Gentlemen:
On March 2, 2009, the Division of Water Quality (DWQ) received your correspondence dated February 27,
2009 (from Dr. Bert Meijboom) regarding Condition Nos. 10, 12, 23, 14, and 15 of the 401 Water Quality
Certification (WQC) issued to you on May 29, 2008. We appreciate your reply to our February 20, 2009,
correspondence regarding the above. A careful review of your additional information received so far has
revealed the following:
Based on your submitted response, the DWQ believes you have satisfied the requirements of Condition
Nos. 10, 12, 23, 14, and 15 of the 401 WQC with the following considerations:
It is our understanding that you have agreed to monitor the impoundment on a monthly basis for
the months of May - October to ensure thermal impacts to waters within the impoundment will
not exceed DWQ Water Quality Standards for mountain and upper piedmont Class WS-IV and C
surface waters for a period of five years. The NC administrative code (15A NCAC 02B .0211 j)
specifies that temperature is "not to exceed 2.8 degrees C (5.04 degrees F) above the natural
water temperature, and in no case to exceed 29 degrees (84.2 degrees F) for mountain and upper
piedmont waters." Monitoring reports should be submitted to DWQ on an annual basis in
November of each year.
