Steve and Andrew,
We are providing additional information requested by the Corps and NC DWR as requested from your emails dated
February and 12 and 131H
1) Provide DWR/USACE with a proposed plan for pipe network and stream reconnection at the southern end of impact
E5. This should be submitted prior to construction if it will require additional impacts from those authorized.
The stormwater outlet plan and pipe network is shown on plans included in Attachment A. The updated
stormwater plan and bypass outlet structure was submitted to the Raleigh office for review and approved by NC
DWR on August 28 2017. This outlet has been constructed including 3 rip -rap plunge pools for velocity
control. The rip -rap plunge pools terminate approximately 20 feet before the jurisdictional stream (See
attached photos).
2) Ensure that the E4/E5 stormwater pipe network and stream pipe network are separate at least until the stormwater is
treated.
The stormwater and stream network are designed to be separate until after the stormwater has been
captured/treated. (See Attachment A) Please note that the stormwater systems are being installed but not
currently online during grading.
3) Verify exact impact lengths for impacts E1 -E5 and mark E3/E5 downstream end points in the field.
Impacts E1 -E3: The proposed fill extent locations have been surveyed and staked in the stream bed (See photo,
Attachment B). The location of the existing fill is approximately 70 liner feet less than the authorized impact
location (78 linear feet of meandering stream). The applicant will continue to construct the multi-purpose field
and fill slope in this location and will eventually move the impacts downstream to a location at least 5 feet short
of authorized impacts.
Impacts E4 -E5: The proposed fill extent locations have been survey and staked in the stream bed (See photo,
Attachment B). The location of the existing rip -rap check dam/fill extends 5 feet further than the authorized
impact.
4) Provide proposed plan for correcting unauthorized fill/failing bank stabilization impacts along White Oak Creek prior
to construction.
Associated Land Surveyors have collected topography along the White Oak Creek stream bank in February 2018
and Odom Engineering is designing a long term solution for stabilizing the stream bank of White Oak Creek. A
final design will be submitted by March 301h . During the installation of the bank stabilization activities, the
applicant will remove the concrete block that has fallen into the stream.
5) Provide an update on the Harmon Dairy Compensatory Mitigation work and a projected timeline for its completion. If
progress is not shown that the compensatory mitigation is being conducted concurrently with construction activities,
TIEC will be found in violation of their permit.
The applicant has completed the following:
■ Phase 1 easement recorded pat and conservation easement recoded on January 24, 2017 Deed
Book 424 PG 1193-1201.
■ Phase 1 and Phase 2 stewardship fees of $30,010 has been paid to Polk Co. Soil and Water
Board.
■ TIEC has completed the purchased Phase 1 and 2 easements from Harmon Dairy.
■ The sediment and erosion control permit was received from NC DEMLR on February 26,
2018. Book F, Page 1020. A copy of this plat will be included in the as -built report.
■ The survey plat for Phase 2 was recorded on February 28, 2018.
■ Looking Glass Dairy is meeting with Billy Clarke, Roberts &Stevens, to sign the Conservation
Easement on Friday March 2nd and we expected this easement to be recorded following this
signing and we will forward a copy to your office, If requested.
■ A pre-bid meeting will be held on Friday March 9, 2018
■ Construction is expected to begin in mid-April 2018
■ TIEC is still working on obtaining financial assurances from Ecosystems Insurance Associates,
LLC and will provide a copy of financial assurances to the Corps of Engineers as soon as this
application process is complete.
