Dear Mr. Horne:
On December 8, 2017, Trent Allen, the Fayetteville Regional Office Supervisor of the Division of
Water Resources (DWR), assessed a civil penalty against the City of Lumberton in the amount of
$380.03, which included $130.03 in investigative costs, for a sanitaiy sewer overflow on
September 6, 2017 at 515 Noir Street. DWR has the certified mail green card that shows that you
received the civil penalty assessment on December 22, 2017.
In that letter, you were notified that you had three options available to you within thirty (30) days
according to North Carolina General Statute 143-215.6A. You could pay the penalty, you could
request remission of the penalty, or you could file a contested case petition with the Office of
Administrative Hearings. As of March 2, 2018, our records do not show that you have done any
of those three things.
If our records are in error, please contact me immediately by phone or email. If you have not paid
the penalty, filed for remission or filed a contested case petition, the penalty is due and payable.
Please make the check payable to Department of Environmental Quality and mail it within ten (10)
calendar days to:
