On January'9, 2018, the Division of Water Resources (Division) received your application dated
January 9, 2018 requesting a 401 Water Quality Certification and Riparian Buffer Authorization
from the Division for your project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until the following
information is received:
The project involves fourteen stream crossings that have the potential to affect
downstream water quality both temporarily during construction and permanently: Your
application to the Division provides thorough general descriptions of the
plans for the project. However, more site-specific detail is necessary to ensure that
downstream water.quality is protected. Provide the additional justification requested
below:
e Provide more a detailed analysis of why boring or -direction drilling would not be feasible
or practically accomplished to avoid impacts to the stream channel. Provide site specific
reasons why each crossing cannot be completed using boring or directional drilling.
® Provide a detailed analysis or construction sequence of how you propose to work in the
dry. Provide documentation of what sized pumps will be used and if spare pumps will be
available in case of an emergency. ,

• Provide an explanation of and details showing how turbidity curtains or other sediment
barriers will be installed where the open-cut/excavation method will be utilized to cross
stream and wetland complexes.
In addition to your written response, if you believe a site visit is warranted, please

Pursuant to Title 15A NCAC 02B .0233 (8), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information
is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies
of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699-1617.
Please be aware that you have no authorization under the Water Quality Certification Rules or
the Neuse Riparian Buffer Rules for this activity.
