It is submitted on behalf of Mr. Bill Balkcum for the construction of a driveway within a designated easement to provide access to an existing single-family residence on his property. Mr. Balkcum's existing access goes through a neighbor's property located outside of an easement. This access is not reliable and is sometimes blocked. In order to maintain reliable access to his property, he obtained an easement in which to build a driveway. Construction of this road will result in 0.155 acre of wetland impacts. The applicant has minimized the width of his driveway to 12' (with 7 -ft shoulders) and will install two culverts at the crossing to ensure a continued hydrologic connection. Note that a previous application was submitted back in December for this project that proposed less than 0.1 acre of impact. Brad Shaver with the USACE was concerned that the steep slopes proposed in that design would lead to maintenance problems. So Mr. Balkcum agreed to increase the slopes to 2:1, which increased impacts and requires written concurrence from the NC DWR. Enclosed are the PCN form, site maps, and site plan drawings. Copies of the application and the 401 WQC application fee have been submitted to your Raleigh office. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant's property does not have road frontage along Middle Sound Loop Rd. He currently utilizes a driveway that crosses a neighboring tract to access his existing home. This access is not within an easement and is not reliable. To ensure reliable access his property, he has obtained an easement located in a different part of his neighbor's tract. This easement has wetlands that extend across it and it is not possible to access his home without crossing wetlands. The applicant has minimized the road width as possible and two culverts will be used to ensure hydrologic connectivity will be maintained. 1 b. The NC Natural Heritage Program GIS layer was used to determine the presence of federally listed species. No federally protected species are known to occur on or within the site. The Atlantic sturgeon and Wes Indian manatee are known to occur within a one -mile radius of the site, likely within the lower limits of Howe Creek, located about one mile southeast of the site. The northern long-eared bat is also known to occur in New Hanover County. Wetlands within the easement are depressional and support black gum and cypress trees. Uplands are densely vegetated and support loblolly pines and sweetgum. These forested areas could potentially provide appropriate winter and summer roosting habitat for the NLEB. Approximately 0.3 acre of forested habitat will be cleared for the proposed road. However, no roost trees have been identified in close proximity to the site and no percussive activities are proposed for the road construction. Therefore, any adverse impact from tree clearing appears to be exempt per the programmatic BO. The project area does not appear to provide appropriate habitat for any other federally protected species known to occur in the area. 6. Essential Fish Habitat (Corps Requirement) 6a.
