3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
The site is currently undeveloped and sparsely forested with primarily longleaf pine with pond pine and bald cypress
becoming more prevalent in wetland areas. Evidence of past land use for timber harvesting is present but the current
land cover of pines does not appear to be result of silvicultural reforestation activities. The current land cover is best
described as a mixture of longleaf pine forest and pond pine forest with scattered bald cypress within wetland areas and
the current land use is best described as unused/unmodified lands.

open space within the Cypress Village Subdivision.
3e. Describe the overall project in detail, including the type of equipment to be used:
The applicant is proposing to develop the property into a subdivision containing 28 building lots and 1 lot dedicated for
open space. The subdivision will be accessed from Masontown Road following an existing powerline easement. The
road proposed is of the minimum width necessary to safely access the homesites. In addition, standard roadside ditches,
curb & gutter, and sidewalks were eliminated in favor of grassed roadside ditches that both decrease the footprint of the
roadway and provide stormwater management. The 28 building lots are of sufficient size and layout to be built upon
without requiring additional impacts to jurisdictional wetlands. Construction of the development will be accomplished

O. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Impacts to jurisdictional wetlands associated with the Cypress Village subdivision have been avoided and minimized to
the greatest extent practicable while still meeting the applicant's stated purpose and need. The road proposed is aligned
to minimize encroachment into jurisdictional wetlands. By following an existing powerline easement, jurisdictional wetland
impacts at the first crossing have been concentrated in a currently disturbed portion of the wetland. The second wetland
crossing is placed at a narrow portion of the wetland to minimize the impacts associated with this crossing. The road
proposed is of the minimum width necessary to safely access the homesites. In addition, standard roadside ditches, curb
& gutter, and sidewalks were eliminated in favor of grassed roadside ditches that both decrease the footprint of the
roadway and provide stormwater management. Building lots have been designed such that each is buildable without
encroaching into jurisdictional wetlands and no driveway crossings to access homesites will need to be placed in
jurisdictional wetlands. Stormwater runoff resulting from the development will be treated to provide non-erosive discharge
of treated stormwater into wetland areas to maintain predevelopment hydrological conditions in wetland areas.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Erosion control measures will be implemented throughout construction in order to avoid degradation of wetland areas. All
work in wetlands will be conducted from construction matting to minimize impacts to wetlands. Staging areas and
material stock piles will be placed in upland areas.

2c. If this project DOES NOT require a Stormwater Management Plan, explain why:
2d. If this project DOES require a Stormwater Management Plan, then provide a brief, narrative description of the plan:
The proposed subdivision was designed to meet the Low Density requirements for the coastal stormwater rules effective
October 1,2008. Although not required, flood control "peak attenuation" is provided through a peak attenuation basin and
Low Impact Development methodologies, including no curb & gutter, roadside ditches and grassed yard swales. The basin is
designed to detain the volumetric difference between flows generated from pre to post conditions of stormwater runoff. Flows
to wetlands at non-erosive velocities are provided by use oflong, shallow trapezoidal roadside ditches, grassed yard swales
between residential lots, and the peak attenuation basin. The grass ditches and yard swales provide shallow flow conditions to
remove sediment and treat stormwater, in addition to the peak attenuation basin that allows for further sediment removal
through settlement over the runoffs detained time period. The subdivision's Low Density requirements for the coastal
stormwater rules mandate a limited maximum amount of impervious area per lot. A home owner's association (HOA) will
provide the maintenance ofthe stormwater management system. The HOA charter includes deed restrictions and covenants
that state the maximum built upon area (BUA) of 4,467 square feet per lot for the 28 lots.

Subject: Masontown Rd Property
Mickey, is there an Action ID number for the property you reviewed with me for Ray Murdoch on Masontown Rd in
Newport, NC. I have a copy of the signed plat but I cannot locate the formal JD approval or the Action ID number.
I need this for the permit application on Ray's behalf that you will receive soon.

Dear Mr. Smith,
Thank you for your interest in purchasing mitigation credits from the Hofmann
Forest wetland mitigation bank. Should Hofmann Forest wetland restoration credits be
deemed acceptable by the permitting agency for the mitigation of 0.27 acres of
non-riparian wetland impacts for the Cypress Village project [HUC03020106; Action
ID # 2008-02703] we can offer you the ability to purchase those credits in either a 1: 1 or
2: 1 ratio. This letter confirms that you will be allowed to purchase the mitigation credits
you require for this project from the Hofmann Forest wetland mitigation bank.
Please always include the exact number of credits desired and your Action ID # in any
further correspondence. If you have any questions please don't hesitate to ask. Thank you
for your cooperation and support.

STORMWATER MANAGEMENT PERMIT APPLICATION FORM
LOW DENSITY SUPPLEMENT
This form may be photocopied for use as an original
A low density project is one that meets the appropriate criteria for built upon area and transports storm water
runoff primarily through vegetated conveyances. Low density projects should not have a discrete stormwater
collection system as defined by 15A NCAC 2H .1002(18). Low density requirements and density factors can be
found in 15A NCAC 2H .1005 through .1007, DWQ BMP Manual (2007), and Session Law 2006-246.
