APPROVAL OF STORMW A TER MANAGEMENT PLAN

On June 26, 2008, the Division of Water Quality (DWQ) issued a 40 I Water Quality Certification to you
to place fill or otherwise impact 0,012 acre of wetland and 820 linear feet of an unnamed tributary to
Larkard Creek in order to construct the "Crate and Barrel Distribution Center" in Lincoln County,

On February 24. 2009. the 401 Oversight/Express Permitting Unit of the DWQ received a storm water
management plan (SMP) dated February 18.2009 (Engineer's sealed date) from your engineer Mr.
Mansour Edlin of Mansour Edlin Consulting for the purpose of meeting Condition #2 of the 401
Certification for this project On March 5. 2009. the DWQ received additional information with revised
SMP dated March 3, 2009_ The revised SMP has been approved by the DWQ and satisfies the storm water
condition required by the Water Quality Certification, You are required to meet the foll.owing conditions:

1_ The stormwater management system (consisting of three wet detention ponds, outlet plunge
pools, and all associated stormwater conveyances and appurtenances), and the grading and
drainage patterns depicted on the plans, as approved by this office must be maintained in
perpetuity, No changes to the structural storm water practices shall be made without written
authorization from the Division of Water Quality, The storm water manage.ment structures shall
have maintenance access and at least lO,foot drainage easement on each side to allow for the
ability to maintain the structures, and to perform corrective actions_ The stormwater easements
shall be recorded to provide protection of the structures from potential alterations by future
property owners_

2_ All operation and maintenance activities shall be followed as stipulated in the Operation and
Maintenance Agreement signed and notarized on August 6, 2008. and received in our office on
February 24. 2009,

3, Notification of Construction: The applicant and/or authorized agent shall contact the DWQ
Express Review Program in writing at the letterhead address within ten (10) days of the
commencement of construction,
