WITHERS L?March 17, 2009 Mr. Ian McMillan North Carolina Department of Environment & Natural Resources Division of Water Quality 2321 Crabtree Blvd., Suite 250 Raleigh, NC 27604-2260 RE: River Run Phases 4 and 5 DWQ Project No. 04-0544 W&R No. 02080688.01 Dear Mr. McMillan: The attached plans are being submitted for the purpose of modifying the previously issued 401 Water Quality Certification for the above referenced project. Please find the following plans and calculations included with this submittal: - 2 copies Modified Impact Maps - 2 copies Stormwater Management Report As discussed in our meeting last week, the proposed modifications to the previously issued permit are necessary for development of Phases 4 and 5 of the subject property. Impacts have been avoided and minimized to the greatest extent practical. The previously issued permit allowed for a total impact to 181 linear feet of perennial streams and 11,685 square feet of protected riparian buffers. As indicated on the attached modified impact maps, this proposed modification will increase the total impacts to 230 LF of stream impact (increase of 49 linear feet) and 21,133 SF of buffer impact (increase of 9,448 square feet). These impacts are necessary for the construction of a cul-de-sac roadway extension required to access the upland portions of the property, together with pedestrian trails proposed for interconnection of the 2 phases which are separated by a jurisdictional stream. Potential impacts to this stream crossing have been avoided by elimination of a road crossing indicated on previous Preliminary Subdivision Plans, and minimized by use of the pedestrian trails in place of the roadway. Additional temporary buffer impacts are indicated on the modified impact maps for the purposes of gravity sewer construction and connection to the existing system, together with the outfall swales necessary to convey storm water discharge from the proposed underground sand filter BMP's through the buffer for direct discharge to the stream, thereby preventing erosive velocities within the buffer. Please note that the sewer alignment has been modified from the originally issued permit, such that proposed temporary impacts T and U replace previously permitted but not constructed impacts O & P.
