Doug,
As per your request, I called John Vilas of the Town of Boone
(Inspections Dept.) - (704) 262-4530 - this morning to inquire as to
the concerns they have with recent "dumping" at the plant/shop area at
the site.
John said that very gradual dumping of fill material has occurred
behind the shop building in the area of previous concern (in the
floodway). I believe our permit requires that the fill area not be
extended without a modification to the mining permit. The Ceciles
were required to seed/stabilize this area back when we issued the
renewal permit. Now, it appears that material is being dumped (on the
weekends according to the trailor park owner across the side street
from the dumping) by area contractors. John said the material is not
clean soil material - it contains concrete and rebar and other debris.
John was going to set up a meeting with the Ceciles to discuss the
situation and the Town's zoning/permitting requirements for such an
activity. However, he wanted us to look into it from our perspective
first so that when the meeting is held, the Ceciles can be advised of
what they need to do to gain compliance with both LQS and the Town.
Thus, Doug, can you or staff please inspect the site in the next
couple of weeks to determine if the fill area has expanded beyond the
approved area shown on the map? Then contact John and me as to your
findings. It would be beneficial if you could attend the meeting with
the Ceciles once John sets it up.
