North Carolina Water Quality Certification Condition 9 for the Yadkin Project (No.
2197)
Dear Mr. Collins:
We understand the Federal Energy Regulatory Commission has set a deadline of March 22, 2018 —
less than five months from now - for Cube Hydro to submit the Sedimentation and Flood Protection
Plan for Salisbury's pump station ("the Plan") pursuant to Article 401(a) of the FERC license for
Project No. 2197 and Condition 9 of North Carolina Water Quality Certification for the Project. 160
FERC T 61,098. We understand that upon Commission approval the plan becomes a requirement of
the license and must be implemented by Cube Hydro. 160 FERC 61,098.
As explained by FERC, this requirement incorporates the implementation of Environmental Measure
17 presented in the FERC Final Environmental Impact Statement. Fortunately, substantial work in
support of the sedimentation and flood protection for the p -Limp, station has already been completed by
your predecessor APGI in cooperation with Salisbury.
The development, approval, and implementation of the Plan is an important public health and safety
matter for the City of Salisbury. In light of that importance, and given the short time frame for your
submission of the Plan to FERC, the City of Salisbury would like to offer to host at your earliest
convenience a meeting with representatives of Cube Hydro, DEQ/DWR 401 & Buffer Permitting
Branch, DEQ/DWR Public Water Supply Section (Mooresville Regional Office), Wildlife Resources
Commission, Rowan County, and Salisbury.
