The linear feet of stream disturbance is shown as 145 LF but according the delineation and buffer determination that was previously completed, this length will be considered as "0" for permitting purposes since the stream is currently full of concrete and debris and the new culvert will be considered an improvement. I have a copy of the report that was done when the delineation and buffer determination were completed and can bring that to the pre-application meeting. WAKE COUNTY, NORTH CARC)l Final Recommendations for Stream 1; Crossing #1: Both agencies recommended that a bridge be used instead of a culvert system to minimize stream impacts. This would expedite the permitting process. However, if a culvert system is used, mitigation requirements would be lessoned if the crossing location was moved to where the stream maintained less sinuosity. To acquire the proper permits, a Stream Quality Assessment form is not required, but an "upland" Wetland Data Sheet form is required (Appendix C). Photographs depicting the area are found in Appendix A - Stream #1; Crossing #1. Stream 1 Crossing #2: Both Thomas Brown (USACE) and Michael Horan (NC-DWQ) agreed that the impacts to the stream at Crossing #2 are not mitigable. The crossing area has been degraded because of development and/or construction off site. Therefore, linear stream impacts at the proposed crossing will not be counted towards the cumulative impacts to the stream during road construction. Thomas Brown further indicated that road construction at this stream crossing would "improve the stream" and provide some credit (-10 -15 ft) to the cumulative linear impacts that Stream 1 will accrue. The removal of the concrete and the placement of a headwall will assist in the restoration of the original stream channel. Final Recommendations for Stream 1; Crossing #2: Although engineers must provide the linear feet of impact to the stream at the crossing, the impacts to the stream at Crossing #2 will not be accounted for when calculating total stream impacts. The impacts acquired during construction are not mitigable. The USACE recommended that the concrete that is present in the stream, which was caused by earlier development off site, be removed and a head wall created to improve stream health and function. Stream 3: Although there are no plans to extend the proposed road across the third stream on site, the area was still assessed for permitting issues. Both Thomas Brown (USACE) and Michael Horan (NC-DWQ) determined that Stream 3 is Non-Regulatedl'Not Subject" for 404 and/or 401 permitting or Neuse Buffer Rules. Therefore, the proposed road construction will not impact the described area. Joint Force Headquarter North Carolina National Guard August 3, 2007 Delineation & 4041401 Permitting of Regulated Wetlands & Waters - Final Report -23- EXECUTIVE SUMMARY This document is a product of contract between the North Carolina National Guard and AMEC Earth &. Environmental, Inc. The contract was established to identify and delineate regulated wetlands and other waters, as well as provide 404/401 permitting guidance as related to construction plans for the North Carolina National Guard Headquarters located in Raleigh, North Carolina. Information provided was collected in accordance with state and federal construction permitting compliances as outlined in Section 401 and Section 404 of the Clean Water Act of 1972, and the Riparian Buffer Protections for the Neuse and Tar-Pamlico River Basins as outlined by the North Carolina Division of Water Quality. The North Carolina National Guard Headquarters and proposed construction site are located at 4105 Reedy Creek Road Industrial Drive, Raleigh, North Carolina in Wake County. The current Headquarters is maintained on 70 contiguous acres and is surrounded by land that is also owned by the Sate (North Carolina Department of Administration and North Carolina Department of Agriculture & Consumer Services). Proposed construction includes, a multi-story Army Forces Readiness Center building; stormwater control and detention structures; paving for privately owned vehicle parking; Military Vehicle Storage Compound; and sidewalks, curbs, and gutters. Thirty four thousand square yards of paving will consist of parking and access roads for the facility. Proposed road construction actions require the crossing of regulated wetlands and/or other waters on the property. Although no jurisdictional wetlands were identified on the property during the site field delineation, three streams and/or streambeds were identified. Field findings were presented to both the US Army Corps of Engineers (Thomas Brown) and North Carolina Division of Water Quality (Michael Horan) representatives during a regulatory site visit on 21 August 2006. Both representatives confirmed that the property does not maintain jurisdictional wetlands and that only one of the three streams identified on the property is "Subject" to regulatory compliance (i.e., Stream 1). Based on the recommendations provided by both regulatory authorities, proposed construction plans were modified. Although current construction plans propose to use a bridge at stream crossing #1, total stream impact was calculated for two construction options (e.g., bridge or culvert). In the event that a culvert system is used, the total stream impact would equal 120 linear feet. Whereas, the total stream impact for bridge construction would equal 0 linear feet. The total stream impact calculation(s) is based, in part; by the fact that stream impacts (130 linear feet) at crossing #2 of Stream 1 are not mitigable. Stream impacts at crossing #2 are not mitigable because the North Carolina National Guard has agreed to remove concrete that is present in stream 1. Once removed, a head wall will be erected to improve stream health and function. Because the concrete was caused by earlier development off-site, the impacts to the stream by the proposed road crossing will not be accounted for when calculating total stream impacts. Because all total stream impact calculations are less than 150 linear feet, a Nationwide Permit (14) is needed prior to construction. To receive 404 permit approval from the US Army Corps of Engineers and 401 permit approval from the North Carolina Division of Water Quality, proper documentation is provided to North Carolina National Guard staff so that they may submit the completed forms to the regulatory authorities at their discretion and/or timeframe. To ensure permit compliance, documentation provided by AMEC Earth & Environmental reflects current permit requirements as updated on 19 March 2007. ES-1 ¦
