P.A. to appeal an on-site determination made by the Town of Cary as provided in 15A NCAC 02B .0267 (4)(d). On January 16, 2018, Shelton Sullivan of DWR, conducted an on-site determination to review the feature located on the subject property for applicability to the Jordan Buffer Rules (15A NCAC 02B .0267). The feature evaluated is a headwater of Nancy Branch, Class WS -IV Waters within the Cape Fear River Basin and within the Jordan Lake Watershed. The feature evaluated is labeled as "A" and "B" on the attached maps initialed by Shelton Sullivan. During the review, Mr. Sullivan evaluated the feature using the DWR Stream Classification Form. Feature A is on the subject parcel PIN 0735577241 and receives flow from a culvert under NC 55. The feature continues downstream to the adjacent and downstream properties. Feature A was evaluated to have a score of 15.0 on the DWR form, and therefore, ephemeral and NOT SUBJECT to the Jordan Buffer Rules on the subject parcel PIN 0735577241. The site visit and review of Wake County GIS maps revealed that the feature continues onto the adjacent and downstream parcels (PIN 0735576503, PIN 0735478571 and PIN State of North Carolina I Environmental Quality I Water Resources 1617 Mail Service Center I Raleigh. The feature was determined to be an intermittent channel at a property corner between parcels PIN 0735576503 and PIN 0735478571 as indicated on the below map. At this point and continuing downstream, the feature is labeled as Feature B, Nancy Branch, and was evaluated to have a score of 24.5 on the DWR form, and therefore, SUBJECT to the Jordan Buffer Rules. The forms and maps are attached to this letter. The property owners of parcels PIN 0735576503, PIN 0735478571 and PIN 0735573739 are copied on this letter. This determination, DWR Project # 20171573, shall replace the determination originally performed by the Town of Cary as documented in their letter dated October 25, 2017 and reference number TCRB 17-04. This determination shall expire five years from the date of this letter. This determination can be contested as provided in General Statute 150B by filing a written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH) within sixty (60) calendar days. A petition form may be obtained from the OAH at http://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-3000 for information. A petition is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received in the OAH during normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding official state holidays). The petition may be faxed to the OAH at (919) 431-3100, provided the original and one copy of the petition along with any applicable OAH filing fee is received by the OAH within five (5) business days following the faxed transmission.
