Reference is made to the 401 Water Quality Certification issued to you on December 19, 2007, to
construct the above-referenced project. On January 21, 2009, KHA, Inc., on behalf of the Town of Apex,
requested that the DWQ rescind the above-referenced project. The DWQ rescinded the above-referenced
project on January 21, 2009.
