Dear Mr. Draovitch:
On February 15, 2018, the North Carolina Department of Environmental Quality (DEQ) received
compliance boundary (CB) maps for the subject facilities. DEQ has reviewed these CB maps and
requests the following revisions be made or additional information be submitted to support Duke
Energy's assertions.
Asheville Steam Electric Plant
• The 1982 Ash Basin is not being considered part of the waste disposal system in the
NPDES permit renewal. Therefore, please revise the CB map to not include the 1982 Ash
Basin within the waste boundary footprint and revise the compliance boundary
accordingly.
The CB map indicates that a portion of the Interstate 26 corridor is included within Duke
Energy's property boundary. Please submit documentation verifying proof of ownership
of the land underlying this portion of Interstate 26 by Duke Energy.
Belews Creek Steam Station
• The CB map indicates that a portion of Middleton Loop Road and Pine Hall Road are
included within Duke Energy's property boundary. Please submit documentation verifying
proof of ownership of the land underlying Middleton Loop Road and Pine Hall Road by
Duke Energy.

Buck Combined Cycle Station
• DEQ compared the CB map with the Rowan County GIS website. The following issues
will require resolution:
o At the southwest portion of Duke Energy's property, the CB map includes two
properties within the Duke Energy property boundary that are shown on the Rowan
County GIS website as being owned by David & Barbara Brewer (Parcel No.
6502034) and James & Polly Lewis (Parcel No. 6502033). Please submit
documentation verifying proof of ownership of these two parcels by Duke Energy.
o At the southwest portion of Duke Energy's property, the CB map indicates that
Duke Energy owns Parcel No. 6502016. This parcel contains a right-of-way that
splits the parcel in half. Please submit documentation verifying proof of ownership
of the right-of-way by Duke Energy that splits Parcel No. 6502016.
o At the southwest portion of Duke Energy's property boundary, the CB map includes
a portion of Dukeville Road (approximately 400 feet) that is shown on the Rowan
County GIS website as not being owned by Duke Energy. Please submit
documentation verifying proof of ownership of the land underlying this portion of
Dukeville Road by Duke Energy.
Cape Fear Steam Electric Plant
• The CB map indicates that a railroad spur just south of the 1985 Ash Basin is included
within Duke Energy's property boundary. In recent previously submitted maps to DEQ,
this railroad spur was not included within Duke Energy's property boundary. Please
submit documentation verifying proof of ownership of the land underlying this portion of
this railroad spur by Duke Energy.,
H.F. Lee Energy Complex
• The Triangle Pond is not considered part of the waste disposal system. Therefore, please
revise the CB map to not include the Triangle Pond within the waste boundary footprint
and revise the compliance boundary accordingly.
Mayo Steam Electric Plant
• The CB map indicates that a portion of Highway 501 is included within Duke Energy's
property boundary. The CB map includes a footnote indicating that this Section of 501 is
owned by Duke Energy, however, no documentation of proof of ownership was provided.
Please submit documentation verifying proof of ownership of the land underlying this
portion of Highway 501 by Duke Energy.
Please submit the requested information and/or revised CB maps by March 7, 2018. If the
requested information cannot be provided, then the CB maps must be resubmitted by March 7,
2018 with the property and compliance boundaries adjusted to not include the roadways or parcels
noted above. Otherwise, DEQ will post the maps with the draft NPDES permits as submitted and
there may be a need for a future permit modification when (and if) the requested information
becomes available.
