Deanna Ballard Attachments: 95-03 REN -MOD 2015.pdf John/Andy, Staff review of the approved mining plan and permit conditions of Radford Quarries' Boone Quarry Mining Permit No. 95-03 indicates that buffers within the mining permit boundary vary from 0 feet to 50 foot unexcavated (roads and erosion and sedimentation control measures are allowed within these buffers, but no excavation/mining can occur within this zone) along the permit boundaries and 50 foot undisturbed (natural vegetation) buffers exist along streams. The buffers required are as shown on the mine maps last revised August 6, 2014 and received on September 21, 2015. There are many other operating and reclamation conditions addressing environmental protection and public safety matters contained in this mining permit — copy attached. Please note that GS 74-60 of the Mining Act of 1971 refers to when written notice to the operator is required (such as a Notice of Violation), it must be mailed by certified or registered mail. Notification to adjoining landowners or affected persons by the applicant or the Department is only required when new permits and permit modifications that add land are issued as required in GS 74-50 and GS 74-61 of the Act — see this link for the statute: https://www.ncga.state.nc.us/EnactedLegislation/­Statutes/HTML/BVArticle/Chapter 74/Article 7.html Please advise if you need further information or clarification.
