Failure to Properly Operate and
Maintain a Waste Treatment System

On January 22, 2018, DWR staff with the Raleigh Regional Office (RRO) of the Division of Water
Resources (DWR), conducted a compliance evaluation. At the time of the evaluation staff
observed several items that are a violation of your permit and need your immediate attention -
1. The pump station was not working correctly. Carlos Hernandez (resident) states that he
has to keep the pump unplugged because the alarm stays on He plugs it back in "every
few days". At the time of this inspection the pump station appeared to be registering a low
water alarm I have included a list of contractors that can help you to determine what
repairs will be needed.
2 The chlorine and de -chlorinator tablets on site were old and no longer in solid form. Please
purchase new tablets and submit a receipt to the Raleigh Regional Office immediately. 2-
3 tablets should be placed in each of the chlorinator and the de -chlorinator tubes as needed.
3 The effluent that is discharged from the subject facility must be analyzed once each year
See Part 1(A) of the attached permit about this requirement. A list of NC certified
laboratories that provide this service is attached. Make arrangements for sampling to be
carried out within the next month, and submit results to this office within 3 weeks after the
sampling has been completed. Be sure to include your permit number (NCG551502) on
the sample results

4. The outfall is covered in sediment; therefore, the pipe is not visible. Effluent appears to be
backing up into the chlorinator and dechlorinator tubes Please ensure that the discharge
outlet, and access to the discharge outlet, is always maintained and cleared.
5. You are required to inspect the septic tank at least yearly to determine if solids must be
removed or if other maintenance is necessary Septic tanks should be pumped out every
five years or when the solids level is found to be more than 1/3 of the liquid depth in the
septic tank compartment, whichever is greater. A pumping company can check the status
periodically and determine when pumping is required The Division has no record of the
last time the tank was pumped Please make arrangements to have the septic tank checked
and pumped if needed.
Currently, the wastewater treatment system is not being properly operated and maintained. This
is a permit condition violation of your permit Permit Condition (Operation & Maintenance) (4)
which states, all system components, including but not necessarily limited to, septic tanks, surface
sand filters, other filter components, pump/recirculation tanks, controls and alarms, disinfection
units, dechlorination apparatus, and the outfalls shall be maintained at all times and in good
operating order.
Requested Response
The Division requests that the Permittee secure a contractor/engineer to inspect your existing
system and determine what repairs are needed or what components are in need of replacing_
This is to ensure that the system functions as intended and meets the conditions of your permit
including meeting the effluent monitoring limits contained in the general permitBy copy of
this letter the RRO is requesting that you provide this information to RRO within 60 days
of receipt of this letter. Specifically, it is requested that you submit a written response to
this office detailing how you will ensure in a timely manner that the system is in full
compliance of the permit conditions and functions as intended
If the contractor/engineer determines that any part of the system needs to be repaired or replaced,
the Permittee should inform this office The components that are required when replacing a system
are included in Section A of Part I of the attached general permit. Before construction begins, an
Authorization to Construct (ATC) must be secured from the Division of Water Resources To
apply for an ATC, you are required to submit the following
a A completed and signed Notice of Intent (NOI) application (attached) delivered
to the address shown at the bottom of the NOI.
b. A letter of request for an ATC to Charles Weaver, NPDES Permitting Unit,
Division of Water Quality, 1617 Mail Service Center, Raleigh, NC 27699-1617.
c. Plans and specifications of the proposed sand filter system in triplicate. Plans and
specifications must be drawn and submitted by a licensed North Carolina
professional engineer.

manner. These violations and any future violations are subject to a civil penalty assessment of
up to $25,000.00 per day for each violation. Should you have any questions regarding these
