Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. S&EC completed a wetland delineation and Jordan Watershed Riparian Buffer evaluation for the entire property to identify natural resources so that impacts could be avoided & minimized to the maximum extent practicable. The project proposes two impact areas to jurisdictional wetlands, both necessary for road crossings to access uplands. Impact Area #1 includes some additional wetland impacts necessary for drainage and lot development Impact 1A is proposed lot fill necessary for the construction of residential structures on lots 15 & 16. Impact 1B is proposed fill associated with a drainage easement between lots 15 & 16. This impact is necessary to get the drainage flows from the northern areas of the property, back into the wetland system to the south. Impact 1C is a proposed road crossing. This impact is necessary to access the eastern side of the property and was designed to cross the wetland system at a near perpendicular angle. Impact 2 is a proposed road crossing necessary to access the southern portion of the eastern side of the development and was designed to cross the wetland system at a near perpendicular angle to minimize impacts. All remaining jurisdictional wetland areas and jurisdictional ponds have been avoided. Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 29. With respect to residential developments (NWP 29 -Regional Conditions section 4.0) the applicant does not anticipate any impacts to streams or wetlands associated with stormwater facilities, there are no impact associated with single-family recreation facilities, there are no permanent wetland or stream fills proposed within the floodway/floodplain and the stream classification for this project is WS -IV, NSW (i.e. not High Quality Waters, Coastal Wetlands or wetland adjacent to these waters). Additionally, there are no jurisdictional streams onsite and therefore riprap stabilization is not being proposed. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Construction measures employed will be use of silt fence to minimize erosion and turbidity offsite and within downstream wetland systems, tree protection fencing to limit disturbance outside the limits of construction. Construction of road crossings or other infrastructure will be done when the site conditions are relatively dry to minimize any potential erosion and turbid water discharging into the wetland systems. 2. If this project DOES require a Stormwater Management Plan, then provide a brief, narrative description of the plan: The project is within Jordan Lake, Lower New Hope watershed. The site must therefore meet the Town of Cary's requirements relating to ordinances and policies for stormwater compliance. To meet these requirements the Nitrogen export rates from the site are to be reduced to 4.4 lbs.aclyr,- Phosphorus export rates to 0.78 lbslaclyr. This is being accomplished through the use of one wet pond and one stormwater wetland. Additional peak flows at the point of analysis shall be reduced to predevelopment levels for the 1 -year storm and larger storms must also be controlled to within the anticipated flows from R-40 zoning or 10% of pre -development flows, whichever is less. We have reviewed the materials submitted and offer the following comments. We understand the United States Army Corps of Engineers (USACly) has determined that the Yates Farm (WA0987) lies outside the permit area for the proposed project. Thus, there is no federal undertaking that may affect the historic property and we have no further comments under the federal regulations. However, we remain concerned about the future of the Yates Farm and urge your client to consider alternatives to provide for its preservation either in service to the church or moved off the site and reused by others. As there appear to be no immediate plans to demolish the property, we remain hopeful that the church will see its value to the history of Wake County and consult with Capital Area Preservation and/or Preservation North Carolina to explore alternatives to demolition The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the Advisory Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36 CFR Part 800. Thank you for your cooperation and consideration. If you have questions concerning the above comment, contact Renee Gledhill -Earley, environmental review coordinator, at 919-807-6579 or enyiror=encttlxc-iew aencder.gi2v.
