Fox, Fox Hill Farm, Orange County, North Carolina, Neuse River Basin. Action ill No. 200221429 DATE: Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the subject document, and we are familiar with the habitat values of the area. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661- 667d), North Carolina General Statutes (G.S. 113-131 et seq.), and the North Carolina Administrative Code 15A NCAC 101.0102. The proposed project consists ofthe construction of a 9.4 acre pond and an access road, which will result in impacts to 150 linear feet (If) of stream channel (Little Creek) associated with the construction of an earthen dam, 1,600 lfofthe same stream channel resulting from flooding, and 50 If of stream channel due to the construction of a bottomless arch culvert for the road crossing. The proposed road crossing will occur within an unnamed tributary of Little Creek. Impacts from pond construction will occur to Little Creek, which is a WS-IV NSW in the Neuse River basin. Weare pleased that the applicant will use an arched culvert and minimize stream impacts for the road crossing; however, no information on avoidance or mitigation for the pond impacts was provided. In the Eno River there are numerous records for the existence of rare species, including the federal and state endangered dwarf wedge mussel (Alasmidonta heterodon), federal species of concern and state endangered green floater (Lasmigona sub viridis) Atlantic pigtoe (Fusconaia masoni), and yellow lampmussel (Lampsilis cariosa), federal species of concern and state significantly rare pinewoods shiner (Lythnlnls matutinlls), state threatened triangle floater (AlasmidOllla undulata), eastern lampmussel (Lampsilis radiata radiata), creeper (Strophitus undulaws), and alewife floater (Anodonta implicata), and the state special conce.rn notched rainbow (Villosa constricta). We are concerned with the permanent impacts to Little Creek, and we are particularly concerned about the listed species that are located downstream of the proposed project. Streams provide important habitat and have inherent aesthetic, recreational, and educational value. Impounding these aquatic resources will remove their natural functionality and will likely result in vegetation shifts and water quality modification with concomitant changes in wildlife and fish species compositions. We do not feel that we can adequately review the permit without information on avoidance, minimization, and mitigation and survey information for listed species. Please see the survey recommendations below. . We recommend that a mussel survey be conducted on the affected stream. The survey _ _should be comprehensive, but especially target the species listed above. Aquatic surveys _ should be conducted within the proposed footprint ofthe affected area and 100 meters upstream and 300 meters downstream from the proposed footprint of the affected area. Surveys should be conducted by biologists with both state and federal endangered species permits. Qualitative mussel sampling should be conducted by visual (snorkel, SCUBA, or view scope) and tactile surveys and should be conducted during the period 1 April to 31 October. These surveys should be timed to provide catch-per-unit effort (CPUE). Specimens should be documented for identification confirmation with color digital photographs in JPEG format. The resource agencies should be provided a complete compilation of the results of the survey. If species with federal protection status are encountered, sampling activities should cease and findings should be immediately reported to Dale Suiter of the US Fish and Wildlife Service (USFWS) at (919) 856-4520 and Judy Ratcliffe of the NCWRC at (919) 773-0276. Should it be determined that listed species will not be directly impacted and an adequate mitigation plan is provided, we recommend that the following conditions be incorporated into the permit to reduce impacts to fish and wildlife resources. 1. We have concerns about the effects on downstream flows and aquatic habitat. We recommend that flow releases maintain the natural, instream flow volumes downstream ofthe dam. 2. Remaining wetlands and streams on the site should be protected from additional impacts by placing them in a permanent conservation easement to prohibit filling, draining, flooding, and excavation. 3. In order to minimize stream impacts, while retaining some measure of wildlife habitat, we recommend a 100-foot undisturbed, native, forested buffer along perennial streams, and a 50-foot buffer along intermittent streams and wetlands. Maintaining undisturbed, forested buffers along these areas will minimize impacts to fish and wildlife resources, water quality, aquatic habitat both within and downstream of the project area, and help prevent the extirpation of endangered and threatened species. In addition, wide riparian buffers are helpful in maintaining stability of stream banks and for treatment of pollutants associated with urban stormwater. Whereas, a grassed buffer, particularly fescue, is a vegetated buffer but will not provide the necessary and highly valuable functions as discussed for forested buffers. 4. We recommend that a 4-6-foot wide littoral shelf, planted in native herbaceous aquatic plants, be constructed along the edge of the pond to provide aquatic habitat. In addition, Page 3 18 December 2002 Fox Hill Fann Action ID No. 200221429 native trees and shrubs should be planted around the upper portion of the detention structure to provide avian and terrestrial habitat and to reduce exposure ofthe water surface to sunlight. The littoral shelf should provide increased areas for uptake of nutrients by plants, as well as provide additional fish and wildlife habitat. 5. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. This is especially important in areas adjacent to streams and wetlands. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. We encourage the applicant to utilize onsite vegetation and materials for bank stabilization, to minimize the use of rip rap (or hard stabilization methods), and to _maximize the use_ofnatiyesegetatiQnfor stabilization and shade. We_requesl111al _____~ matting along with vegetation be used to stabilize the side slopes adjacent to wetlands to prevent soil erosion into these sensitive areas. 6. Concrete is toxic to aquatic life and should not be allowed to come in contact with surface waters until cured. NORTH CAROLINA 401 WATER QUALITY CERTIFICATION THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ) Regulations in 15 NCAC 2H, Section .0500 to Mr. Randolph D. Fox, resulting in the discharge of fill into 149 linear feet, flooding of 1,600 linear feet, and placement of 50 liner feet of a bottomless arch culvert in perennial streams associated with the construction of a road crossing and pond on your property in Orange County, North Carolina, pursuant to an application filed on 20th day of November of 2002, and in additional correspondence provided January 17, 2003. The stream fill area for the dam, including upstream and downstream stabilization measures, shall not exceed 149 linear feet. The application provides adequate assurance that the proposed work will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application and as described in the Public Notice. If you change your project, you must notify us and send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. Should wetland or stream fill be requested in the future, additional compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed below. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Dam Safety, Solid Waste, Sediment and Erosion control, Coastal Stormwater, Non- discharge and Water Supply Watershed regulations. Conditions of Certification: 1. Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" whichever is more appropriate (available from the Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to assure compliance with the appropriate turbidity water quality standard; 2. All culverts shall be designed, constructed and installed to allow aquatic life passage, as recommended by the North Carolina Wildlife Resources Commission. Generally, this means that the culvert or pipe invert is buried at least one foot below the natural streambed. If multiple cells are required, the second and/or thirds cells should be placed so that their bottoms are at stream bankfull stage. This will allow sufficient water depth in the culvert or pipe during normal flows to accommodate movements of aquatic organisms. If culverts are long and sufficient slope exists, baffle systems are recommended to trap gravel and provide resting areas for fish and other aquatic organisms. If multiple pipes or cells are used, at least one pipe or box should be designed to remain dry during normal flows to allow for wildlife passage. In addition, culverts or pipes should be situated so that no channel realignment or widening is required. Widening of the stream channel at the inlet or outlet of structures usually causes a decrease in water velocity causing sediment deposition that will require future maintenance. Finally, riprap should not be placed within the streambed; 3. That the activity be conducted in such manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (50 NTU's in streams and rivers not designated as trout waters by DWQ; 25 NTU's in all saltwater classes, and all lakes and reservoirs; 10 NTU's in trout waters); 4. All sediment and erosion control measures placed in wetlands and waters shall be removed and the original grade restored within two months after the Division of Land Resources has released the project; 5. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 6. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401/Wetlands Unit web site at htto://h20.enr.state.nc.us/ncwetlands ; 7. Waste or borrow sites shall not be located in streams or wetlands; ~ 8. All temporary fill shall be removed to the original grade after construction is complete and the site shall be stabilized to prevent erosion; '. 9. The enclosed "Certification of Completion Form" is to be used to notify DWQ when all work included in the 401 Certification has been completed; 10. A mid-column, low-flow release must be designed and installed for the dam to release at least the 7Q10 low flow from the dam to maintain downstream uses; 11. A 50-foot-wide, wooded buffer must be maintained along all sides of the pond (except the dam) and stormwater directed to sheetflow before it enters the pond buffer. Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall expire on expiration of the 404 Permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 1508 of the North Carolina General Statutes and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. If modifications are made to an original Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty (60) days following receipt of the Certification. Unless such demands are made, this Certification shall be final and binding. Fox Property. ECS, Ltd. has completed the items addressed in your letter as follows: 1) Based on a conversation with Ms. Cyndi Karoly of the NCDWQ on January 7, 2003, we understand that utilizing a flow meter is an acceptable method of measuring the existing flow in the perennial stream where we propose to construct the dam. On January 8, 2003, ECS visited the stream in question in order to measure the flow rate of the stream in the approximate vicinity of the proposed dam. Based on our January 10, 2003 (4:00pm) site visit, the average flow rate in the vicinity of the proposed dam is 1.52 feet per second. We intend to maintain base flow durin construction of t e stream. Once the spillway pipe is in place for the dam, the stream will then be re-routed through the spillway pipe. The proposed spillway pipe was sized to pass greater than the base flow of the stream (see the attached hydraulic and hydrologic calculations from the preliminary dam report). Spillway capacity calculations were incorporated into HEC-l Flood Hydrograph Package modeling runs for the 50 year and 1/3 Probable Maximum Precipitation Storms. The HEC- 1 outputs give peak flow rates from the spillway during these storms. Flow outputs from HEC-l are also attached. The proposed dam will be equipped with a bottom drain, should water need to be drained from the pond. In drought conditions the existing stream on site would have no flow. For the proposed dam, if it was determined to be necessary, the bottom drain could be opened and allow flow downstream. ~ 2) Mr. Fox has deciqed to place a road arch system over the stream to minimize and limit stream impacts that will be created by the proposed project (see attached P. Additionally, we have tried to place the proposed stream crossing in a topographically beneficial area that will also minimize and limit any stream impacts. The area associated with the driveway arch system will be the only proposed construction to impact protected Neuse Buffers. A 50-foot Neuse River Buffer will be maintained around the remaining portions of both streams and around the proposed approximately 9.4-acre pond. Accordingly, we do not feel that Neuse Buffer mitigation is warranted on the site. 3) Mr. Fox has potential future plans to utilize a portion of his land as a personal (non-commercial) Japanese Maple Nursery and will utilize the proposed pond as a primary irrigation source. This personal nursery will not be commercial and will be very limited in size. If pursued, this nursery will be located at least 100 feet from the proposed pond and stream areas. Since the nursery will be small and for personal use only, and since Japanese Maples do not require a large amount of pesticide and fertilizer; pesticide and fertilizer use on the subject property will be very limited, if not non-existent. 4) We have a preliminary design for the proposed dam and will initiate a permanent design, which will be submitted to the Dam Safety and the Division of Land Quality, once we have acquired the 401 and 404 permits. We have included all preliminary dam plans and calculations in Appendix A. All Dam Safety and Division of Land Quality permits and approval/s will be obtained prior to any construction of the proposed dam. Due to the costs and time involved with design and approval of the proposed dam (in excess of$10,000 and 6-months) and since approval of our requested 401 and 404 permits are uncertain at this time, we do not feel that the proposed dam should be permanently designed or submitted to Dam Safety and the Division of Land Quality prior to issuance of the 401 and 404 permits. ECS Ltd. has extensive experience with dam design and in working with the Dam Safety and Division of Land Quality and feel confident that our dam design will be accepted. 5) Our original application limited the proposed construction impacts to 1,800 feet. Approximately 1,600 linear feet flooded for the pond, approximately 150 linear feet pipe and fill for the proposed dam structure, and approximately 50 linear feet pipe and fill for the proposed driveway, totaling 200 linear feet of cumulative perennial stream impacts requiring mitigation (1,600 flooded). Mr. Fox has decided to place a road arch system over the stream to minimize and limit stream impacts that will be created by the proposed project (see attached figure). The arch road crossing should eliminate the need to fill any portion of this stream. Additionally, we have tried to place the proposed stream crossing in a topographically beneficial area that will also minimize and limit stream impacts. Additionally, based on our review of the preliminary design for the proposed dam, ECS can limit the pipe and fill associated with the dam to no more than 149 linear feet, leaving a total 149 linear feet of cumulative perennial stream impacts. ECS understands that perennial stream impacts less than 150 linear feet do not require mitigation by the NCDWQ. Accordingly, we feel that stream impacts on the site have been minimized and avoided to the maximum extent possible and we do not feel that mitigation should be required by the NCDWQ at this time. Plans were also submitted for a road access that includes the placement of approximately 50 linear feet of a road arch system (bottomless arch culvert). The footings for the bottomless arch culvert will be constructed on the high ground berm of the stream channel and will not result in any discharge of fill into the jurisdictional waters of the stream channel. The project's purpose and need is to provide road access to Mr. Fox's property. Also, the purpose and need for the proposed pond is to provide irrigation to a proposed nursery operation, water supply for fire suppression, and recreation opportunities for the property owner. Evaluation of the probable impacts, which the proposed activity may have on the public interest, requires a careful weighing of all those factors, which become relevant in each particular case. Insufficient information is available for us to complete our review of this project. Specifically, please provide the following information so that we can complete our review of your application: · Mr. Thomas indicated that this project may not qualify for Nationwide Permits 14 or 31, and as such would require an Individual Permit. He noted that you are currently re-considering your proposed design. Please advise us when you have reached a final, preferred design following coordination with the Corps of Engineers as to which 404 Permit will apply to this work. · In your application, you stated that the stream you propose to impact is intermittent. Based upon field reviews conducted by Mr. Thomas and Mr. Mitchell, we have determined thatthe stream in question is perennial, and that significant uses will be lost. As sue cumulative impacts of 150 linear feet or more will require mitigation. . Since the stream impacts associated with this project exceed 150 linear feet, compensatory stream mitigation will be required for this project in accordance with 15A NCAC 2H .0506(h). You have the following options for satisfying the stream mitigation requirement associated with this project: . . 1. Payment into the North Carolina Wetland Restoration Program (WRP),Jf the WRP will accept the responsibility for conducting this mitigation work, or 2. Preparing and implementing a stream mitigation plan. ' . Please note that your application will be considered incomplete until a detailed mitigation plan including a 1:1 stream restoration component is forwarded to this office. We strongly suggest that you locate a mitigation site within th'e .same river sub-basin as your project. At this time we are unable to conclusively determine the stream (and possibly buffer) mitigation requirements due to the lack of clarity in the final design. . If you decide to propose use of the Wetland Restoration Program in lieu of developing your own stream mitigation plan, you will need to notify this office in writing in your response, and we will contact the WRP on your behalf to see if they will accept the project. We propose to construct an earthen dam aild a 9.4-Acre pond on the subject site. After evaluation of several alternative dam designs, we have selected one that limits the impacts to 1,750 feet (Approx. 1,600 linear feet flooded for the pond and approx. 150 linear feet pipe and fill for the proposed darn structure). Drawings showing the alternative designs are included with this letter. We additionally propose a driveway to access the proposed pond. This driveway will impact approximately 50 linear feet (pipe and fill) taking the total amount of stream impact to 1,800 linear feet. Mr. Benjamin V. Wilson, of ECS, Ltd., visited the site on May 23, 2002 and observed the areas of the proposed conservation easements and mitigation. Based on this visit, it appears that there are sufficient streams on site for conservation along with some restoration where existing culverts will be removed. By removing the length of an existing culvert stream crossing on the southern adjacent tract (tract 2); approximately 130 linear feet of impact is removed from our total amount of stream impact. This will reduce the impact to 1,320 feet using a 1: 1 ratio. By setting aside conservation easements at as: 1 ratio for the remaining cumulative impacts of 1,320 linear feet; 6,600 linear feet of conservation easement adjacent to the streams on the property (tract 1) and the southern property (tract 2) will be required. These are shown on the attached drawings. We propose working with the North Carolina Wetlands Restoration Program to achieve our proposed conservation easement plan. We propos'e to construct an earthen dam and a 9.4-acre pond on the subject site. We additionally propose to construct a driveway to access the pond. A proposed dam construction cross section and proposed pond area figure are included. We propose to pipe and fill approximately 150 linear feet of stream for the dam structure. We propose to flood approximately 1,600 linear feet of stream for the pond. We propose to pipe and fill 50 linear feet of stream for the pond access driveway. Total stream impacts are approximately 1,800 linear feet. No wetlands will be impacted. 19. Project Purpose (Describe rhe reoson or purpose of the project..ee instructions) ResidentiaVCommerical development is not planned for the subject site. The pond is planned for fire suppression, flood control, and recreational purposes for Mr. Fox and the Fox family. Additionally, Mr. Fox proposes to utilize the pond as the primary irrigation source for a personal Japanese Maple Nursery that the Fox family will potentually persue if the proposed pond is approved. Construction of our dam will begin as soon as our proposal is approved by the US ACE & NCDWQ. Consturction will be complete approximately 6 months after the start date. Fox 2726 Croasdaile Drive, Suite 102 Durham; NC, 2770.5 Dear Mr. Fox: On March 18,200.2, the NC Division of Water Quality received your application for a 401 Water Quality Certification to impact 1,800 linear feet of streams and 20,00.0 square feet of Neuse Buffers in order to construct a dam and stream crossing at Fox Hill Farm in Orange County. In accordance with 15A NCAC 2H .0506, a thorough inspection of the site has been conducted by Mr. Steve Mitchell of the DWa Raleigh Regional Office, and we have discussed this application with Mr. John Thomas of the U.S. Army Corps of Engineers. Insufficient information is available for us to complete our review of this project. Specifically, please provide the following information so that we can complete our review of your application: . Mr. Thomas indicated that this project may not qualify for Nationwide Permits 14 or 31, and as such would require an Individual Permit. He noted that you are currently re-considering your proposed design. Please advise us when you have reached a final, preferred design following coordination with the Corps of Engineers as to which 404 Permit will apply to this work. · In your application, you stated that the stream you propose to impact is intermittent. Based upon field reviews conducted by Mr. Thomas and Mr. Mitchell, we have determined that'the stream in question is perennial, and that significant uses will be lost. As such, cumulative impacts of 150. linear feet or more will require mitigation. . Since the stream impacts associated with this project exceed 150 linear feet, compensatory stream mitigation will be required for this project in accordance with 15A NCAC 2H .0506(h). You have the following options for satisfying the stream mitigation requirement associated with this project: , . 1. Payment into the North Carolina Wetland Restoration Program (WRP)"if the WRP will accept the responsibility for conducting this mitigation work, or 2. Preparing and implementing a stream mitigation plan. Please note that your application will be considered incomplete until a detailed mitigation plan incfuding a 1:1 stream restoration component is forwarded to this office. We strongly suggest that you locate a mitigation site within th'e'same river sub-basin as your project. At this time we are unable to conclusively determine the stream (and possibly buffer) mitigation requirements due to the lack of clarity in the final design. ' If you decide to propose use of the Wetland Restoration Program in lieu of developing your own stream mitigation plan, you will need to notify this office in writing in your response, and we will contact the WRP on your behalf to see if they will accept the project. You should note that mitigation requirements proposed to be mitigated through the Wetland Restoration Program must be rounded to the nearest linear foot increment according to 15 2r .0503(b). Until the information requested in this letter is provided, I will request (by copy of this letter) that the Corps of Engineers place this project on hold. Also, this project will be placed on hold for our processing due to incomplete information (15A NCAC 2H .0507(h)). Thank you for your attention.
