On February 17, 2009 the Division of Water Quality (DWQ) received your application which was
unsigned and undated for the above referenced project. DWQ is returning the project for the following
reasons:

Additional Information Requested:

1. Application fee: Based on the noted wetland impacts, the fee is determined to be $570. Check #4704
for $240 is enclosed. You may submit that original check with the additional fee amount of $330 or
you may submit one check for the full amount.

The fee for applications is now $240 for projects impacting less than an acre of wetland and less than
150 linear feet of streams (whether intermittent or perennial, temporary or permanent). For projects
impacting one or more acres of wetland or 150 linear feet of streams (whether intermittent or perennial,
temporary or permanent), the fee is $570.

2. Application not signed or dated. Please note that Agent's signature is valid only if an authorization
letter from the applicant is provided. See page 13 of 14 of the PCN application.

This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at
this time) by the DWQ. Please call Mr. Ian McMillan or me at 919-733-1786 if you have any questions
regarding or would like to set up a meeting to discuss this matter.
