Beckwith, Regulatory Agent Subject: NWP 14 Application for Pipe Extension, Little Savannah Road Widening, Western Carolina University, West Campus Millennial Initiative Neighborhood 1 Project in Jackson County Dear Ms. Beckwith, Mulkey, Inc. has been retained by Western Carolina University (WCD) to provide design and permitting services for development associated with the Millennial Initiative project. WCU plans to construct Neighborhood 1 of their 344-acre Millennial Initiative on West Campus (Figure 1, attached). Neighborhood 1 comprises approximately 40 acres and will include 280,000 square feet of academic space, 65,580 square feet of private development space, and 262,500 square feet of housing space. The initial anchor of Neighborhood 1 will be the 145,OOO-square foot School of Health and Gerontological Sciences building. An environmental assessment (EA) and fmding of no significant impact (FONS!) document was submitted to the State Clearing House and is open for comments until March 2, 2009. Please accept this letter as a request for a NWP 14 to extend the Long Branch Creek pipe on Little Savannah Road at the project site. Development of the Millennial Initiative project will require roadway improvements for additional lane capacity for dedicated right and left turn lanes on Little Savannah Road. The road widening will require use of a junction box . and extension of the existing reinforced concrete pipe (downstream side) on Long Branch Creek. The new junction box and pipe components will comply with N.C. Department of Transportation design guidelines. Unavoidable permanent impacts will occur to jurisdictional resources due to the placement of the junction box and a 44 linear foot, 60-inch diameter reinforced concrete pipe in the channel. Long Branch Creek at the site is classified as Class C HQW and drains to Cullowhee Creek, approximately 1 mile downstream, which is classified as Trout waters. Road widening and extension of the pipe will create permanent impacts of approximately 2,052 square feet (0.047 acre) of trout buffer along Long Branch Creek. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The proposed project is located on Little Savannah Road, approximately one-half mile west of NC 107 and the main Western Carolina University (WCU) campus. Little Savannah Road (SR 1367) is an existing two-lane transportation facility maintained by NC Department of Transportation. Jackson County Airport is immediately northwest of the project area. East and south of the project study area is a mix of rural development including small apartment complexes, mixed residences, a volunteer fire company, and a recycling and waste center. Land use in the proposed project area (Neighborhood 1 - see 3e below) consists of naturally forested areas and small maintainedldisturbed open areas. 3b. Construction of the Millennial Campus facilities will require roadway widening and lane improvements to Little Savannah Road, including widening at the Long Branch Creek crossing. TheLittle Savannah Road widening will include extension of the existing 60-inch diameter corrugated metal pipe on Long Branch Creek. 3e. Describe the overall project in detail, including the type of equipment to be used: WCU plans to construct Neighborhood 1 of their 344-acre Millenniallnitiative on West Campus. Neighborhood 1 comprises approximately 40 acres and will include 280,000 square feet of academic space, 65,580 square feet of private development space, and 262,500 square feet of housing space. Construction of the overall project will involve clearing, grading, and landscaping pertaining to the construction of buildings, parking, and other infrastructure. Utility improvements related to the proposed infrastructure projects include new water and sewer line connections from the School of Health and Gerontological Sciences building to existing lines along Little Savannah Road. Roadway improvements will add an additional 30 feet of lane capacity for dedicated left and right turn lanes entering the Millenniallnitiative campus. Widening of Little Savannah Road will require extending the existing pipe on Long Branch Creek. Construction will involve typical construction equipment such as graders, bulldozers, cranes, track hoes, dump trucks, and road paving equipment. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. A Campus Master Plan has been completed to provide an overall concept plan for the Millenniallnitiative and to identify potential impact areas. The site plan for WCU's Neighborhood 1 on West Campus was designed with a focus on avoiding and minimizing impacts to wetlands and streams, as well as preserving other significant natural features of the area. The School of Health and Gerontology site plan is in compliance with the WCU Millennial Initiative Campus Master Plan. Wetlands identified within the project area for Neighborhood 1 have been completely avoided and will not be imn::ldArI ....,----_. During construction of the pipe extension on Long Branch Creek, construction equipment will be operated from the existing roadway and will not enter the stream. A 25 foot widebuffer will be maintained along both sides of Long Branch Creek below the culvert extension. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Measures to minimize potential stream impacts include, but are not limited to, provisions for waste materials and storage, stormwater management measures, and appropriate road maintenance measures. Limiting in-stream activities and replanting stream banks immediately following the completion of grading can further reduce impacts. Tree protection fencing in combination with silt fencing will be constructed around the wetlands in order to protect them during construction. Temporary diversions may be constructed at the toe of the proposed fill slope to divert sediment-laden water from the construction site to temporary sediment traps (for drainage areas less than five acres). The traps will be sized to control the ten-year storm event. Check dams will be placed in the temporary diversions to restrict the velocity of flow in these channels thereby minimizing erosion. Silt fence will be installed between the diversion berms and adjacent areas to further ensure that silt does not impact offsite properties and the stream located at the low point of the property. The campus will have a closed stormwater system. All inlets into the proposed storm drainage system will be protected to prevent sediment from entering the pipe system and being conveyed downstream. Construction entrances will be installed at any entry points into the site to provide a buffer area where construction traffic can drop their mud and sediment to avoid transporting this material onto private and public roads, to control erosion from surface runoff, and to help control dust. The proposed erosion control measures will be installed at the beginning of the construction, prior to any land disturbance. All disturbed areas brought to final grade will be stabilized with permanent vegetation within fifteen days. Stormwater controls will be designed to maintain pre-development hydrographic conditions for the 1-yr, 24-hr storm and will be maintained by the University. The final design will encompass a combination of infiltration features as well as a closed piping network and a stormwater dissipation for additional storm water control. 2. Protection of downstream water quality will be provided through the various levels of Federal, State, and local permit review processes. These include the North Carolina Division of Land Resources (NCDLR) sediment and erosion control permit for land disturbing activities. All sediment and erosion control plans must control surface water run-off, limit the size of the area exposed at anyone time, avoid increases in velocities of storm water discharge, and identify on-site areas subject to severe erosion, as well as those adjacent or nearby off-site areas that are especially vulnerable to damage from erosion and sedimentation. Jackson County land use ordinances, including those that address Flood Damage Prevention; Land Development Compliance; Mountain and Hillside Development; Noise; Sediment Control; and Watershed Protection will also offer another level of water quality protection for this project and other projects in the County. 4.
