You have our approval, in accordance with the condi[ions listed on the original 401 issuance, for the original
impacts with the purpose ofconstructins direct connectors [o the I-77 HOT lanes a[ Lakeview and Hambrigh[ Roads
in Mecklenbure Counry. This renewal is bein� issued to address the expiration of the General Certitication 3886,
which was previousl}� issued by NC DW R in accordance with Na[ionwide 14 Permi[ from by the Corps of
En�ineers. General Certification 3886 has been amended and replaced by General Certification 4135, which now
accompanies N W 14 and covers the afore mentioned project. No impact changes from Ihe original 401 permi[
issued February 17, ?017 are au[horized by this reissuance and all permit condi[ions s[ill apply.
In addition, you should acquire any other federal, s[ate or local permi[s before you proceed with your project
includin� (but no[ limi[ed [o) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed
regulations. l'his approval will ezpire with the accompanying 404 permi[.
This approval is valid solely for [he purpose and desi�n described in your applica[ion (unless modified below).
Should your project change, you mus[ notify [he NCDWR and submit a new applica[ion. Ifthe proper[y is sold, the
new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying
with all [he condi[ions. If [o[al wetland tills for this project (now or in the future) esceed one acre, or of rotal
impacts ro streams (now or in ihe future) exceed I>0 linear feet, compensarory mitigation may be reyuired as
described in ISA NCAC 2H .Oi06 (h) (6) and (7). For this approval to remain valid, you must adhere to [he
conditions listed in the attached certification(s) and any addi[ional conditions.
If you wish to con[es[ any statement in [he attached Certification you must tile a pe[ition for an administra[ive
hearine. You ma}' obiain the petition form from [he o�ce of Administrative hearings. You must file the pe[i[ion
with the office of Administrative Hearines wi[hin sixty (60) da}�s of receipt of this notice. A peti[ion is considered
filed when it is received in the oftice of Administrative Flearings during normal office hours. The Office of
Administrative Hearings accepu filings Monday through Priday between the hours of 8:OOam and S:OOpm, except
for official state holidays. The ori�inal and one ( I) copy of the petition must be filed with the Otiice of
Administrative Hearines.
The petition may be fased-provided the orieinal and one copy of the document is received by the Office of
Administrative Hearings within tive (5� business days following the faxed transmission.
