On January 11, 2018, the Division of Water Resources— Water Quality Programs (Division) received your
application dated January 26, 2013, requesting an Individual Water Quality Certification from the Division
for your project. The Division has determined that your application is incomplete and cannot be
processed. The application is on -hold until all of the following information is received:
1. The application submittal to the Division was missing page 1 of the narrative. Please provide Page
1 for our review.
2. If the U.S. Army Corps of Engineers requests a response to any comments received as a result of
the Public Notice, please provide the Division with a copy of your response to the USACE. [15A
NCAC 02H .0502(c)]
3. Please provide a detailed discussion regarding what measures will be taken during dredging to
ensure downstream water quality protection. [15A NCAC 02H .0506(f) and (g)]
4. Buck Creek and Little Buck Creek are classified as Trout waters therefore all aspects of this project
(dredging and spoil sites) are subject to the Trout Buffer regulated by the Division of Energy
Mineral and Land Resources
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is not
received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve
the application and it will be returned. The return of this project will necessitate reapplication to the
Division for approval, including a complete application package and the appropriate fee.
