On September 4, 2017, the Division of Water Resources (Division) received your application dated October 9,
2017, requesting a Buffer Authorization Certification from the Division for the subject project.
On November 1, 2017, the Division determined your application was incomplete and requested additional
information regarding plan details for impacts to the riparian buffer. On December 4, 2017, the Division
received a response to the additional information request. During the review, the Division determined the
project should remain on hold pending the submittal of the required environmental documentation to
Department of Administration and necessary environmental analysis be completed resulting in the issuance of
a Finding of No Significant Impact (FONSI). On December 12, 2018, as recommended by the Division, the
applicant requested the application remain on hold pending the results of Draft EA review. To date, the Division
has not received a copy of the FONSI resulting from the completion of the environmental analysis. Therefore,
by a copy of this letter, the Division is returning your application for Buffer Authorization Certification.
Publication of the draft environmental assessment will be sufficient for the Division to continue processing your
application.
Pursuant to Title 15A NCAC 02B .0259(8)(b) and 15A NCAC 01C .0107(a), the Division of Water Resources is
unable to approve your application. For the reason listed above, your application is hereby returned. Once
you have addressed the problems and/or inadequacies with your application as it was submitted, you will need
to reapply directly to the Division of Water Resources for approval including a complete application package on
the Buffer Authorization application (if applicable). This form can be found online at:

wetlands-buffer-permits/401-application-forms-help-documents. To conserve resources, the Division will
retain existing file materials so that an additional application is not necessary. Upon receipt of your letter of re-
application, any additional information will be attached to the existing file on record for this project.
Please be aware that you have no authorization under the Tar -Pamlico River Riparian Buffer Rule forthis activity
and any work done within waters of the state and buffer may be a violation of North Carolina General Statutes
and Administrative Code.
