Sullins Governor Director March 12, 2009 Undrea Major, Project Engineer Project Development and Environmental Analysis Branch NCDOT 1548 Mail Service Center Raleigh, NC 27699-1548 Subject: Response to Request for Removal of NCDOT Transportation Improvement Project R- 4748 from the Merger 01 Process Dear Mr. Major: Dee Freeman Secretary Based on the fact that the preferred alternative for reference project will not have impacts to waters of the State and therefore not require a 401 Water Quality Certification, NCDWQ concurs on the removal of the project from the Merger '01 Process. Should the nature of the project change resulting in potential impacts to waters of the State, NCDOT must notify NCDWQ of the changes and the estimated impacts and submit an application for the appropriate permits and/or certifications. If the changes result in significant impacts, it may be necessary to return the project to the Merger '01 Process. If you have any questions regarding this matter, please contact me at 919-733-5715.
