The North Carolina Department of Environmental Quality, Division of Water Resources is
sending you this letter to supplement its January 26, 2018 transmittal letter for Certification No.
WQC004162 ("Certification") with additional information regarding judicial review of the
Certification.
Please note that pursuant to Section 19(d) of the Federal Natural Gas Act,
The United States Court of Appeals for the circuit in which a facility subject to
section 717b of this title or section 717f of this title is proposed to be
constructed, expanded, or operated shall have original and exclusive jurisdiction
over any civil action for the review of an order or action of a ... State
administrative agency acting pursuant to Federal law to issue, condition, or deny
any permit, license, concurrence, or approval ... required under Federal law,
other than the Coastal Zone Management Act of 1972 (16 U.S.C. 1451 et seq.).
15 U.S.C. § 717r(d). Courts have interpreted this provision to apply to actions seeking judicial
review of state approvals or denials of certifications under Section 401 of the Clean Water Act.

Atlantic Coast Pipeline, LLC, dated January 26, 2018. Please note that you should get any
other applicable federal, state or local permits before proceeding with the subject project,
including those required by (but not limited to) Sediment and Erosion Control, Non -
Discharge, and Water Supply Watershed regulations.
This approval and its conditions are final and binding unless contested, This Certification can be
contested as provided in General Statute 15013, by filing a written petition for an administrative
hearing to the Office of Administrative Hearings (hereby known as OAH) within: sixty (60)

2. Compensatory Mitigation
Mitigation must beprovided for the proposed impacts as splecifiedinthe table below. The
Division has received an acceptance letter from the INC Division of Mitigation Services (DMS)
tomeet this mitigation requirement. Until the QIVISreceives and clears your payment, and
proof of payment has been provided to the Division, no impacts specified in this
Authorization Certification (Certification) shall occur. For accounting purposes, this
Certification authorizes payment tothe DK83tmmeet the following compensatory
mitigation requirement [15A NCAC 02H 0506 (b)(6)]:

8. No temporary impacts are allowed beyond those included in this Certification. All temporary
fill and culverts shall beremoved and the impacted area shall bereturned to natural
conditions within 6Ocalendar days after the temporary impact is no longer necessary. The
impacted areas shall be restored toor|gima�|grade, including each stream's original cross
sectional dimensions, p|amfornnpattern, and longitudinal bed profile. All temporarily
impacted sites shall be restored and stabilized with native vegetation. [15ANC4CO2H
q. Approved temporary pipes, culverts, rip -rap pads, etc. in streams shall be installed as outlined
in the most recent edition of the North Carolino Sediment and Erosion Control Planning and
Design Manual or the North Carolina Surface Mining Manual or the North Carolina
Department of Transportation Best Management Practicesfor Construction and Maintenance
Activities so as not to restrict stream flow or cause dis-equilibrium during use of this
Certification, [15A NCAC 02H 0506(b)(2) and (c)(2)]
lO. Mixing of topsoil and subsoils within wetlands shall beminimized tothe greatest extent
practical. During excavation, the soils shall be placed on fabric to minimize impacts whenever
possible. Topsoil excavated from trenches should be piled separately from soils and backM!Ued
into the trench only after the subsoils have been placed and compacted. [15ANCACO2H
11. Wetland Monitoring
Upon restoration oftemporary impacts towetlands, all restored areas shall be monitored
quarterly for at least three years with photo dorornemtatiom. Wetland restoration shall be
considered successful ifall ofthe following criteria are satisfied:
a. the affected wetland satisfies the current federal definition fora wetland (i.e., soils,
hydrology, and vegetation);
b. vegetation is at least 80 percent of either the cover documented for the wetland prior
to construction, or at least 80 percent of the cove/ in adjacent vvetbmd areas that
were not disturbed by construction,
C. if natural rather than active revegetadon was used, the plant species composition is
consistent with early successional wetland plant communities in the affected
ecoregiom;and
d. invasive species and noxious weeds are absent, unless they are abundant in adjacent
areas that were not disturbed by construction,
Three years after construction is conmpleted. ACP shall submit a report to the Division
identifying the status of the wetland reveggtation efforts and documenting success as
defined above using the following link:

restoration sites have not adequately recovered.

Any temporary impacts to wetlands that do not meet the current federal definition for a
wetland, as defined by the 1987 U.S. Army Corps of Engineers Wetland Manual and confirmed
by a Corps representative, at the end of monitoring shall be considered permanent impacts
and shall require a modification of the Certification. If total project permanemt impacts to
wetlands exceed one acre, mitigation at a 2:1 ratio will be required. 115AWC/\CO2H .0506
lZ. Stream and Riparian Area/Buffer Monitoring
Upon restoration of temporary innpactshostream and riparian area/buffens, all restored areas
shall be monitored quarterly for at least three years with photo documentation. Stream and
riparian area/buffer restoration shall be considered successful if all of the following criteria
are satisfied:
a. the stream channel isstable and active erosion isnot observed;
b. riparian vegetation is at least 80 percent of either the mover documented for the
wetland prior to construction, or at least 80 percent of the cover in adjacent riparian
areas that were not disturbed byconstruction;
c. if natural rather than active ,evegetation was used, the plant species composition is
consistent with early successional riparian plant communities in the affected
ecoregiom;and
d. invasive species and noxious weeds are absent, unless they are abundant in adjacent
areas that were not disturbed by construction.
Three years after construction is comnple1ed, ACP shall submit a report to the Division
identifying the status of the riparian revegetation efforts and documenting success as defined
above using the following link:
Form. Stream and buffer monitoring may be extended by the Division if the restoration sites
have not adequately recovered.
Any temporary impacts to streams that require permanent impacts for stabilization /e.g. hp
rap) shall be considered permanent impacts and shall require a modification of the
Certification. If total project permanent impacts to perennial streams exceed 300 linear feet,

24.All fish and mussel relocations shall comply with the following protocols approved by WRC:
"North Carolina Revised Fish and Other Toxa Collection and Relocation Protocolfor ln5treaM
Construction Activities" (September 22, 20171 and "2017 Study Plan: Revised Freshwater
Mussel (L/n/onidoe) Relocations for the Proposed Atlantic Coast Pipeline in North Carolina"
(September 22, 2017[ Any deviation from these protocols require written approval from
WRC. [15ANCACO2H.0506(b)(2))
15. All work in or adjacent to streams shall be conducted so that the flowing stream does not
come incontact with the disturbed area. Approved best management practices from the
most current version of the NC Sediment and Erosion Control Manual, or the NC DOT
Construction and Maintenance Activities Manual, such as sandbags, rock berms, cofferdams,
and other diversion structures shall be used to minimize excavation in flowing water. ACP
may request site-specific exemptions of this condition where conditions at the time of the
crossing are not feasible /e.8., inundated wetland conditions) orconditions are not necessary
(e.g., no flow, dry conditions that are anticipated to remain dry throughout completion of
pipeline installation and site restoration). Toobtain amexemption, ACP must submit the
request to Division staff in the appropriate regional office at least 14 calendar days prior to
the anticipated start ofconstruction oothe crossing and shall not proceed until written
approval from the Division is received, [15A NCAC 02H .0506(b)(3) and (c)(3)]
IG. gk(Ln Cut
Where conditions at the time of the stream crossing are not feasible to be conducted so
that the flowing stream does not come into contact with the disturbed area (e.g. inundated
wetland conditions) and ACP has received an exemption from the Division pursuant to
Condition #I5above, ACP shall comply with the following [25/\NCA[02H.0506(b)(2)]:
a. Turbidity curtains shall be installed as shown on the plans provided to the Division
on September 29, 2017; and
b. Water Quality Sampling shall be conducted:
Sampling shall belocated 5Ofeet above /upstrearn>and 50feet below
(downstream) the crossing;
ii. Sampling shall beconducted for turbidity, Sampling shall also beconducted
for total dissolved solids for crossings within a Water Supply Watershed area;
iii. Monitoring atboth the upstream and downstream locations shall occur at
least two (2)times per day when active construction isoccurring. The first
sampling shall occur thirty /3O\minutes prior tothe start nf|mstrearn
construction. The second sampling shall occur two (2)tosix (6)hours after
the start ofinstreamconstruction;

ix Umonitoring during active construction shows any enceedancesofthe
turbidity and/or total dissolved solids standard, work shall stop until the
source isidentified and nemnediated. Measures and BK4Pnshall bere-
evaluated before moving forward to ensure future exceedanmesdo not
Monitoring at both the upstream and downstream locations shall occur at
least one (1)time per day for four (4) consecutive days once the crossing
(including restoration) iscomplete, [fany ofthe post -construction sampling
show exceedances of the turbidity and/or total dissolved solids standard, the
source shall beidentified and rennsdiated. Daily sampling shall continue until
samples are below the turbidity and total dissolved solids standards.

17. Culverts
Culverts shall be designed and installed in such a manner that the original stream profiles are
not altered and allow for aquatic life movement during low flows. The dimension, pattern,
and profile of the stream above and below a pipe or culvert shall not be modified by widening
the stream channel orbyreducing the depth ofthe stream inconnection with the
constructiVnactioity. The width, height, and gradient ofaproposed culvert shall besuch asto
pass the average historical low flow and spring flow xvithnut adversely altering flow velocity.
Placement of culverts and other structures in streams shall be below the elevation of the
streambed by one foot for all culverts with a diameter greater than 48 inches, and 2O0ofthe
culvert diameter for culverts having adiameter less than orequal to48inches, 1nallow low
flow passage nfwater and aquatic life.
M multiple pipes or barrels are required, they shall be designed to mimic the existing stream
cross section asclosely aspossible including pipes orbarrels atflood plain elevation and/or
sills where appropriate, Widening the stream channel shall beavoided.
If bedrock is discovered during construction, them the Division Regional Office (Raleigh or
Fayetteville) shall be notified by phone or email within 24 hours of discovery,
installation of culverts in wetlands shall ensure continuity of water movement and be
designed to adequately accommodate high mater or flood conditions. When roadways,
causeways, or other fill projects are constructed across FEMA -designated floodvvays or
wetlands, openings such as culverts or bridges shall be provided to maintain the natural
hydrology of the system as well as prevent constriction of the Moodvvay that may result in
destabilization of streams or wetlands.
The establishment of native woody vegetation and other soft stream bank stabilization
techniques shall beused where practicable instead ofrip-rap orother bank hardening

18.
Any rip -rap required for proper culvert placement, stream stabilization, or restoration of
temporarily disturbed areas shall be restricted to the area directly impacted by the approved
construction activity. All rip -rap shall be placed such that the original stream elevation and
strearmbamkcontours are restored and maintained, Placement ofrip-rap Orother approved
materials shall not result in cle-stabilization of the stream bed or banks upstream or
downstream ofthe area nrinamanner that precludes aquatic life passage.
Any rip -rap used for stream or shoreline stabilization, shall be of a size and density to prevent
movement bywave, current action, orstream flows and shall consist Vfclean rock ormasonry
material free nfdebris ortoxic pollutants. Rip -rap shall not beinstalled inthe streanobed
except in specific areas required for velocity control and approved as a permanent impact
area by this Certification. [15A NCAC 02H M06(b)(2)]

21 All mechanized equipment operated near surface waters or wetlands shall be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids mrother potential toxic chemicals. Construction shall bestaged in
order to minimize the exposure ofequipment to surface waters to the maximum extent
practicable. Fueling, lubrication and genere|equipment maintenance shall not take place
within 100 feet of a waterbody or wetlands to prevent contamination by fuels and oils except
as follows: in situations where equipment must continue to operate during fueling activities
such asdevvateringpumps near surface waters, secondary containment structures will be
used toprevent any spillage from reaching the surface waters. Fuel shall not bestored within

regardless mfamount that causes a sheen on surface waters, any petroleum spill regardless
of amount occurring within 100 feet of surface waters, and/or any petroleum spill less than
25 gallons that cannot be cleaned up within 24hours shall be reported to the Division.

solids, conductivity, alkalinity, acidity, sulfates, oil/grease, phenolic, iron, manganese,

26. Stormwater Management and Diffuse Flow Plans

characteristics of these ditches within state protected riparian buffers other than measures
required to minimize the sediment, nutrients and other pollution that convey to waterbodies,
For sites within a state -approved local government stornnwvater program (e.8. Phase N, Water

of the project within Cumberland, Robeson, and Sampson Counties must be in full compliance
with the Certificate of Plan Approval No. Cunobe-2018-035, issued by D[K4LR, Fayetteville
Regional Office, Prior to commencement of construction of the project within Northampton,
Halifax, Nash, Wilson and Johnston Counties, a sedimentation and erosion control Certificate
of Plan Approval issued by DEML8, Raleigh Regional Office, must be obtained and submitted
to the Division using the following link:

29, ACP shall schedule and conduct a pre -construction meeting with the construction
contractors, ACP staff, and Division and DE&4LR staff toreview the conditions and
requirements ofthe respective certifications and permits for clarity and understanding

30. ACP shall schedule and conduct monthly ride -through inspections with appropriate Division
and DEMLR staff to assess compliance with the respective certifications and permits. [I5/\
31. KAa. Leslie Hartz and Atlantic Coast Pipeline, LLC shall conduct construction activities in a
manner consistent with State water quality standards (including any requirements resulting
from compliance with section 303(d)of the Clean Water Act) and any other appropriate

such standards or laws are not being met (including the failure to sustain a designated or
achieved use) orthat State orfederal law isbeing violated, orthat further conditions are

Pipeline, LLC and the U.S. Army Corps of Engineers, provide public notice in accordance with
15A NCAC 02H .0503 and provide opportunity for public hearing in accordance with 15A NCAC
QlH .0504. Any mem/or revised conditions shall be provided to Ms. Leslie Hartz and Atlantic
Coast Pipeline, LLC inwriting, shall beprovided tothe U.S. Army Corps ofEngineers for
reference in any Permit issued pursuant to Section 404 of the Clean Water Act, and shall also
become conditions ofthe 4O4Permit for the project.
32. Upon completion of all permitted impacts included within the approval and any subsequent
modifications, the applicant shall be required to return a Certificate of Completion (available

the Public Notice, The planis and specifications for this project are incorporated by reference
