Sullins Governor Director March 18, 2009 Natural Resources Dee Freeman Secretary MEMORANDUM To: Marc Hamel, NCDOT Rail Division From: Rob Ridings, NC Division of Water Quality, Transportation Permitting Unit Subject: Scoping comments on proposed rail projects: P-4804A (Edgecombe County') and Y-4806A (Cumberland County). Reference your correspondence dated February 20, 2009 in which you requested comments for the referenced projects. Investigations should be undertaken by NCDOT to verify the presence of streams and/or jurisdictional wetlands in the area. In the event that any jurisdictional areas are identified, the Division of Water Quality requests that NCDOT consider the following environmental issues for the proposed project: Project Specific Comments: 1. Project P-4804A is within the Tar-Pamlico River Basin. Riparian buffer impacts shall be avoided and minimized to the greatest extent possible pursuant to 15A NCAC 2B.0259. General Project Comments: 1. The environmental document shall provide a detailed and itemized presentation of the proposed impacts to wetlands and streams with corresponding mapping: If mitigation is necessary as required by 15A NCAC 2H.0506(h), it is preferable to present a conceptual (if not finalized) mitigation plan with the environmental documentation. Appropriate mitigation plans will be required prior to issuance of a 401 Water Quality Certification. 2. Environmental assessment alternatives shall consider design criteria that reduce the impacts to streams and wetlands from storm water runoff. These alternatives shall include road designs that allow for treatment of the storm water runoff through best management practices as detailed in the most recent version of NCDWQ Stormwater Best Management Practices, such as grassed swales, buffer areas, preformed scour holes, retention basins, etc. 3. After the selection of the preferred alternative and prior to an issuance of the 401 Water Quality Certification, NCDOT is respectfully reminded that they will need to demonstrate the avoidance and minimization of impacts to wetlands (and streams) to the maximum extent practical. No. Y-4806A, Federal No. STP-0620(14) WBS No. 40325.3.4 The North Carolina Department of Transportation (NCDOT) Rail Division is evaluating the closure of an the Rankin Street urban local street crossing with the CSX Railroad in Fayetteville, Cumberland County (sec Figure 1). The Rankin Street rail crossing was identified in NCDOT's Traffic Separation Study for the City of Fayetteville. This initiative proposes safety improvements within the City of Fayetteville that close crossings where feasible and protect the crossings that will remain open with crossbucks, automatic flashers and gates, signals and locking gates. The Rankin Street Crossing (# 629 884B) closes the at-grade rail crossing and alters traffic patterns on Winslow and Rankin Streets. Streetscape designs and crossing protection features will be added these streets. We would appreciate any information you have that would be helpful in evaluating potential community and environmental impacts for this project. If applicable, please identify any permits and/or approvals required by your agency. Nine threatened or endangered species are listed for Cumberland County according to the (January 31, 2008 FWS list) US Fish and Wildlife Service species list. The Clark Street rail crossing was identified in NCDOT's Traffic Separation Study completed for the city of Rocky Mount in May 2002. This initiative proposes safety improvements within the City of Rocky Mount that close crossings where feasible and protect the crossings that will remain open with crossbucks, automatic'flashers and gates, signals and locking gates. i The Clark Street crossing (#629 774R/629 775X) provides parallel access for residential homes in the vicinity. With the closure of this crossing, alternative access would be provided for properties on Clark Street on either side of the rail line. Norfolk Street would be extended on the south side of the rail line between Clark Street and Pender Street. South Street would be extended on the north side of the rail line from Pender Street to Branch Street. These extensions would occur predominantly within existing rail Right-of-way or CSX owned property.
