Dear Ms. Simpson:
On February 11, 2009, the Division of Water Quality (DWQ) received your, application dated February
11, 2009 to impact 5,051 square feet (ft) of Zone 1 protected riparian buffers and 6638 square feet (ft) of
Zone 2 protected riparian buffers to construct the proposed greenway trail. On February 25, 2009, the
DWQ mailed you a letter requesting that the 10' wide greenway trail be reduced to at least 8 feet in width
to minimize impacts to the protected riparian buffers. On March 6, 2009, the DWQ received your
additional information stating the trail width would not be reduced as previously requested by DWQ.
Since you have failed to reduce your buffer impacts, DWQ is returning your application. To reapply,
please provide the following information so that we may review your project.
Impact Justification (Avoidance and Minimization)
This Office believes that the proposed 10' wide greenway trail could be reduced to 8 feet in width
to minimize the impacts to the protected riparian buffers. Please submit revised plans and a
revised buffer impact table in Section C.6 of the Preconstruction Notification (PCN) Form.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at
this time) by the DWQ. Please call Amy Chapman or Cyndi Karoly at 919-733-1786 if you have any
