The pier will extend off the south face of the existing gazebo. Currently when patrons arrive by boat they must tie the boat off to the gazebo, climb on to the bow of the boat and carefully climb over the back of the benches on the gazebo that form the railing. In breezy conditions this can become a bit tricky, difficult and somewhat dangerous. When they depart they must go through the same procedure in reverse. It would be much safer to have a normal pier so that customers arriving by boat can just pull up along side the pier and exit and re -board the boat in a conventional manner. The benches on the pier are being provided so that when customers need to wait for a table during busy periods they have a place to sit. PROJECT SUMMARY: The applicant proposes to construct a 72'x6' pier to extend off the south side of the existing gazebo, and will include 4 cantilevered benches and 6 wet slips. Field Investigation Report: Tale of The Whale Restaurant Page 2 Project Setting The development site is located at 7575 S. Virginia Dare Trail (US 64), Nags Head, in Dare County and adjacent to the Roanoke Sound. The site is developed with a restaurant building, paved parking, bulkheading, deck, dock and gazebo. The tract is approximately 58,000 sq. ft. (1.33 acres), with 298' of shoreline. The property has an elevation of approximately 4.5' above normal water level (NWL), and has sandy soils and is vegetated with indigenous grasses. There is a small wetland fringe to the east of the restaurant which consists of black needlerush (Juncus roemerianus), salt meadow hay (Spartina patens), and non -coastal vegetation. The water depths at the site range from 1'-5" to 2'-5" from the bulkhead to the southern end of gazebo, and consists of a sandy bottom. The proposed transient pier would extend out to depths of 3'-2" to 4'1 ". No submerged aquatic vegetation was observed. There appears to be no known archeological sites on the property. Riparian properties to the east of the Tale of The Whale restaurant are a vacant, undeveloped lot and Caribbean Corners' cafe and retail condominiums. Riparian property to the west is a convenience food market store/gas station. Previous permits issued for the project tract include the following: • CAMA Major Permit, #236-87, for pier, gazebo, and walkway • CAMA Minor Permit, #03-007, for elevated walkway, handicap ramp, deck and steps. • CAMA Major Permit, #183-06, for shoreline stabilization (bulkhead, return wall, riprap). • CAMA General Permit A58935, issued through 07H.2500 for the reconstruction of the pier, platform, and gazebo destroyed during Hurricane Irene. The Roanoke Sound is classified as Coastal Waters. The Division of Environmental Management's water classification for Roanoke Sound is SA and High Quality Waters (HQW) by. This area is closed to shellfish taking. Development Proposal The applicant is proposing to construct a 72' long by 6' wide pier, with 4 cantilevered benches, each measuring 8' by 2'. The location of the proposed pier will be at the southern end of the existing gazebo. The total length of the existing dock/gazebo structure measures 93' from the bulkhead, and the final length of the pier/docking facility after construction of the transient pier would be approximately 165'. Six 'wet slips' are proposed so that transient boaters can tie up to the pier when visiting the restaurant. The benches will be for customers to have outside seating while waiting for a table in the restaurant. Currently there is no easy access to the pier/gazebo from the adjacent waterbody. Customers that arrive by boat must climb over the back of the gazebo's benches or dock railings. Anticipated Impacts The development proposed will result in the shading of approximately 496 sq. ft. of Public Trust Area and Estuarine Waters Areas of Environmental Concern. Temporary water turbidity will occur during construction.
