John and Ray,
I will be unable to attend the external scoping meeting for U-5851 scheduled for
2/26/2018, so I have included the Corps of Engineers' written scoping comments for this
project. My review included the information you provided and an evaluation of
remotely sensed resources including aerial photography, Guilford Co. Soil Survey, LiDAR,
and USGS topographic maps. Given the urbanized nature of the corridor there appear to
be few potential waters of the US (such as streams and wetlands) within the study area,
with the exception of North Buffalo Creek. That said, a delineation of any potential
waters of the US within the study area and subsequent Corps verification would be
necessary as part of the permitting process. If any of the proposed project activities
involve a discharge of dredged or fill material in waters of the US, the project will
require Department of Army authorization.
Typical NCDOT widening projects could be authorized by Nationwide Permit 14 or
Regional General Permit 31, given documentation of avoidance, minimization, and
compensatory mitigation (if warranted). The Corps would anticipate that any
improvements proposed for the North Buffalo Creek crossing would be accomplished
with a bridge; as such, impacts to North Buffalo Creek should be limited to bank
stabilization where warranted. Note that any utility relocations necessary due to NCDOT
road widening should be included in the permit request for the road widening.
Given the very low likelihood for proposed impacts of waters of the US approaching the
Individual Permit threshold, the Corps anticipates that this project would not require
evaluation via the Merger process.
