comment period:
Work in the Dry —All stream crossing shall be conducted in the dry (dam and pump, flume,
HDD) instead of in the wet (open cut) unless an exemption is granted by DWR for a specific
crossing
o If open cut crossing is approved by DWR, ACP will install turbidity curtains and
conduct water quality sampling above and below impact
Stream and Wetland Monitoring — upon restoration of temporary impacts, restored areas
shall be monitored for three years with photo documentation
o DWR may extend monitoring requirement
o Wetland areas that are not jurisdictional at end of monitoring shall be considered
permanent impacts — mitigation may be required (per rules)
o Streams that require hardened structures for stabilization (e.g. rip rap) shall be
considered permanent impacts — mitigation may be required (per rules)
IHIDD — Documentation of the composition and properties of drilling fluids and additives,
including manufacturer's literature and Material Safety Data Sheets for each horizontal
directional drilling crossing must be submitted to the Division (will be available through
Laserfiche)
Well Testing — Requiring private well testing to be done both before and after construction
within 150 feet of the limit of disturbance or 500 feet from basting areas.
o Testing after construction was proposed by ACP only in response to a complaint, we
are requiring it for all wells.
o Testing after shall be conducted by an independent qualified groundwater specialist.
Construction SW Permit — ACP volunteered to seek coverage of and meet the requirements
of North Carolina's NPDES Construction Stormwater Permit (NCGO10000) Section 11.13 for
the entire construction corridor in North Carolina (gas lines are exempt from NPDES
stormwater permitting)
Pre -construction Meeting — Pre -construction meeting with ACP, contractors, DWR and
DEMLR prior to any surface water impacts
0 Regular Inspections— Monthly ride -through inspections with DWR and DEMLR
