Tlie North Carolina Natural Heritage Program database was checked for records of tlueatened and endangered species. There are 51 species listed for H�y�vood County that hlve feder�l status. Tlie bog tuitle (G1�7Nemys uuih(enGe�gii) is lisred as tlireatened due to similarity of appearance to the listed northern bog turtle. The bald eagle (Hnlr�reener leucocephllus) is listed under tl�e B�Id aud Golden Eagle Protectiou Act (HGPA). According to the USFWS, i-la}m�ood Couuty is now considered occupied sununer r:�nge for Indi�na bats and NLEB. Appalachian elktoe are tound in some well-oxygenated sueams with moderate to fast Flowing �v�ter and stable, mised substrates of silt, saud, gravel, and/or cobble. S�reams that support �his mussel are typically mucl� larger than Messer Brancli. The only records in Ha��vood County are from the Pigeon River and tl�e lower portions of the East Fork Pigeon aud West Fork Pigeon rivers, tliere are no records from airy tributaries to these rivers. With rare exception, gray bats roost in caves year-round. This project only involves a small bridge replacement, so constn�ction work will not extend far from the esisting right-of-way into areas where caves could occur. There are no caves or mines visible near the bridge and, according to USGS data, the nearest underground mine is over 1 mile away. Therefore, gray bats will not be affected by Uie project. Like gray bats, Indiana bats and NLEB �vinter in caves or mines with stable, but not freezing cold temperah�res. However, in summer, they generally roost under the loose bark of trees, either dead with peeling bark or cavities, or live trees with shaggy bark such as white oak, maples, sycamore and hickories. The construction work will require the removal of trees near tlie bridge. Any obstructing trees will be removed from October I S to April I S(winter clearing) when bats should not be roosting iu the area. Also, on June l, 2015 we conducted a survey of the bridge and did not see roosting bats or any evidence of bat usage (i.e. staining or guano). This bridge is only about 6 feet above the water surface and very cool underneath. Witli winter tree clearing, we recommend a"may affect, uot likely to adversely aTfecY' detennination for NLEB and Indiana bat. Small whorled pagonia generally occurs in open, dry, deciduous woods with acid soil, though habitats can include slopes along streams and mesic forest with white pine and rhododendron. Land use adjacent to the bridge consists of maintained road shoulders, a lawn, and forest. There is wooded habitat south and west of the bridge, but it is heavily shaded with rhododendron. A survey was couducted on June l, 2015 and no small whorled pogania were observed. The nearest record for this plant is over l0 miles from the project. The Carolina noithem flying squirrel, rock gnome lichen, spruce-fir moss spider and spreading avens ai�e found in spn�ce-fir forests and other isolated high elevation locations in western North Carolina. However, rock gnome lichen is an exception because it can occasionally be found at lower elevations in deep river gorges with high humidity and some vertical rock faces that are periodically wet. The bridge site has an elevation of only 2,420 feet and lacks rock faces and other habitat conditions required by these species. The project is limited in scope. Erosion and sedimentation control measu��es wi11 be implemented to minimize adverse effects of the work on aquatic liabitats. Habitats for listed species appear lacking at tlie project site and none of these species �vere observed during field visits. For these reasons and H�ose discussed above, �ve recommend that a determination of "no effect" on listed species apply to this project, except for NLEB and Indiana bats. This project was reviewed by NCDOT's Human Environment Unit in 2013-2014. No survey was required for archeological ��sources. There is a house near tl�e bridge tliat is eligible for listing on the National Register, buf the project received a detei7nination of "uo adverse effecY' due to the minimal anticipated impact of the culvert and the use of aluminum guardrails (see attached fonns). NCDOT best management practices will be used to minimize and control sedimentation and erosion on this project. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion controls are being effectively controlled. If tlie devices are not fimctioning as intended, they will be replaced immediately with better devices. Bridge No. 273 — Haywood Page 3 November 18, 2015 Impacts to Waters of the United States Messer Branch (DWQ Class: C) is sho�vn on Nie USGS topographic map as a perennial stream. The channel is well defined �vith a substrate of sand, silt, cobble and bedrock and is approsimately 6 feet in �vidtli. The stream has sufficient flo�v to support fish and other aquatic life. Messer Branch flows to the Pigeon River. The Pigeon River meets the definition of a Traditional Navigable Water (TNW). For these reasons, we believe Messer Branch is a Relatively Permanent Water (RP� and is under the jurisdiction of the U.S. Army Corps of Engineers. In order to constn�ct the project, it will be necessary to impact waters of the United States in the French Broad River Basin (CU 06010106). Specifically, NCDOT is requesting to replace Bridge No. 273 �vitli a"bottomless" concrete culvert. Listed below is a summary of the proposed impacts. Erosion and sedimentation measures will be installed. One half of ihe culvert will be constructed downstream of the old bridge while traffic is maintalned on the old bridge. Messer eranch, included wlthin the French eroad Niver Drainage Basin, constitutes a second order stream flowing south to north through the project area. It emptles Into the Plgeon River/Waterville Lake a short distance north of the brldge locatlon. A strongly slopfng topography characterizes the majority of the APE and area surrounding this relatively incised stream valley. A map revlew and site ffle search was conducted at the Offlce of 5[ate Archaeology (OSA) on Tuesday, August 20, 2013. No previously documented archaeological sltes are located within the projects APE or adjacent to the study area. Five archaeologlcal surveys have been conducted in thls general vicinity which resulted In the recordatlon of numerous prehistoric archaeologlcal resources (Stephenson 1985, Snedeker 1986, Brown & Rogers 1990, Noel & Snedeker 1993, Espenshade & Garrow 1998). These sites are almost exclusively relegated to upland contexts such as hllltops, ridges, and knolls. In some cases, benches and ridge-toes were also utllized, but to a far lesser degree. Severe soll deflation was noted at the majority of the upland sites. As a result, few were deemed significant, and therefore did not necessitate avoidance or inclusion on the Natlonal Register of Historlc Places (NRHP). The relatively high upland site densitles in this section of Haywoad County are Ilkely a consequence of the severe terrafn, lack of habitable floodplains, and resource orfentatlons. Based on lhis in(ormation, the constricted Messer Branch s[ream valley would Ilkewise harbor prehistorlc sites on well-dralned, upland landforms or well-drained, elevated stream terraces. Follawing revlew of nearhy prehistoric archaeologital sites and others fn Haywood County, the APE does not flt the typical location expected to uncover past activity assoclated with prehistorlc occupatlons. An fnspectfon of Natlonal Reglster of Historic Places (NRHP), State Study Listed (SL), Locally Designated (LD), Determined Ellgible (DE�, and Surveyed Site (SS) properties employing resources avallable on the NCSHPO website concluded that none of the above designated properry types were located within or adjacent to the project area. Construction design data was examined far determining the potentfal impacts to the APE ground surFaces. Aerial photographs (NCDOT Spatial Data Viewer) and the Google Street View map applicatlon (when amenable) were also examined/utllized for addltional assessment of hydrological, agricultural, modern earth- moving, and other erosive disturbances that may typify the APE. Two domestic structures and a cemetery (Teague) are depicted at th(s location (USGS Cove Creek Gap topo) In Ihe past, whlle aerlal imagery relates today, the presence of one house and a large agricultural garden plot fronting Messer sranch. Potential exists for uncovering a few historlc or prehistoric arti(acts from this landform Iocatlon, but the house and cemetery are located beyond any potentlal impact areas, and the probabllity of documenting intact, signfflcant archaeological deposits in the actual APE (s unlikely. Since the 6ridge replacement is diminutive in scope, state-funded, and proposes no alteratlon of undlsturbed ground areas beyond the existing ditch-Iines, meaningful arthaeological sites/deposits are unlikely to be affected by the project. No further archaeological input or work wlll be necessary for this NCDOT brldge replacement project.
