for impact S9. (15A
NCAC 02H .0506(0 and (g)]
MEC has investigated access in this area in great depth and has determined that the
stream crossing at S9 is necessary to access transmission structures 18 and 19. The
construction entrance location at structure 20 is the most appropriate point to access the
transmission easement from Hickory Nut Gap Road due to site-specific topographic
conditions adjacent to the road and traffic safety issues with regard to motorists line -of -
sight.
Response requests from USA CE:
Updated/revised threatened and endangered species assessment report that includes all
currently listed species for this area/county (to include bat species). Again not requesting
actually survey results but a complete list/description of relevant species and their habitat and
what if any habitat exists within the right-of-way/construction corridor. The report should also
note any anticipated effects on these species/habitats from the proposed work (see #2 for
related question).
The updated report and list was emailed to all parties, and is included in the
Response_Request Packet.
2. Also please provide information on the amount of trees that will be cleared within a) the
impact areas and b) the right-of-way in its entirety and if there are any percussive activities
planned (e.g. drilling, explosives, jack -hammering).
All areas within the ROW will be cut down to an early successional state; a tree count
was not conducted. The site plans detail locations of transmission poles. Auguring of
holes for the transmission poles will occur at each pole location. Until geotechnical
investigations occur, it is not known what construction techniques will be required to
auger the holes. Due to the terrain, geotechnical investigations cannot occur until the
right-of-way is cleared and any access roads are installed.
3. Plan/cross-sectional profile of proposed culvert impacts so that can determine if pipes are
properly sized, buried, and if any rip rap is proposed.
Please see culvert installation plans; a cross-sectional drawing of S3 is included in the
packet.
4. If proposed permanent impacts are 190 linear feet of stream channel, then a mitigation plan
needs to be submitted that will compensate for these permanent impacts.
Per "Note 2" of NWP 12, I have the understanding that impacts for linear projects are
calculated per stream and therefore are not cumulative for the project.
5. Mapping labels/corrections for Jurisdictional Waters: a) There are several discrepancies
between what is labeled/shown as jurisdictional waters on the USGS topographic maps - not
all waters have been labeled on the overall topo maps even though streams are shown
(assuming these are S2, S3, S6, S11, S14?). Sugar Creek (S6) is also not labeled as such on
the enlarged or the overall.
The revised maps are included in the packet. Sugar creek is S6. Please note that the
plans that were submitted are updated (from those of the field visit) and have correctly
labeled stream titles. Please let me know if there is any more confusion.
6. Impact clarification: On the PCN, the S9 is listed as 30 linear feet but it appears that the
plan label shows 40 linear feet.
A PCN form with corrected number is included in the packet.
7. Please include a discussion on if the cleared vegetation will be left in place or hauled off. If
hauled off, where is the planned disposal sites.
Brush and cleared vegetation debris from the transmission r/w corridor shall be "chipped"
and spread uniformly over the r/w. Debris from areas outside of the r/w on private
property may be spread on the ground if permission is granted by the property owner.
8. Please provide/include any correspondence from SHPO regarding previous cultural
resources review/coordination.
UCS submitted this project to the SHPO for review on 12/13/17. We have been in
contact with Renee Gledhill -Early of the SHPO, and have received confirmation
that the project is currently under review. We have requested comments within
30 days of the original submittal.
Response Requests from NC Wildlife Resources Commission:
1. Please provide the temporary and permanent seeding specifications for the project. We
strongly recommend that the permanent seeding mix consist of native grasses and forbs with
an emphasis on pollinator species. This was recently done for another gas pipeline project in
the upper piedmont. NCWRC can work with USFWS to provide recommendations, if needed.
Byran Tompkins was able to recommend a seed mix (of native species) that I will pass on
to our engineers for evaluation. I believe it passes State sedimentation and erosion
control requirements.
2. We recommend against using double-barreled culverts. Double culverts set at the same
elevation often result in one culvert carrying most or all of the flows over time; this can cause
channel instability and problems with aquatic organism passage.
A single culvert scenario was considered, but it would not allow adequate flow of water
as modeled during the 10 -year storm event. Additionally, a single culvert scenario would

require a much larger pipe, and therefore a significant additional amount of fill material
would have to be placed in and around the culvert. This fill material would be required to
tie the finished grades of the proposed access road back into existing grades in order to be
acceptable for vehicle passage.
We recommend avoiding rock outcrops and cliffs within the right of way; are there any of
these features in the ROW?
No rock outcrops or cliffs were found within the ROW.
In order to lessen the impacts of the project to various amphibian species, we recommend
leaving downed woody debris on the edge of the corridor. Can this be done?
Leaving debris on the edge of the ROW will likely not be possible in most areas because
the ROW are on private property, and private land owners generally like their land left
looking tidy. I will pass that recommendation on, in case there are areas where it could
be applied.
